Dear sir nnd friend : Ur the time the sun rises over the eastern hills tomorrow moriilug 1 will lay cold in ( loath , and as it can do no harm now I will re veal to you the secret of mv Hfo , My name is not 11. M. llodgors. What it is I cannot toll you. I will explain later on liow I came to take tbo name of II. M. Kod- ers. I was" tbo second son of n wealthy lawyer ia a family of six children , four boys and two girls. J was being educated for u lawyer to succeed inv futhnr , and was looked upon as the most promising person in that town. I was the favored anu pot child of the family. In the * mme town , within a few blocks of my father's ' residence , lived a wealthy hanker , "whoso family consisted of himself , wife and one daughter , tbo Inttor tbo same ago as my self. Vi'o had been playmates together for years , were raised within sight of each otbor , and , ho it said , were ulwavs very much attached to each other. For il lustration , wo will . call her Sara. When she had grown to bo a young lady , she was the most beautiful person , I think , I over laid my eyes upon and 1 fell desperately in love with her and she as much in love with mo. I hellovod tier to bo the purest and most innocent person on earth. I never ( as much us I was with her ) had the slit-litest thought of auy dishonor. I would ratbor have died than offer her the slightest Insult. It was tlio wish of our lives thut wo could bo mar ried , but yet wo were both too young , scarcely seventeen. Wo * be came engaged , however , with the Ireo consent of both our parents. It'Was known to everybody. Thus things wove until ono morning some three years ago , when Sara wus found dead in her room in her her father's ' house. At tbo coroner's inquest It was rnvcalod that I was Her acknowledged lover ; that an abortion had been performed , nud this was the direct cause of her death ; that I had boon to sea her that evening ; was scon to leave there about 11 o'clock tnat night * that I hud purchased ether and chloro form from a druggist that day for the supposed purpose of putting her to sleup while .the drug she had taken was having its clTect. The bottle was found in her room and Idcmllicd by tbo druggist ns tbo one given mo. My walking stick nnd umurclla were botli found in her room with iny handkerchief and several otbor things. I was summoned bofoto the coroner's Jury. I Ulld not deny that I was her lover and ex plained how the chloroform and other wcro given her. She had requested mo to pot her feomothltig for tbo sick headache which she often bad , I nnd seen her that morning nnd told bur I would bo down again tbat evening. 1 talked to her for some time and in the course of the conversation she told mo tnat she believed she was going to have tbc hoad- acbo and-utked mo If 1 would bring thut mod- iclno when I came in the evening. Thut is now I happened to tnho it to hor. The um brella I had forgotten to take away for sev eral weeks , and the handkerchief she took out of my pocket that night. My cane I hud loft there just thut night and sbo must have taken it up to her room where tbo umbrella was. The Jury did not believe mo , and tuo verdict was that she 'bad mot her death from malpractlco and I was the guilty party. I was at once arrested ana thrown into Jail. O , God I was It not enough to know that the girl I bad loved bud been ruined , by whom I did not know , nnd was dead , but tbat I should bo accused of it , was all tbo moio bitter to hear than death. I was sure to bo convicted , for which I would bo sentenced for life. When I was In jail await ing my trial , my father , mother , sisters and nud brothers visited mo regularly. I pleaded with. tliem to bring mo some thing that would send ino into eternity. The ttrao for my trial was drawing near and tbo whole country was aroused. 'Ho is guilty. ' 'I hope thev will hang him,1 were the remarks people would uiako , hut nlns , they never hung mo nor did I over bavo u trial. With the assistance of my brothers I escaped from Jail over three years ago , aim evorslaco I have wandered from place to place an out cast , never knowing what it was to have a friend and never receiving one line from my parents. I rcau in the papers tbat tbcro was a reward ot $1,000 for my rapture. Detectives were put on my trade aud ara yet searching for mo. I have lived in constant fear for all these years , knowing not what miuuto I might bo arrested aud taken baclt to suiter for another's crime. Thousands of times I hnvo been tempted to taka my lllo , but with a will of Iron have kept from doing to , but the tlmo has coiuo when I can keen from it no longer. Ho has prepared and forwarded to Wash ington an Instructive table of figures showIng - Ing tnat It Is an imperative necessity that ( in additional force should bo put on at onco. The table shows that Omaha has a greater population than cither Kansas City , Denver or St. Paul , that the increase of the ofllca during the year 188'J amounted to 12 par cent , and the lucroasn during 1S90 amounted to 11 per cent , whllo the other offices mentioned showed u decrease during the satno.years. During the year of 18'JO the net revenue of the office was { JO,000 more than during the preceding year. The per ccntof running the Omaha office used up only 7 7-10 of the gross receipts dur ing Ib'JO. ' During the snmo period the office collected and turned Into the government treasury tbo neat llttlo sum ot , $183,727.55 , nnd all of this was done witti.loss help than any office of Us sl/.o In the United States. This request has been ignored , but still bo has not given up hope and is dili gently workimr to accomplish this object. Should this additional help be granted Omaha would still retain its proud position of being ono of the most profitable olllccs in the coun try , as tbo expenses would only run up to about 85 per cent of the gross earningswhllo the ether cities mentioned annually exhaust from 45 to 50 per cent of the gross earnings. USTICE IS AGAIN ON DUTY , 'be February Term of the District Court Opened Yesterday. > OME IMPORTANT DECISIONS MADE , Byron Itccd Gains n Ijntul Suit The Morse Hrldgo Company Against the City-Other District Court The February term of the district court pcuod yesterday with a