Tbc evidence disclosed the fnct that the deceased hail been In ilia habit of frequently dropping into the brewery to get a glass of boor , nnd on the day In question was so drunk that ha annoyed the employes and w.is Dually nut uut. Englobert rieckcnstoln was the first wit ness , lie testified to Foloy's condition , nnd he finally took tlio troublesome caller by tno collar and led him to the door. S. Wolsholl saw nbout the sarno thin ? , nnd A. S. Aucbmoedy , head bookkeeper for Kriiff , testilled that ho saw Foley carted nway In tlio patrol wagon. Ur. ( Jhnrles Allison , Iho doctor who con ducted tlio post-mortem on the body of tbo deceased , was the next witness. Ho founa a scalp wound nbout an Inch long a little to the right of the back of the head , nnd the skull underneath was fractured. Ho also found the tissues of tbo left sldo of tbo bead nnllltratcd with blood over a surfaca two by four menus in sl7e. At this point the coroner took occasion to correct the witness by reminding him that the clot was on the right side. The attorneys for Hornborg objected to ttio interruption , but Hiirrignn insisted , stating that ho was present at the post-mortern nnd didn't ' want tbo doctor to make a mistake. "Well , but the doctor Is under oath , nnd you are not , " protested the attorney. It didn't make any difference , however , as Ur. Allison refused to bo corrected , but maintained his former position , stating again positively that the lanro clot was on tbo loft Hldo. Ho thought that it was the result of tbo blow on the other side of the head , which was caused by some blunt substance. Ho found evidence of heart trouble , but this would have tendency to have retarded death In this Instance , as a moro vigorous heart would surely have hastened death. James 1' . Urcnnnn , a young man in the employ of I'axton & Gallagher , was the only witness who really threw any light on the nssnult that Is nllcged to have resulted in Foloy's ' death. Ho was riding along Eleventh street under tbo viaduct , and was about sixty-live foot axvay from Foley , when bo heard a blow , lit ) looked in that dlicctlou nnd saw Foly falling. Ilornborg stood close besiilo bun with a wairon stake in his hand. Foley lay upon the sidewalk whcro ho tell , nnd Ilornberg climbed back upon his wagon nnd resumed his work of unloading beer barrels. Ho had about two-thlids of a leaden on bis wagon nnd nfto * unloading them drove nwny.Foley was still lying upon the sidewalk nnd the witness uotillod Oflleer Bloom that a man had been knocked down nnd needed his atten tion. Ilo aftci wards saw Foley lifted into the patrol wagon and tbo injured man was tnen unable to stand. Ilo thought Foley must have been loft lying there alone for fifteen minutes. Ho mot Hornbcrg on the street about half an hour afterwards , and the latter then told him that Foley was abusive nnd bothering the men nnd was pat out of the building ; that In getting across the chute he was struck with a keg , and at cnco asked Ilornberg "If ho was the who struck him with a kcp. " Hornbcrg told him thai ho was unloading kegs and didn't know whether he bit him or not , but ho was not a , and thereupon stepped down off the wagon nnd slapped him with his open hand , knot king him down. This was told the witness by Hornbcrg , who also told him that after driving his team nround the corner ho went buck nnd raised Foloy's bend and asked him If bo wanted a glass of beer , and Folcy replied "To h 1 with your beer. " Tbo witness could not tell whether Horn bcrg struck Foley with the stake or not , as ho heard the blow and only looked In time to see Foley falling. lie could not say whether tlio wound on Foloy's head was made by Iho blow or by striking tbo sidewalk. Hornocrg was not present , and his attor neys did not know whether they would allow " him to co upon the stand or not" The Jury thought It strange that no ono but Brennnn could tell anything about the case , nnd asked for moro witnesses , but the coroner evinced a desire to rush the inquest through , nnd said ho would not adjourn or oven take n recess for dinner. The jurors , however , inti mated that they know their rights nnd privi leges , nnd announced their determination to find out moro about the cuso , after which the coroner subsided. The jury decided to visit the brewery and Insnect the sidewalk where Foley was knocked down , and promised to ro- turu as soon as they could. Say ! Ous O'Knln , a Missouri Pacific switch man , was working in the company's yards yesterday afternoon , helping to switch