The preliminary examination of the man
Covoll , which has been dragging along In the
superior court for more than n week , was
completed yesterday afternoon so far as the
taking of testimony was concerned. The
attorneys began their arguments after being
notified by the court that ho should feel per
fectly frco to call them down whenever they
tried to tell him anything ho already know.
The case has become quite n chestnut by this

The list of business failures , which has
been lengthening at such an alarming rate In
this city , wns Increased yesterday afternoon
nt 7 o'clock when Sheriff Mclll , accompanied
by his deputy , Jack Cuslck , entered tbo
Model clothing house , located nt the corner
of Broadway nnd Scott street , and de
manded the keys from the proprietor
of tbo establishment , Mr. L. H.
Mossier. IIo prefaced bis demand by show
ing two writs of attachment , which hnd been
Issued in the district court , ono by Bradt ,
Shlpmun&Co. for ? filH.74 and the other by
Frankonthnl , Frendcntbnl & Co. forl,074.lV > .
Both of the attaching creditors are New
York firms. The keys were delivered Into
the bunds of the sheriff nuu the place was
closed tip.
When questioned aVout the affair Mr.
Mossier was very much excited. "H is all a
mistake,11 said ho , "Wo have been trying
for several weeks to got some money , but wo
couldn't do it , nnd Its all a mistake , anu that's
all I know about it. "
Notwithstanding Mr. Mover's vehement
protestations some of his friends are unkind
enough to hint that the move was not alto
gether unexpected on his part. Mr. Mossier
had no Interest in the stock of fixtures , al
though ho has to all appearances been the
lord high executioner of the concern. Ho
failed in the same way three or four years
ago , and diu not start In again for nbnut
eighteen months' . When nt last ho resumed
business tbc property was all in the name of
his brother , who lives in Missouri. A quiet
rumor got afloat to the effect that It wns the
intention of Mr. Mossier to go out of tno
business and take his stuff to Missouri , and
it was this rumor that led to the attachment.
The grounds , as alleged In the writ of attach
ment , were the non-residence of the owner
and the fact thnt the proprietor wns about to
take the goods out of the state for the pur
pose of duf rauding the creditors.
When the sheriff took possession the money
drawer wns empty , a fact which gave color
to the rumor th'nt something uncommon had
been nbout to take place , But whatever that
something was , it failed to materialize. .
Mr. Mossier stated to a Bui : reporter last
ovenlngthnt the firm owed the money claimed
by the attaching creditors , but that it was
not yet duo , and ho had not the slightest Idea
wny ho was closed up. Ho also stated that
ho had telephoned his brother , who o\vns the
stock , for instructions.

For the past few months the lovco problem
hns been of sufliclent importance to attract
general attention In Council Bluffs , and the
question of whether it was advisable to have
tbo old levee widened and strengthened or
to Invest $25,000 or $ . ' ! 0,000 in n now bank has
been thoroughly discussed in all directions.
But a new phase of the problem has been
presented to the public within the past
twenty-four hours that completely over
shadows all other features. It Is Important
and imperatively demands solution.
When the old lovco wns built three years
ago the city council passed n resolution di
recting the assessment of a 2 mill tax to pay
for the work nnd certified It up to the county
auditor as a special tax upon property bone-
fitted by the protection the bank afforded.
The tax was levied upon the consent of the
property owners and the agreement of tbo
majority of them to walvo any nnd all ques
tions ns to its loenlltv. It was in fact guar
anteed largely by T. J. Evans , George F.
"Wright and other property owners who
bail largo interests to bo protected ,
It now transpires that the tax levy
was entirely too small to cover the costs of
the work. It has about ail been collected ,
last year's collections only amounting to
about 250 , and the whole amount realized
wns only about § 2,500. , Warrants for nearly
double this sum were Issued against this
fund , nnd at the present time there is duo
and unpaid something over $ 'J,100 worth of
these warrants , and Interest for thrco years ,
which brings the entire amount up to nearly
$ i,500. , The quandary the council finds
Itself In now is how to provide
for the payment ot these warrants ,
Sluco there hns been so much squabbling
over the matter anil so many Injunctions
threatened It is very likely that the property
owners , or many of them at least , will resist
uny attempt to tax them further for the pay
ment , of this old debt. It is an ugly problem
whichever way it is 'looked nt and will give ,
the aldermen ti good deal of concern before
nn avenue of eacapo is discovered.
It is Intimated thnt the first thing that will
bo inquired into is the guarantee of the gen
tlemen named , nnd if they will agree to make
good tholr promises at this late uay it will
relieve tlio aldormcn of a good deal of uncasi-
ness. If they refuse to do this , which Is not
at all Improbable , in view of the fact that
tliov have understood that the debt has been :
entirely liquidated , the council will bo com
pelled to make n now special levy upon Clio
property. Wlicn this is done it is not nt all
improbable that some Injunctions will bo
asked for.
The discovery that these warrants were
unpaid was not maito until yesterday when
City Treasurer Kinuchnn asked Chairman
Wood of the finance committcu what should
be done with the unpaid warrants , imparting
the information nt the same time that the
special tax hnd been exhausted nnd $1.100
worth of warrants were still outstanding in
the hands of local capitalists who did not
know the lost penny had been paid out of the
fund provided. Thcro Is no question about
the warrants hclug collcctacle , but the man
ner of providing the fund is a serious obstacle
in the way ,

