THE OMAHA DAILY BEBK MONDAY , JULY 20 , 1891. Its Use May Bring On an International Dispute with KING LEOPOLD'S ' DEMAND REFUSED , A Iiltllo I'rolinto CIIHO Thnt Has HtinlcntMl tliu Malta or Severn ! NutloiiN mid IH Still Unsettled. If King Leopold of Belgium should mass hU nrmlcs nnd navies , sail over the occnn , aeclnro war ngnlnst the United Stnles , dovns- Into the cities nnd towns , MIOIC , burn nnd de stroy Omaha , nil dumairo should bo charged against Judge GaarrfaV. . .Shields of the county court. The Judge Is to ultimo for the trouble Unit may nrUe. Ho lias deliberately snubbed the Belgian consul. It happened In this way. Some months ngo Mayor Gushing employed n coachman and all around worker , Who was known lo iho public ns Chnrlcs Kondclny , Chnrlos , nt ono time , by birtti was a subject of King Leopold , but to hotter his circum stances left his mother country nnd cnmo to this land of iho frco nnd the bravo , noplni ; to grow up with the country. In duo tlmo ho reached Now Vbrk , nml later , with a few dollars and n grip sack , gotoft the train nt the footof Tonlh street. Ho struck nn em ployment agency fora Job , but fnilod to got what bo was nflor. Mayor Gushinir wanted n conchtnnn and Uondelay got the position. Ho wns duly installed , milked the cow , combed down the horses , watered the lawn and , while the members of the family were nt home , slept In a room over the cnr- riago house. Lnst.summer Mayor Gushing and his wife took nn outing. The mayor wont to Now Yorlc nnd Mrs. Gushing went to Manltou , Gol. The servants were loft nt home , nnd being ufrald of burglars , Gharles was as signed to .sleep in ono of the chntnbors. Charles wns twcuty-llvo ycnrs of ago nnd n man who made few friends. Ills principal companion was the mayor's dog , which al ways occupied iho room with iho man from Leopold's country. Now , Uondelny ought to have known bet ter , but on the night of August 11 ho went lo bed und took the dog with him. The next morning ho did not arise , ns wns bis custom. The maid of all work prepared the break fast and waited. Th6 incut burned vvhllo she waited , nnd nt last , growing slightly ux- nspenitcd , wended her way to Rondelny's room to call him. The calling was uselo'ss , for the spirit of the man had taken flight nnd pushed beyond this viilo of tears. Tlio door was locked and would not open. Sus picion dawned upon her that all wns not right nnd going down ttio stairs three steps nt n Jump. She hastened over the way to a point whcro some carpenters were building a house. There she told her suspicions nnd ono or two of the men accompanied her to the room , whcroith the aid of n chisel the door wns forced. A sad sight mot the gnzo of ttio little group , for on the bed Kondclny lay n cold corpse and under the bed the dog wns another. The room wns full of bad uir nnd escaping gas. The next move was to notify the coioner who hold an inquest , put in n bill of $10 to the county nnd said tlio dc.ith was caused by the man taking on n greater loud of Illuminating gas than ho could conveniently carry. Hondclay was buried according to the rights of the country and upon the petition of Mayor Gushing , C. ' .I. Smyth was appointed by Judge Shields to look after the worldly effects. During his life Rondclny had bean a model of economy and hail laid away some wealth which consisted of $ . ! " > in cash , n $255 note against n Minnesota man , two out-lying lots in St. Paul , besides some $ oO that the mayor owed him. , Smvth as ndministintor tools possession of this , paid the funeral expenses nnd then commenced to cast about , for the bolrs. None were found In this country , but after n while it leaked out that a brother or a sister lived over the seas. Tliov opened n concspondcnco mid n short time thorcnflor Judge Shields received n letter from Henry Lohcrl , the Uelcian consul , who dornniiuod the property constituting the Itondelay os- tnto. bhlehls did not send the property , but did send n letter. This did not suit the gen tleman of rank , who wrote the following : CONSULATE Di.llu.mo.UK , ST. MAIIY'S , Kan. , U. S. A.-Kr. MAHY'M. Kan. . May Si. IMII.-U. W. Shields. Umaha. Gushing. mayor of Omaha , Hied his petition praying for the appointment of an administrator for the estate of I'harles Komlelay , alleging that the deceased at the time of his death was an In habitant of Iho city of Omaha , Douglas county , Ncbraskii. IH'll , duly allo.ujd as a valid claim against the said est ite. After this wis all done I he , ml from this man at St. Marys. ICnn. The tone of thu letter at Hist uavo me t'.iu Im- piesslon that be was the king of the ItuUlans. It Informed me that I had committed n grave olTense and error In appointing an adminis trator of the Uondelay estate. He demanded that I at once dismiss all prnci'cdlius. This. of course , I lefusoJ to do. Ilo also demanded that U. . I. Smvth. tliu administrator , send to him at St. Marys , Kan , all the papers , money and pioperty bo onlng to the estate. This the administrator very properly refused todo. I claim that thu section referred to In the treaty with llelglum was never Intended to oust probate courts of jurisdiction lo appoint administrators or bcttlo estates at the domlcil of the deceased. The only purpose of the section , to mo plainly o\piosseil , is th it thu heirs shall bo not , lied ot the do.ith and of the condition of tliu estate ; and that tliu consul s'lall h tve the right to appear as attorney In fact , or as an agent to protect thu Interests of thu absent hells and ci editors. If the position of the gentleman from Ilel- glum Is correct , then when a clt.7cn of llol- uliun dies In any of the United Stutoi of America , thu probate jlldgo ot the county where ho dies must do ono of two things : Either appoint tlio Uelglum consul adminis trator , lhouili ho be a resident of another state , or notify such consul and .see th.it the property of the deceased Is sent to him Into another state. To compel the county Judt'o In such cases to appoint such consul , whether or not the consul Is a lit person or appeared In court and took the oath and wave the bond as prescribed by law. would bu nonsense. U would be. contrary to the law and the functions of the Jrnlu-o. 1 cannot bclluvc that that was the Intention of the truaty. Kven had the petition pruyed for appointment of .Mr. Lobert of St. Mary's. Kan. , as administrator , I bclievo the law would compel mo to rufusu thu prayer for the reason. If for no other , that he lived beyond the jurisdiction of the court , and that being so I could have no method of en forcing any orders against him. The mere statement of the othcrproposltlon Is Hiilllclent to condemn It. The Ilka that thu Unite . I States of Amoi lea would enter Into n tiuaty with llolgium. oruny other power , that when a foreigner died In ono ( if the United States , the consul could taUu possession of all the person il otluets of the deceased , ship them to the old world and leave thu ciedttors with out a remedy Is simply monstrous. Hut. no loial evidence hp.s been Introduced before me , directly or indirectly , to snow that the deceased at the tlmo 01 his death was a ritl/en of llolgium. On the contrary , I have been creditably Informed that ho had at least tuUcn out his Hist papers hero and had ab- lured and renounced all allo lance to any foreign government. I bollovo 1 have performed my duty thus far In accordance with tlio treaty , tliu law and common sense ; and I believe It Is my duty to see tint the estate Is pioporly admin istrated , and to recognize Mr. Lobort. consul. as thu attornoy. In fact , for the absent heirs If any such there bu. Very respectfully , U. W. SMIIM.DS , County Judge. The Judge now fools that n great weight has been lifted from his mlna nnd Is linger ing between two decisions as to his future.
