council mooting last night thnt the council

appointment of Frank H. Morrissey as sani
tary commissioner , and further held that
Mr. Morrlssoy Is now out of n job so far ns
nn ofllclal position is concerned.
Mr , I'oppicton , In his opinion , reviewed
the case nt length. Ho stated that the coun
cil had confirmed the appointment of Morrissey -
rissey on April 28 , nnd reconsidered nnd re
pealed nt an adjourned session of tbo same
mooting. The only question , the city attor
ney held , was xvbother the vote on the mo
tion to confirm an appointment was nn
executive net or whether such a mo
tion wna subject to roconsldenitlon
the amo lu any other motion of the council.
After reciting the rules bearing on the ques
tion Mr. 1'opplotou saW : "J aui therefore

thb hours of 12 o'clock on Saturday night

ing such term sell , barter or iu any manner
dispose of any liquor , nnd any person violat
ing the provisions of this section shall bo
lined $100. "
An ordinance was introduced authorizing
the assistant city attorney to oinploy n stcu-
.ogrupher at a salary not to exceed $40 per
month.
City Clerk Oroves presented the result of
his labors In n neat manuscript , volume defin
ing the boundaries of the now voting dis-

Mr. Ucchul. called up the TJoutrlas street
grading ordinance and secured Its passage ,
Mr. Uruneralono voting in the negative. The
ordinance passed declares the necessity of
grading the street and orders the board of
public works to advertise nnd truto the neces
sary steps to have the work done.
The lira limits ordinance as amended was
passed. Then Mr. Bechel got In some flno
parliamentary work. Ho moved that the vote
bv which the ordinance was passed bo rccon-
sfdoreu and the motion to reconsider bo laid

tion was unanimously agreed to.

Monday morning with the largest docket
that Judges aud attorneys have ever seen In
this district.
The term Just closed had a docket on wnlch
thcro were 2,40(1 ( cases , but the docket of tUo
coming term will break the record and ap
pear with 2iV > U civil cuscs. Of tnis number
.moro than two thousand have boon noticed
( or trlul.
The Judges ylow the fa.cts with consider
' able Interest , when they realize that the May
'term will run at least until August 1.
Tbo assignment of rooms has been a prob
lem , but at last that question has been sot-
tied , .ludgo Kstcllo will preside over the
criminal docisot. and will occupy the largest
room , or No. 1 , lu tbo court houso. Judge
Ferguson will bo lu room No. 2 , nnd Judge
Irvine In No. 3. Both will huvo charge of
Jury cases.
The rooms on the third floor of Tin : BF.I ;
building are nearly readv for occupancy.
They will bo carjKitod with brussels , and
furni.sniHl with oak furniture.
' Judges Wnkeley nnd Doano will preside
over the equity dockets , and will occupy
rooms Nos. 1 and 3.
The largo room , No.3 , will bo occupied by
Judges Davis anil HopawnU alternately.

In the other counties of the district.
In the criminal court a murder case will bo
called next Alonday.
Thomas MoNamco , who Is now in Jail ,
charged with having murdered Klsio Wil
liamson , alias Kato Nichols , a woman who resided -
sided on Ninth street , will oo placed on trial.
Ills Ucfeuso has not been outlined , but it Is
thought that ho will plead temporary Insan
ity nnd that ho committed the crime while
under the influence of liquor.
In the system of Juries thcro will be a now
departure.
Heretofore there have been three panels to
eclcctfroui , the regulars drawn by the county
commissioners , the sheriff's panel , which con
sisted of tallsmon who were picked up by the
sheriff , and the "peckers' " panel. As a rule
the public know nothing about anything ex
cept the regular panel.
The members of the sheriff's panel used tn
number about lifty , Those men appeared on
the first day of tbo term , watched these who
were excused from the regular panel nnd got
on In their places. By hunirlng about the
court house most of thorn got on the list , and
as u rule made as much money as the mem
bers of the regular panel.
Tlio "ixxsknrs" were kuown only by them
selves , the lawyers aud tbo court oftlcora.
Thvro were at least two hundred of them.
Their plan of operation was this : Every
morning they would visit the court
rooms , watch for Jury trials and go
into the rooms whore Jury coses
were liable to bo callcil. When the ether
panels were exhausted by the challenges of
the attorneys , those mcu were put on. As
soon us a Jury was made up In one room they
emigrated to tno domain of Another Judge ,
whcro they waited until the panel was 11 lied
In that room. These men usually made n
living , as they averaged two dry * each wcok
during the entire term. The new Jury law
has IcgUlatod nil of these mon out of tholr
Jobs , nud next Monday , when the courts con
vene , such men as Paxton , the mllltonrlro ;
Vatos , the , banker , Bochcl , the councinman
and n scorn of others will sit In the Jury box