A Jail Hronker Caught.
W.-H. Hobb is the name of a young man
who was arrested yesterday morning by
Officer Bcswlck. Although barely out of his
teens , ho has achieved a reputation for gen
eral toughness which mighttwell bo envied
by many who have been in the business
much longer. He was a resident of this city
for several years past until last summer ,
and was a well known Ilguro around
the gambling bouses nnil other places of ques
tionable repute. After ho left ho drifted ;
about until ho flnully turned up nt Lincoln
Neb. , and begun operations ngnln.
It was not long before ho got into trouble
there nnd found himself in tbo county Jail on
n charge of burglary. Ho stayed iheroquletly
for n time , but ono morning when the jailer
wuko up ho found his bird had flown , where
ho bad gone was for a time roa
mystery , but ho wns nt last
traced to Havolock , a small place near
Lincoln , nnd wns followed by the chief of
police nnd an offlcor. The officers tied their
borso and searched for their man , but the
only trnco they could ilnd of him was when i
they returned for their horse nnd learned !
thnt Hobb had been there and had taken him
aWuy In tholr absence.
Knowing thnt Council Bluffs was Hob b's
homo , the Lincoln authorities surmised that
bo might come hero next , nnd they noti
fied Chief. Cnry of his escape nnd illy
fered a reward for his recovery.
The Bluffs police had n few scores of their
own to settle with Hobb , ho having been Im
plicated lu a robbery hero several months
ago , and they were very willing to be on the
lookout. Officer Bcswlck got on his track
and finally overhauled him yesterday morn
ing at Schemer's saloon on Lower Uroadwny.

Special School Hoard Meeting.
A special meeting of the board of education
was held last night for the purpose ) of audit
ing and paying a largo number of bills and
transacting a lot of routine business that has
nei-n accumulating for a long time. The pres
ident ana nil the members were present.
Chairman Hunter of the finance committee
reported n resolution providing for the Issu
ance of * I5X)0 ( worth of school bonds voted
nt the regular election lu 1SSO to pay
for now school buildings. The bonds
nro to run ten years nnd draw 0 per
cent Interest , which Is to be made
payable scml-nnnually at the banking house
of Kountzn Bros , in Now York. The resolu
tion was adopted and the secretary nnd treas
urer wore Instructed to sign the bonds and
date them January 1 , 1891.
The claim of Architect S. E , Maxon for
school building plans that were accepted and
subsequently rejected , was reported by a
special committee to whom it hnd been re
ferred nt n previous meeting , with the rco
oiiiincudation that ho bo allowed $300 in full
settlement. The report was adopted by the
board and accepted by Maxon , nnd the sec
retary wns instructed to draw on order for
ho amount.
Chairman Huntca of the finance conimlttco
recommended that the salary of Prof. Wynmn
bo Increased to tl'-'O per month for the ro-
tnnimlcr of the year. The proposition struck
the other members favorably und the ralso
was ordercu.
The teachers' nnd Janitor's ' pay roll problem
wns called up again and solved by the board
ordering the superintendent , chairman of tbo
finance committee nnd the secretary to ex
amine and O. K. the lists without referring
them to the board , anil if the officers desig
nated are unable to net , tbo remaining mem
bers of the finance committee were em
powered to look after the matter , thus pre
venting any delay In the payment of tbo
salaries.
Superintendent Sawyer presented his re
port for the past two months. It showed the
entire enrollment of boys for November to
bel.G''U . : girls , 1.710 ; total , ! Ui20 : average
per cent of attendance , S3. The December
attendance wns slightly better , showing 1HO , (
boys and 1,709 girls , with an average attend
ance of 01 per cent , nnd a total attendance of
! tS8. ! ) His report was'vory voluminous , and
liulldatcd that a good deal of harit and care
ful work had been upon It. IIo also made a
verbal report of his high school work , giv
ing examples of the practical character
of the methods a instruction adopted.
Ho requires his pupils to keep abreast of
the times mid study current events as well as
book problems. Ho requires them to give
oral explanations ot such problems as the
Behrlngsca controversy , the Associated press
and what it is ; the ghost dances and the In
dian problem , and similar things that are the
topics of the times , The report apparently
pleased the board nnil they approved by reso
lution the methods of practical instruction as
outlined.

