The mysterious disappearance of Miss

The coupe driver who took the couple from
the residence of Mr. Athcrton , was found
yesterday , and proved to bo Frank Elmoro.
Ho nt first denied that ho was the man , oven
when confronted by the two young men who
had ridden with him , but finally admitted
that ho had driven tlio vehicle In
question. Ho insisted , however , that
ho knew nothing ns to the
whorcaDouts of cither the girl or the stranger
naylng that they loft the coupe on the
street and told him to await their return. Ho
declared that ho waited In vain , ns be saw
neither of them agnlu and was beaten out of
bis faro.
After exercising his Imagination In this
manner for n while , Klmoro at length got
down to business find told the story of his
connection with the case In a clear , straight
forward way that was afterward very easily
corroborated.
It seems that the stranger arrived In the
city from St. Louis Saturday noon over the
"Wnbash , and proceeded to the Barker whore
ho registered with a woman who accompanied
him as "C. F. Boyd and wife , St. Louis. "
Boyd left tbo woman at the hotel and at
once started out , as it afterward developed ,
to got possession of the girl. He first on-
gngcd the services of Elmoro , whom ho told
to follow him around all night if necessary ,
and ho would bo well paid for his timo. The
driver was also Instructed to krcp out of
sight of anyone with whom Boyd might talk
upon the street.
This explains how It happened that Boyd
found a coupe just when ho wanted ono at
the corner of Seventeenth and Cass streets.
The story of the trip to the Atborton resi
dence , the installation of Andrns and Urnpp
ns nurses of the Athorton Infants In Miss
Daisy's place , and tl.o preparation of the
pirl for her journey with Bojd has already
been made public.
Elmoro was directed to drive to the Bar-
l < cr , which bo did mthtill possible speed , and
there lio.vd and the girl hurried upstairs to
the room occupied by Mrs. Boyd , where they
remained for n short time nnd'thcn all three
came down , their bill was settled , and
Klmoro was asked to dnvo them to the trans-
fur depot In Council Bluffs In time to catch
the 4 : GO Wabash train for St. Louis. This
Klmoro refused to do , claiming that the rouds
wcro too heavy , and after receiving a very
liberal payment for the work already done ,
he was discharged. Boyd asked him to
direct him to a good private boarding house.
In the Blurts where ho could stop ever In
case ho lost bis train , ns ho didn't want to go
to a public hotel , and then boarded a car with
his liulv companions and disappeared , first
giving Elmoro Instructions not to answer
any questions and not to know anything in
case anybody wanted Information.
Boyu was well supplHl with money , as
.Elmore says ho saw three I , rolls , Including
fifties , twenties , tens and 11 -J. The first
time that Elmoro suspected that anything
unusual was up was when Boyd and the girl
got into the vehicle. After driving a few
blocks he looked around to slzo up the situa
tion , but thn girl was sitting quietly and ap
parently contented , and ho did not think that
eho looked as if she needed or desired assis
tance.
Boyd did his work very smoothly , nnd
while riding with A minis and Crapp com
mended them highly for their noble work In
Miss Hudson's behalf. They declare that If
Boyd will only tell them whore ho took his
uorvo lessons they will call it square.
It is thought that Boyd missed the Wnlmsh
train , but loft for home over either the Bur
lington or Missouri Pacific by wuy of Kansas
City.

Detectives Haze nnd Savage made n good
catch yesterday afternoon. Between 4 nnd 5
o'clock the rooms of E. C. Small , 013 South
Sixteenth street were ontcrod by sneaks and
a fine overcoat stolon.
Thn ofllcors saw Chnrlos Johnson nnd
Frank Knno , accompanied by a couple of
pals , on the street with the coat In tholr pos
session. The quartette acted rather queer
anil were followed by the officers nnd
arrested. The arrest had boon made and the
coat recovered bcforo the loss had been re
ported nt pollco headquarters.
About 8 o'clock last evening Detectives
Savngo nnd Dempsey saw the rest of the
trnng on Fourteenth street and promptly took
thpm Into custody. Their names nro James
O'Tcolo , Frank Johns and Charles Alien.
When searched at the station a small
assortment of skeleton keys were found , also
a new silk muffler , black silk tie , , shoo brush ,
small gold chain and a pair of p.isto diamond
shlrtstuds. The studs were in a small box
bearing the name of n Denver jeweler.
The ofllcors claim that the crooks have just
arrived from Chlcifo and are good people to
keep locked uo. They nro charged with
being suspicious characters and petit lar
ceny.

Patrick O'Brien ' , un employe at the Fre
mont , Elkhorn & Missouri Valley round house
and who lived at Lqster's ' ooardlng house
near Florence , met with an accident yester
day morning which caused his death.
O'Brien had been down in the yards on
some work and jumped a freight train to rldo
bncic to the round bouse. When near that
point ho Jumped from the train and was
struck by another. His head was consid
erably cut nnd the body was bruised all
over. The Injured man was taken to the
round house nnd doctors summoned. Bofoio
they arrived ho had breathed his last.
Coroner Harrlgan was notified and after
viewing the remains had them convoyed to
Heafey < fc Hcofoy's whoio on Inquest will beheld
held , probably today.
O'Brien ' was a single man and had no near
relatives that are known of.

