General \Vhc.itonresumed thostand yester day morning. When reinforcements wore or dered to Pine Uidgo to assist the Seventh cavalry , Captain Catley's ' company , C , was ordered out. Tnoy wont but the captain did not accompany them. The Second regiment was under tire from the Indians near Pine Hideo December til ) and 'M , and company C was In a somewhat critical position. The general supposed that Captain Catley was with his men. C.iptaln Catloy General , why do you think Capt.dn C.itley unable to command a company under tire ( General \Vhealon-I am aware that Cap tain Catley was convicted at a court-martial in Idaho eleven years ago for questionable deportment in an engagement with the In dians , The court was hero ordered cleared. Hut Cuptalu "Catley's objection to this statement going in aj evidence was over- ruica. Continuing his testimony General Wheaton stated that bo had been apprised of the de tails of the court , martial byonoof his ofllcors , who was present nt the proccedingi and was well'posted as to nil Its details. The general court martial referred to was ttien read , which embraced in Its allegations that Captain Cailoy had been guilty of gross misbehavior and cowardice in the face of a war party of Indians on Bljr Creek. Idaho , July i9 ! , 18T9 , and that ho failed to fulfill the functions of his position In i < ot delivering the proper orders or attempting : anything to repel the enemy that ho retreated two miles , tak ing no precautions to protect his command or the wounded members thoroot. Ho was then a lieutenant of the Second infantry. The re sult of his cow ardlco and InoHicloncy was the loss of several man and the pack mules of the company. The disclosure made by this llttlo Im promptu bit of elocution created a buzz of excitement among the blue-coats within the court , but this quickly subsided and the logonrt continued. Captain Catlov was dis missed from the service by the Idaho court- martial , but this decision was not approved by President Hayes , and ho was reinstated ou the recommendation of the Judge advocate general of the army. Tills recommendation is now on Its way hero , but Judge Advocate Captain Itay objected to its ba admitted as evidence in the present case. The court was again cleaicd. The objection \yas not sus tained and Cienoral Wheatou'proceeded to glvo bis opinion of the document , stat ing that ho thought "misconduct" would boon a better term to have applied to Cap tain Catloy's action , than cowardice. Here Captain Catley sprang a little sensa tion of his own by asking General Wnoaton if he , himself , had not once been court-mar- tialod. The Judge advocate was on his foot In a second , and interposed a strenuous ob jection , stating- that it wa ? Captain Cntloy who was being trlod and not General Whca ton. ton.Tho The objection -was sustained. General Wheaten , however , insisted on answering the question , wliich ho did , by rising nnd saying that ho had never been arrested aud tricd.i Captain Catloy hereupon arose and begged the general's pardon. The general then continued his testimony. Ho had always treated the captain with the courtesy to which ho was entitled. Ho considered him perfectly competent to handle his company on the parade grounds , but before - fore a band of hostile Apaches was another matter , nnd the captain's post record.