In contact with the clothes of the
ragpicker nnd the greasy suit
of the mechanic of the shop. Tbo now Jury
law Is no respecter of persons , and llko rain ,
t hits the rich as welt as the poor. Just now
some of tlio wealthy bond holders and bust-
less men are making an effort to get out of
serving the state at $ J per day , but they are
not likely to meet with any marked degree of
mcccss. They have pleaded with the Judges ,
but the Judges have said "No ; if you were
drawn you must serve. ' * Since receiving the
answer they have talked business trips , but
.his will not win , as the courts have decided
to send for nnd liud every man who runs
nwny to avoid serving on Juries.
Under the provisions of the now law , 180
urors were drawn and of this number
ilnnty will nppciir at the opening
of the term nnd remain thrco-weeks , after
which they will go about their business nnd
ttio other ninety will put la an appcaranco
anil sit out the balance of the term.
The Judges are of the opinion that the
ninety will bo n sufficient numoor to keep the
courts running , but at nny time when the
panels nro exhausted , the Jurors who are out
on n leave of ubsonco will be summoned and
pressed into service.

Little heard somehow that his wife had gone

found her there. Ho upbraided Ins wlfo
bitterly for such conduct and she took the
matter so greatly to heart that on the way
homo she purchjiscd some morphJno. Some

to save her life.

composed and Incinerated body of a man appar
ently about forty-five years ol 340 was found
yesterday about a mile south of this city.
Notnlng was found on the body which would
establish tlio identity of the corpse , but a man
nnswerlng the description of the dead man ,
who said he was a resident of Chicago , was
seen hero about two weeks ago. Ho was of
dark complexion , were a gray suit and

pounds. _

advisory board of the Western Traffic associ
ation , which Is to bo held tomorrow nt the
Windsor hotel , will depend the Hfo of that
association. After the failure of the mooting
nt Chicago prophecies ol the downfall of the
association were made and the angry attitude
of the members who wont to Chicago went
far toward giving such prophecies the color
of probability. Time scorns now to have
smoothed their nngor nt the missing members
and to havn coaled the indignation nt the cut
rates instituted by the Missouri Pacific , and
the railroad men now in the ctty are predict
ing n harmonious meeting tomorrow. It Is
confidently nssortod that a quorum will bo
present tomorrow. There is doubt , however -
over , about the recent action of the Southern
Pacific. Mr. Huntington will not bo In Now
York for two weeks and no one at the South
ern Pacific oflk-es yesterday could toll wheth
er any preparations to bo represented nt the
meeting had been mado. President Marvin
HuL'bitt and Chairman Albert Keep of the
Chicago Ac Northwestern , Sidney Dillon of
the Union Pacific and Chairman Cbappel of
the Denver & Hio Graudu were quoted yester
day as predicting harmony nud peace for the
morrow.
The Missouri Pacific's ' sugar rates will un
doubtedly bo up for discussion as they are
still on the slate from the Chicago fiasco.
The Trlbuno says they will probably bo ex
plained away however , aud the road again
put on good rncoril as in favor of maintaining
rates. Mr. Gould's pot scheme of establish
ing Joint acencies will also be brought up
again.
Another subject to bo brought up is that of
Canadian competition for through freight to
the northwest , and action may bo taken in
direct opposition to the interstate commerce
law. with the idea of having it tested In the
supreme court. The long nnd short haul
clause of the law necessitates a reduction on ,
If any is to bo made , all freightallko , whether
for local or through delivery. The through
freight Is only a small per cent of the to'.nl
tonnage on the New ork Central , nmount-
ing to about 12 per cent , and on the Pennsyl
vania to about the same. Henco. it will bo
proposed tomorrow that some road , with the
association at its back , Ignore the obnoxious
"long and short , haal" clause and adjust Its
tariff to meet the through rates of the Cana
dian lines. In this way the one clause of the
law will bo tested , as the whole law in a gen
eral way will bo tested In the action of Coo
Hrothcrs against the Lehigb Valley.
The Sun "Mr. Gould's
today says ; pur
poses have so far remained a mystery , but
from the opinion of a gentleman given below
it is clear that ho has applied some kind of a
sedative to the feelings of the members of
the advisory board , and yet none of thorn
have so much as hinted what it was. The
Suii is able to explain the reason of the rc-
nmrkablo change , which will have the effect
of turning tomorrow's meeting liito n lo o
feast or a war dance. Messrs. Gould and
Clark have decided to leave their Manager
Leeds to hU late and throw him onto the
meroy of the advisory oonrd. They have
disavowed all knowledge of the cut in sugar
rates and have Informed the commissioner
and other members of the board that Mr.
Leeds acted entirely on his own authority.
Mr. Leeds came to New York Just before the
tlmo sot for the meeting and was submitted
to n severe examination by his superiors. Ho
convinced them that ho was Justllicd in filing
the tariff. But Mr. Leeds' mistake was in
not applying to tbo association for leave to

