The lire department was called out yester
day morning at 3 o'clock to the corner of
Fifteenth street and Third avenue. A lire
had been started In soina old Ice houses which
were formerly connected with the Stewart

who was anxious to see the rest of the estab

lire had gotten considerable headway before

Henry Davenport of Atlantic was brought
before Clerk l > . M. Hunter of the federal
court on tlio charge of selling liquor without
a government license. Ho claims that ho had
inudo application for a license , hut had not
yet received it. A telegram was sent to the
deputy revenue collector at Burlington to
find out whether ho told the truth. A reply
was received stating that no license had been
asked for by iitiy ouo from Atlantic named
Davenport. The prisoner was accordingly
bound over to await the action of the federal
ijrand Jury in the sum of f20l ) , In default of
which ho was sent to jail.

ing over the sidewalk on Seventh sti'eet be

able condition , and during the recent muddy

driving along the sidewalk. The adjacent
property owners did not. like this , and they

The case of the Council Bluffs & Omaha
transfer com pnny vs M. Zoltsiniinn was on
trial In Justice I'atton's court yesterday af
ternoon , The plaintiffs clulm that they had
n contract with Zoltsman to furnish him
forty tons of hey during the recent hav fam
ine at $13.50 per ton , hut when they delivered
It ho refused to take It. They accordingly
bring action to recover damages in the sum
of $50 on account of his alleged refusal to
ntaiid by his word. Zoltstnntm claims that
ho had the contract , but that the plaintiffs
refused to fulfill their half of it. Ho sues
fnr $ ! > 5 damages. The case was tried on
these rather contradictory statemoincnts and
was taken under advisement by the court.

An answer wns filed yesterday by the do-
fendauU in the case ot Hitchcl Larimer
against Jack Green and Thomas Skinner ,
which was commenced last month in superior
court to obtain possession of a ttilrty-two-
ncro tract of laud situated between HI ? lake
and the rivor. The plaintiff claimed that the
land was held by the defend nuts without any
right or title , nud she demanded that they
lilvo It up to her , together with $150 damages
which shn has suffered by the detention. In
the answer which was tiled yesterday the
defond.uu.s allege that the property , which ts
situated north of the river line according to
the old government survey , ts In the state of
Nebraska , and that therefore the court has
no Jurisdiction In the case. They ask that
the case bo dismissed nt plaintiff's cost. The
trial was to have oomo off yesterday , but as
the tiling of the answer brought some now
matter Into the cajo , it was postponed until

with the nmount of outstanding accounts ,

The case of Horace Kvcrett vs the city wns
resumed in district court yesterday morning
mid occupied the attention of tbo court until
! ) o'clock In the afternoon , when on account
of the Illness of Mrs. Puscy , wife of N. M.
1'usoy , the attorney for the plaintiff , there
was n continuance until such time as Mr.
1'usoy shall bo able to attend. None of the
cases that followed In the nsslgnment were
ready for trial , so nn nctjournment was taken
until this morning , after a few matters of
minor Importance had been nttondcd to.
A decree of foreclosure was granted In the
case of Charles Bowman against Kato B.
nnd f. j. Sackott on two lots situated in
Sackett's ' addition.
An objection to motion for n continuance In
the three cases In which J. P. Cnsndy is de
fendant was filed by the attorneys 'for the
plain tiff , Wright & nt.ldwiu. Thov allege
that a continuance has boon nskcd for by the
attorneys for the defendant nt every term of
court since that of January , 1S90 , nnd has
each tlmo been supported by affidavits from
physlcl.ms stilting that the health of the de
fendant is such as to render the trial of the
case impossible. They arcuo from this thnt
the health of the defendant is constantly fall
ing , and that a conttnunnco of the case to an
other term of court will bo equivalent to
turning the plaintiff out of court altogether.
A motion for u continuance was filed In the
case of W. P. Cranrlo vs Charlotte Maish ,
by the plaintiff , on the ground of a failure of
certain depositions to nrrivo thnt it Is
claimed nro essential to the trial of the case.

favor of the plaintiff , the defendant faillni ;
to appear The title to lot 129 of the original

In the case of A. Ovcrton vs L. noscnflcld ,
in which nn injunction was sought by the
plaintiff to restrain the defendant from
engaging In the sale of Intoxicating liquors ,
the plaintiff warranted a judcmcnt lor nt-
tornoy's fees and costs , by default , and an
order of abatement. Several other cases in

The funeral of Mrs. Phoabo Gary took place
yesterday morning at the residence of her
son , Chief of Pollco Wade Gary. A largo
number of trionds of the deceased were

a very impressive manner. After the ser
vice the remains were taken to their last

Hammer yesterday forenoon for n prelimi
nary examination on the aiiurgo of obtaining
money under false pretences. Standing

the purpose of seeing whether the prisoner
was the man who had dona them up. As
Mack looked nromul on the crowd and saw
so many familiar faces ho uamo to the con
clusion that it would not bo worth while to
contest tha point , nud ho waived his prelim
inary examination. Iho court hound him
over to await the notion of the grand Jury ,
nnd fixed his bond nt VH ) , in uefnultof which
ho was renmndud to the county jail. The

Mrs. N. M. Pusoy Is dangerously ill nt her
homo , at the corner of Willow nvonuo and
Sixth street. Sue has been a sufferer from
dropsy for some tlmo past , and of lute It has
been complicated with symptoms of heart
failure. Yesterday afternoon she was re
ported to bo very low , aud in the evening her
physician stated thnt her death was expected
