Every warehouseman of class A shull bo
required during the Hrst week of January of
iach year to iiubllsh'tn ono or more of the
newspapers dally , If thcro bo such published
n the town in which the warehouse Is
ocatod , n schedule of rates for storage dur
ing the ensuing year. Thcso rates , except
under curtain restrictions , shnll not bo In
creased during the year. 'Mo discrimination
shall bo made in the rates for storing grain.
The maximum rate for handling prniu , In
cluding the cost of receiving and delivering ,
shall bo for the Ural ten days or part thereof
Iceut nor Inisliol , and for each tpn days or
part thereof after the first ten days one-half
of 1 cent per bushel , provided that grain
dump , or linblo to early damage may bo sub
ject to 2 cents for the llrst ten days and for
each additional llvo days or part thereof not
exceeding one-half of I cent per bushel ;
provided , further , that where grain has boon
received prior to January 1 , IS'.ll ' , under any
express or implied contracts lo p.iy and re
ceive rates of storage different from
these pro cribcd hy law , or where
it has been received under nny usage or cus
tom prior to said day to pay or receive rates
of storage different from the rates Jlxed by
law , it shall bo lawful for any owner or man
ager to receive and collect such agreed cus
tomary rates.
All grain shall ha weighed on receipt and
delivery nnd annually on n date to ho pro
scribed'by the board of transportation.
No warehouseman shall bo held responsi
ble for loss or damage to property byflro ,
provided reasonable care mid vlgllanco bo
exorcised to protect the same ; nor from hont-
ing if it can bo shown ho has exercised proper
care in handling the sntno.

they discover that any portion of grnln is
out of condition or becoming so , uud cannot
save the same , shall Immediately glvo notice
by advertisement In n dally paper In the city
in which the warehouse Is situated , as nlso
posting n notice to the same otTcct In n pub
lic pluco of the actual condition of the grain
ns nearly as the game may bo ascertained ,
stating nil the facts relating to Its receipt
and grade.
Any warehouseman who shall do anything
to depreciate the vnluo of grain in his
warehouse shall bo held responsible
ns nt common law , or upon his
bind und in addition thereto his license shall
bo revoked. If grain declared out of condi
tion Is not removed within ono month from
the time of serving said notice , the ware
house man may sell the same nt publlo auc
tion for the account of snld owner by giving
ton days' notice in a dully newspaper.
No warehouseman shall tamper with any
grain in hisoharno with a vlow of prollt to
himself1 or nny other person. Ho may , how
ever at the request of the owner , dry , clcnn
nnd improve the condition orvaluoof grain ,
but in such rasa the grain shall bo delivered
only as such separate lot or as the grndo in
which It was originally received.
Persons owning grain in store and grain
Inspectors may nt all times nxamlno the same
uud for this purpose warehouses shall always
bo open to thorn. Any warohousfiinnn who
shnll use Imperfect or Incorrect seulea shall
bo linblo to prosecution ,
Any person uctlnp as Inspector without nu-
thority so to do shall ho liable to a line of not
less than $100 nor inoro than $200 for every
offense.

It shall bo unlawful for nuy warehouse
man to combine with any railroad company
or anv Individual for any purpose contrary to
the direction of the owner.
If any warehouseman shnll ho deemed
guilty of n violation of nny of the provisions
of this net , ho may bo proceeded agulnit hy
the parly injured In nny court of coinpotcitt
jurisdiction. In the tnnttor of criminal pros
ecution the case must bo conducted oy the
county attorney.
Warehouse receipts for property In nny
class of publlo warehouses shall bo transfer
able by the endorsement of the party to
wliosa order such receipt may bo issued , und
such cndOnomcnt shall ho doomed a vnlld
transfer of the properly represented hy such