sotno of the cars belonging to tbo Sells Bros' . circus. In some way O'Knln ' was caught between tbo bumpers at the thighs and quite badly Injured. No outward marks wore visible beyond n number of bruises , nnd it is supposed that ho Is Injured Internally. O'ICain was taken to Kansas City last night nnd will bo placed in tlio railroad company's hospital there for treatment. The Injured man was twenty-four years old ami unmairicd. The council cdmmttlco on police and Count Pulaskl , the dog catcher , had another round yesterday afternoon , This committee is at tempting to prove that Pulaskl Is maklnp more than the regulation fees out ot the ol fico. It was the second day of , the lnvcstlga < tlon and Councilman Bpccht presided , Jacob Hlngoldt was the first witness called , ThU man is in the employ of Pulaskl as an assistant dog catcher. Ho went to work May 1 , caught dogs for n few days , but by an order Issued from the city council , let loose nil Im pounded dogs nnd did not catch any more until May UU. During the thrco days that followed ho helped destroy seventy-two dogs. Pulaskl was called. He commenced catching dogs May 1 , but stopped soon after on ac count of an order , from the city council. Ho could not remember bow many dogs were killed during the month of May , but thought the number might have been eighty-three. Ho know a good many were turned loose after the council ordered the slaughtering to co.iso. Dogs were nlways kept four days before being drowned. This enabled owners to call for their curs. Charley D.ivls had been In the employ of Pulaskl for a number of months. Ilo swore that the gang started out after dogs on May B. They caught and killed sixteen nnd then rested from thulr labors until Mav U ! . when they caught and killed sixteen more. Pulaskl paid his men 'JO cents each for doga , and told them to get as many as possible. At this point Mr. Spocht presented a sworn statement from Pulnski , submitted to the council Juno 1. It shows that durlnir the mouth of Mu. > Pulnski caught clghty-threo dogs. dogs.Davis Davis resumed reciting his experience as a deputy pound master nnd dog catcher. During the early part of the present month , acting under Pulnsiti's instructions , OUP af ternoon ho went out to Walnut Hill and stele Johnson's cattle from the herder. Tno aim is to pjrfect an oreanlzation for the higher elevation of medical , surgical nnd sciontUic attainments ; for the promotion of a moro thorough mutual Intercourse among liberal physicians and specialists ; for the In- terchaniro of scientitic knowledge ; to secure fair and equal legislation and advance the just claim of those who practice medicine and the different specialties of medicine and sur gery in the estimation of the bolter clns of people and of the law. The division of the congress into grand sections representing different western states , nnd into sub-sections of various pathological pusuits may bo alike contemplated. All liberal minded physicians and surgeons who believe In equality before the law , are especially invited to co-operate. Ordinary trains of the Pennsylvania lines carry all classes ol passengers , hav ing cars appropriate for each class , and leave Chicago for Pittsburg and various points cast thereof nt 7:15 : a. in. . 9:45 : a. m. , 8:15 : p. in. , 8:20 : p. m and 11:150 : p. in. from the Pennsylvania station , Adams , Canal and Mndihon streets. LOOK UP THE LiY\V. Inspector Striken a Snafj at the Start. The committee consisting of Messrs. Cooper , Osthoff and Olson , appointed by Lho city council to investigate the affairs of the license in pcctor's ofllco , held a meeting In tho'llconso board rooms yesterday after noon. Inspector Thomas Illloy made n statement to the board nnd claimed that ho had never collected any money , but , had always told people to no to the troasurer'o ofllco and gel their license. Ho denied knowing anything nbout his son's alleged crooked transactions , nnd stated that ho understood that his assist ant had merely borrowed the money from the Italian fruit peddlers. The witness also said that quite a number Df tbo fruit stands did not pay any license nt all. Where space was rented from a prop- 3rtv owner Assistant City Attorney Hhoo- inaker bad decided that no license could be collected. The committee thought this was rather a queer decision , nnd an unjust ono nut decided to look Into that point of the law. Young Frank Itlluy , the accused man , was not present ; neither was Louis Follu , the fruit do'ilcr who filed the nftldavit apalnst Itilov.
