Objects tn the Removal.
Attorney Ucneral John Y. Stone has filed
an objection to the removal of the four cases
airalnst the Northwestern , Hock Island , Mil
waukee and Ilnrllngton railways to compel
them to 11 x their Joint rate charges In
accordance wltu a recent order issued by
the state board of railway commission
ers , from the district to the federal court.
Those cases Avero commenced In the district
court , but an effort was subsequently made
by the com tinnier to have thorn taken to the
federal court. The-attorney general claims
that the cases hi question arosa under the
stnto laws , unit that there is no just ground
for their removal to nny other court than the
state courts. _

The county auditor has Just completed his
investigation of the swampland mutter which
was ventilated by tho" papers some weeks ago.
Ho finds that the number of acres claimed
under the swamp land act Is 5(5,530. ( Of this

A motion was tiled in the district court
day before yesterday by Attorneys Burke &
Howltt. asking for n continuance ot the case
of A. F. Clattcrbuck vs. W. A. Jones. The
main ground that was stated for the continu
ance was -that Clatterbuck , the plaintiff in
the case , was so ill as not to bo able to get
out of doors. In support of the motion Dr.
liolllnger made aflldavit that ho had exam
ined Clatterbuck and had found him suffer
ing from a severe attack of nervous prostra
tion. Yesterday n resistance to the
motion for continuance -was Hied
by Fllcklnger Brosthors , attorneys
for the defendant , in which were nflidavlts
signed by William-A. Jones and F. K. Bragg ,
stating that they saw Clattcrbuck In a sa

TUB IJVK STOCK CONTROVERSY.
t Is Discussed at a Meeting of the
South Omaha IC > ehnnge.
A spqclni meeting of the live stock ex-
chnnge'was held yesterday afternoon to con-
ider the American live stock commission
controversy. President Wallworlc presided ,
nd about seventy-flvo members were pres
ent. Manager W. N. Babcock of the stock
ards company stated that a mooting had
been held Monday afternoon In the oftlco of
the Cudahy packing company , which was at
tended by the managers of the packing
louses , the board of directors of the live
stock cxchantro and himself , at which
the action of the live stock exchange in re
gard to the American live stock commission
company was discussed. Mr. Dabcock bo-
liovcd that ho expressed the sentiment of the
packing house managers when ho expressed
the desire to have the previous action of the
live stock exchange revoked , providing the
American live stock commission com
pany would dismiss its injunction
suit and abandon all legal proceedings , thus
placing all parties Just where they were prior
to the beginning of the present controversy.
This , Mr. Babcock urged , would bo In the in
terest of harmony , for the best Interest and
prosperity of ttio yards , and without detri
ment to any ono.
Mr. Babcock then read a telegram from the
Kansas City live stockcoinmlssion company's
oftlco tolls agent , Mr. Hrown.
John A. Dadisman , at the time the action
was taken prohibiting trafllukhnj with the
live stock exchange , was opposed to It. but
now that the action had been taken he , for
ono , wns in favor of manfully standing
up by that action. Inasmuch us the Chicago
live stock exchange had taken the same
course , ho could not sco why this exchange
should recede. As for cattle at 50 cents ho
know no honest man could do it.
VMco President Waggoner was firmly in
favor of enforcing the rules of the exchange
and of sustaining its former action. As u
commission man engagea for live years , and
as a member of the exchange ,
ho could say that the exchange
was not a benortt to the com
mission men alone , but to stock raisers and
shippers as well. The present commissions
arc such as have boon in vogue more than
twenty years in all stockyards , ana ho know
as n matter of experience that no man could
do the business for less than the present
commissions. Turning toward George H.
Brown , ho said : "And Mr. Drown Knows
that as well as any man ir
this room. Ho knows It botl
from . his experience In Chicago
and hero. As to the statement made by Mr.
Brown , that cattle could bo marketed forliO
cents , ho knows It is false , and every commis
sion man present knows ui'it it could not bo
done. "
Mr , Brown said : ' 'I never made any such
a statement as represented , that cattle could
bo sold at 30 cents. "
Secretary Lott read a circular letter from
the American live stock commission com
pany , showing that the dividends paid were
CO per cunt on the capital paid In.
Mr. Brown said : "I will continue the in
junction proceedings till after the next
regular meeting of the exchange , and if the
live stock commission company bo admitted
to membership I will discontinue them , or
If the packing house managers will give a
guarantee that they v/111 buy stock at the
market prices I will abandon the suit. "
Superintendent A. C. Foster of the packIng -
Ing houses of Swift & Co. attempted to pour
oil on the troubled waters by explaining that
the consensus of opinion at Mommy'tr meeting
was that neither party should back down ,
hut only do that which would place tnem in
their former positions. In the present ques
tion thcro was no antagonism , but
simply a question of expediency , and
if anyone had made n mistake
ho did not think It wrong to undo It. With
Kansas City on our south admitting the
live stock commission company to member-
bhtp , and Sioux City on our north , both
competitors with us for stock from u large
area , ho believed It unwise to do anything
that might drive stock to those places. More
than this , much of the Texas stock was
handled by the live stock Commission com
pany and it wns necessary to got as much of
this sjock as possible. Already arrango-
incnts hurt been made to euro for It in thcso
yards. To cnfu-oj the former action of ttio
exchange would drive much stock away and
would bo detrimental to the Interests of the
stockyards and nucktng house as well as in-
vita adverse legislation at Lincoln.
Michael H. Murphy , who represented
Manager Edward A. Cudahy of the Cvdaiiy

companlns nro having nn interesting light
hero today over rights on certain Important
streets. The old comnany holds a franchise
to build a double track line on Fourth street
to a bridge across the Floyd river , which ia
the key to the east sldo of the city. On this
brldgo the exclusive right is held by the now
company. Neither company can build its
lines from the center to tuo suburbs without
concessions from the other. Ttio city coun
cil has been unable to settle the trouble , and
today the now line commenced to lay track
on the bridge to orotect its richts. Immedi
ately the old line began to double track
on Fourth street , loaaine to the bridge. The
crews of workmen got' ' into n light at 10
o'clock this evening and nro now nt it , each
company trying to protect Its own territory.
The trouble will probably bo settled in the
courts.