Yesterday morning William and Walter
Butler , living nt 1910 Pacific street , were
passing through the Chicago lumber yard.
Under n pllo of lumber they found the dead
body of nn Infant. T. L. Scott reported the
matter to the police , nnd the coroner was no
tified. The body was removed to Heafoy &
Hcifoy's.
From appearances the child had boon born
the night before nnd hidden In the lumber
yard. No marks of violence could bo found
upon the body. Detective Bennett looked
into the case and is satisfied that ho has lo
cated the mother of the child , who is an un
married woman. The coroner will begin an
investigation today assisted by the police.

Joseph Matvuslck of Noola , la. , stepped at
the European hotel , Tenth nnd Jones streets ,
Saturday night. When he wont to bed ho
blow out the cas. Early yesterday morning
tbc hotel people smcllcd the gas and Investi
gated. They found Matvuslck lying on the
bed In an unconscious condition. Ho had
been asphyxiated. Dr. Jones was called and
did all ho could to save the man. After n
couple of hours hard labor the doctor was
successful ,
The matter was reported to the police and
Detective Vaughn and the sick man taken
to the St. Joseph's hospital for treatment.
IIo was doing nicely last evening and will bo
all right in a day or so.

In the northwestern part of the city an
other tented village has been established , to
accommodate the annual campmootlng of the
Iowa Holiness association , which will pro
bably begin on lucsday. This association is
non-denominational In character , being com
posed of representatives of nil the leading
churches , and Its services being conducted on
the broad piano of Christianity without creed
or confusion to mar Its effectiveness.
The only attraction to divert attention
from these meetings will bo the state con
vention of the so-called third party prohibi
tionists , who annually go through the mo
tions of nominating a ticket.
TUB AMI'.NnMKNT MANDAMUS CASE.
Apropos of tbc temperance question , Sec
retary of State McFarland on Thursday.fllod
an answer to the mandamus proceedings in-
statutcd by President Harvey and others of
thn state temperance alliance to compel him to
prepare a certified copy of the constitution of
Iowa containing the prohibition amendment.
The answer Is very short , and after reciting
the well known facts admits the refusal ,
stating that the same was made because the
supreme court of the state haa declared the
amendment unconstitutional and thili it was
not a part of the constitution. Secretary
McFarlund's position is that the question as
to ttio validity of the amendment is not in
volved in the case at all and cannot bo raised.
Ho claims the only question which can bo
raised or considered by the court is
whether the demand was" properly made and
should have been complied with , and in
determining this question the court
will not consider whether the amend
ment Is a p.irt of the constitu
tion , but only If , in view of an unrovorsod
decision of the supreme court that such was
not the case , ho was justified in refusing to
certify it as a part of the organic laws of the
state. Every oftlciul Is charged , with n
judicial notice of supreme court decisions
and bound by them. The secretary thinks
there is no question but what the mandamus
proceedings will ba dismissed and some other
way will have to bo provided .ir Mr. Harvey
wishes to reopen the famous prohibition
amendment caso.
1HK IOWA ANTI-TIlUST LAW.
Attorney-General , Stone has rendered on
Important opinion in regard to the
nntl-trust law enacted by the lust
general assembly. The law provides
that the secretary of state shall address in
quiries to all the corporations organized
under the laws of the state or doing business
in the state ns to whether tliey ore unlaw
fully combining or merging their corporate
existence into any other company. The refusal -
fusal of the corporations to answer these in
quiries subjects them to prosecution , con
viction and revocation of charter. Such In
quiries were sent out by Secretary of State
Jackson last yoivr , with the following dis
couraging result : Answered , 23 ; gone out
of business , UTO ; inquiries returned marked
"uncalled for. " 051 : no answers received
from 1,091. This report was certified to the
attorney general , and before Instituting suits
and putting the state to possible
needless expense , he proceeded to in
vestigate. As to the first throe classes there
was no evidence to show that they had "re
fused" to comply with the law. As to the
fourth class , the attorney ponoral ilnds that
largo numbers of tliom aie agricultural ,
charitable , religious and educational in
character , and it Is likely the in
quiries did not reach the proper per
sons to receive attention. If action should
bo brought against those corporations , says
the opinion , It would bo necessary to prove
that a demand was made upon the proper
ofllcors to make the affidavit and that they
refused. The more fact of having mailed a
letter would not show this , and the attorney
general leols warranted In the conclusion
that there is no evidence to justify h'm ' in
the expense of bringing suits. ' It is
also tlio opinion of the attorney gen
eral that the general assembly did not
Intonuthatthososummary proceedings should
bo taken against the agricultural , religious ,
charitable , educational and llko corporation ! ! ,
but only against these organized for pecun
iary protlt. IIo suggests that the secretary
of state take steps to ascertain the mituroand
proper oftlcers of these corporations , which
can bo done through the county olllcials , and
that aftnrwards now letters of inquiry bo
sent out , or placed In the hands of sheriffs
for legal service. The attorney general In
conclusion says : "In view of the Insufficiency
of the machinery provided for the execution
ot this section of tills statute , I think the
situation U of so grave a character ns to war
rant us In culling the attention of the gover
nor to it for such consideration as ho may
doom proper in the preparation of his blounial
message to the general assembly. "