superiors felt that there was a plain violation
lation of tno agreement , and if they upheld
Mr. Leeds they could never expect any other
road to live up to the agreements Mr. Leeds
will bo allowed to Justify himself if he can.
He will make a statement , which is said to
bo already in the minds of Mr. Gould or
Mr. Clark , explaining why ho ordered
the cut in sugar. It will contain some
interesting features on the other roads , it is
said , particularly the Alton nnd tbo Atchl-
son. The complaint is that Mr. Leeds found
his neighbors making wholesale slashes in
the rates and ho simply met them with an
open rate. The Sun , before Mr. Leeds Hied
his tariff , found evidence in Now York that
quito a number of roads stood m with the
sugar magnates , and it was believed that
they made it an object to the retinors to give
them the best shipments that were made dur
ing the latter part of April. "
"I don't think the advisory board will de
mand the discharge of Mr. Leeds , " said n
president yesterday. "Mr. Gould , I think ,
takes the view that Mr. Leeds misinter
preted his privileges. You will notice that
the offeuse ha committed Is not directly pro
vided for in the by-laws , although it Is a part
of the preamble that no company shall cut
rates on its own authority , oven if its neigh-
hoi's are guilty. Mr. Leeds should first have
reported to the commissioners the offense
committed by his neighbors and demanded
an investigation. Then , if the latter contin
ued to violate the agreement , Mr. Leeds
could hnvo claimed the right to meet their
unauthorized reduction. Seclnc tnat Mr.
Gould Is frank enough to admit the guilt of
his road , I think that the advisory board will
forcivo and forget und then start over again
with a clearer understanding of the rules. "
Northern I'ncillu Improvements.
Nr.w YOHK , May 5. Thomas F. Oakes ,
president of the Northern Pacific , yesterday
confirmed thfi report that the directors of
that road him authorized the purchase in the
market of the preferred stock of that com
pany with money to bo received from 'tho
Manitoba land case recently decided by the
United States supreme court in favor of the
Northern Piicltlc. The rehearing asked for
by the Manitoba company had , Mr. Oakes
said , been denied by the supreme court and
the cose permanently closed.
" \Vothlnkwo will gnt the money about
May 2S , " suld Mr. Oakes. "In the meantime
the company has plenty of money on hand to
anticipate the purchase of the slock if the
market conditions should warrant it , The
directors have also authorized the expendi
ture of $2,000,000 , , for the improvement of the
property. Wollndthat by reducing largo
grades nt certain points wo can save In oper
ating expenses iOO,000 a year. Heretofore
the volume of trafllis has not been heavy
enough to demand those Improvements , but
tbo tonnage is now so great that it is of the
utmost Importance to our inturosts to begin
the work of improving the line by reducing
grades and straightening curves. "

inspector was riding down town this morn
ing. In perusing a morning paper , ho ran
across the hotel interview with David E.
Durie of Seattle , Wash. Captain Stewart
was struck with the name which was the
same as that of a cousin of his who early In
the ' 00s went west to seek his fortune. Ho
went to the Palmer house where Mr. Durio
was stopping und was not long In Identify
ing the fur-westerner as the relative whom
ho had not seen for mauy yean.

of colored men , today adopted a scries of res
olutions affecting their purpose of securing