substantial pros- wet of Importance , though not , perhaps , par- Iculnr interest to the general public. The locket contains 2,407 , cases , being some 200 nero than lait year. A very largo representation of the bar \vns present , and Judges Wiikeloy. Doano and Inrkson wcro on the bench , Judge Hope- veil is expected lo arrive today. Ono of the leading attorneys remarked as : > o glanced over tlio well IHlcd room : "I see that tlio snmo old jurors are present who hnvo boon serving their country in the box hero for something llko twonty-llvo years 1" Jud o Doano made the announcements for the term. They were- that the bar committee would consist of Clinton Powell , Edgar H. Scott , W. S. Popnloton , William I. Hcdlolc and John C. W barton , i'lio bailiffs will bothosaiuoas last turn ) . Ho then announced his decision In several cases , some of which were heard ut the last term of court and others in chambers during va- cation. Two were of special importance ns ; o tlio matter of precedent ns well as to the ntercsts Immediately Involved. Neither of the opinion * wcro of length. Ono was in the case of Byron Heed vs " Slnrtln nnd Lena Quick , husband and wife , 'limtiff sat up that ho was tbouudlsputcil pos sessor of lot No. 1 , In section 13 , township 15 , range in , a patent naving been issued to him Tor same some twenty-seven years ago. In April last the defendant * took possession of Lbo land , and proceeded to cut timber Unit , v/u / tbcro ; build fences nnd do other acts in : , ho line apparently of the idea that thj land jclonpcd to them. Plaintiff sued for nn in unction restricting ttioin from making fur- Lhor depredations or In uny manner tress- passing upon the ground. IIo also nslced the loinluul sum of $ J5 damages , ns ho said it would bo impossible for him to recover anything like the real amount if loss owing to their poverty and financial responsibility. In dofcnso defendants brought UD the question of accretions , the .and being next to the river. It was upon a favorable decision of the question whether or 10 the accretions belonged to Mr. Heed , that lofondnnts rested their hope of success in -ho litigation commenced against them. The court said that ho had no hesitation In idtnR there had been considerable accre tions to the property of a gradual nature , but lot by any cutoff. No question of lurisdlction 'iad been brought up In the tilings , although t had been raised In the pleadings. "If , " said the court , "tho defendants desired , as it would sooin they did , to have the court ousted as to jurisdiction It was for thorn and not the plaintiff to nnko such a showing" in the lllngs. The judgment must bo for the plain- lift , for the property ho lias claimed. " The other specially important cose was Lhnt of the Morse brldco company against : ho city for a balnnno claimed on extras , Tlio x > urt said the case hud boon put into his tiauds oa a transcript of evidence taken whllo Judge Groff was on the bench. The city urged that the , extras were not called for in the contract. The cou t held ttiat the extra work was essential to the completion of tbo contract and with the rest was duly approved by the city. "Tho evidence shows , " said the court , "that payments wore made from time to time as estimates provided in the contract , and on or about August 10 , 183" , the ilnnl esti mate for the contract woric and for extras was approved by the board of public works and to city council , there being then duo to the contractor $ iO'j30.7 ' ! ! , upon which there % vas pild on or about October 10 , 1837 , S1U,2S1.5. ! loavinpf then duo a balance of § 10- 097.52. Since the commencement of the suit and about January s , 18SU. there was paid upon demand $3.1.r > 0.71 , leaving duo at that time for principal a balance of § 2,510.71. The action was tried sotno thno ago , and the court Is without evidence as to what. If anything , hai been paid since. As , however , u "reason- able tlmo has now elapsed for provid ing of funds in some way to meet the demands , the- balance duo at the time of the trial should bear interest from the first day of the present term. Judgment will bo rendered accordingly. " A motion for now trial In Mary Majors vs. Nicnolas Edwards ot al. was overruled. The inoflon to dissolve tbo Injunction in Lander ot nl. vs. D. Mclntyre , was sustained. Judge Wakoloy rendered decisions , the roost important being that of Streltz vs. the 'city to enjoin defendant from forcing- several taxes levied on property , the board of equalization having raised the assessment. " "I am satisfied , " said the court , "that Stroitz had sufficient notlco both by that pub lished and that mailed to him to ho heard as to the proposed increase of valuation of the property. But I fall to find In the record any evidence that complaint was filed or rondo in writing , that the assessed valuations were too low or that any evidence to that effect was received or offered under the rule estab lished bv the supreme court. This is fatal to the validity of tbo action purporting ? to in crease the valuation of lot 0 , in block 171 , from $1,000 to $ lSOO , and part or iota1. ) from ? l,000 to $1,500. .The rate ofctaxn- tion for city purposes within the limitations prescribed by law is so manifestly and en tirely in the discretion of ttio mayor and city council that a court would not ho justified in Interfering with It except upon proof of gross and flagrant abuse. The plaintiff is entitled to nn abatement of the taxes on the $1,800 increased valuation , being 13 mills on the $1 , making $ tf'J to bo deducted as ofthodato when the taxes commenced to draw Interest. Upon paying his taxes , on that basis , within twenty days , a perpetual injunction will bo granted with costs against the city. Otherxvlso the action must bo dis missed for want of equity , with costs. " In ICountzo vs Donnoll , It was decided that plaintiff's ' lien for.nurchaso inonoy Is subordi nate to the liens of material In and laborers. Judge Clarkson announced that ha would hear oxparto matters , and the other judges could bo scon In their own rooms. Judge Wakoloy announced that ho would render other decisions oa Wednesday. "Docs your mother know you're out , " said a boy to his llttlo brother.