was finished the board adjourned.

Michael Lee , a switchman employed in the
Chicago , Burlington & Quincy yards , mot
with a bad accident yesterday morning about
daylight. Ho was walking along the top of
a freight train , when a sudden Joltlhrowhlm
from his perch and ho fell , striking heavily
upon iho hard frozen ground. His loft arm
wns broken in two places nnd was loft with
the bones protruding through the flesh In thn
horrible manner. Ho was taken to his homo ,

A Prisoner Attempts Stilclctc.

of the Inmates of the county Jiill was enliv
ened , aoout 3 o'clock this , morning , by an at
tempt nt suicide by hanging , made by John
McDermott , a prisoner awaiting trial
for assaulting n police ofllcer re
cently. His cellmate was awakened
by the sound of McDorraott being
strangled nnd immediately raised nn outcry.
The guards promptly rushed to the scene and
the man was cut down Just In time to save
his life , lie had torn up his blanket and
made n rope with which ho hung himself 'to
the grating of the cell. Ho is a sufferer from
erysipelas , whlen is supposed to have made
him tired of life.

The amendment offered by Mr. Faulkner ,
proposing n substitute for section 14 and to
provide for tbo appointment by the court of
a board of three persons In each congressional
district to bo known as the United States
board of canvassers , was taken up. Mr.
Fnulkncr advocated tbd amendment and
condemned the action of the republi
can senators in stifling discussion by mov
ing to lay the amendment on the table.
In the course of n colloduy between Messrs.
Faulkner , Gray nnd Spooncr. the latter
styled , as nn Illustration of what the bill
meant , that if ho had a boil on the back of
his nock ho would not think it necessary to
place a poultice over hls'wholo ' back.
The illustration was taken advantage of
by Mr. Faulkner , who saw In It nn admission
that the bill was a partisan and sectional
measure to bo putlu force only in ono part of
the country.

senate and seems good fpr several hours , and
it Is pretty evident that the object on the
democratic sldo is to occupy tlmu. There are
not moro than a dozen senators on each sldo
of the chamber , but there are largo reserves
In the cloak rooms ready to meet any phase
of the question that may present itself. The
galleries are now nearly empty , but the pros
pect Is that the session "will1 continue through
the watches of the night and perhaps all day
tomorrow.
Mr. Pasco a short tlmo ago directed the at
tention of the chair to the absence of a quo
rum , and as the call is being made senators
como into the chamber and prove that there
are more present than is needed to constitute
a quorum.
Mr. Faulunor continued speaking until
1:20 , when the absence of n quorum was
brought to the attention of the chair by Mr.
Sanders. A call of the roll showed only
tbirty-slx senators present , only five of that
n umber being democrats.
A motion was made by Mr , Hoar
to compel the attendance of ab
sentees , but Mr. Harris made the
point of order that the first motion
under the rules was to direct the sergcant-
at-arms to request the attendance of absent
senators.
The presiding ofticor ( "NVashburn ) sus
tained the Doint of order , und Mr. Hoar
changed the motion accordingly. The mo
tion was ngrecd to and a IISL of the absentees
was furnished to the sergeant-nt-arms. The
only democrats present were Messrs. Cock-
rill , Faulkner. Gorman , Harris and Pasco.
Before the list hud been handed to the
scrgeant-nt-arms ' flvo moro senators , all re
publicans' , hud answered , making tbo whole
number present 41 , or four loss than a quo
rum. Up to U o'clock no senator presented
himself In compliance with the request and
it looked as if u quorum might not bo secured.
