JuJgo Dundy banded down a decision
yesterday In the case ot Osborno against Fitz
gerald ot al. The case hud been pending in
the United States court for two or thrco
years and hail Its origin in an agreement to
do certain work on a Colorado railroad. Ac
cording to tlio claim of tlio plain
tiff , Mlclmel Oshorno , n contract
vuis entered into by Fitzgerald , of Fitzgerald-
Mnllory fame ; It. C. Gushing- , now mayor of
this city , and the plaintiff , a prominent rail
road contractor. The contract called for the
construction of about ten miles of railroad ,
and what is known as the Alpine tunnel in
Colorado. This work had hocn commenced
nnd partly completed by several contractors ,
who failed to iinish It. Accordlnc to Os-
borno's representations , Fitzgerald was to
furnish nil the money required , and
CushinK and Osoorno were to do the
work ; Fitzgerald was to huvo one-halt of the
proflts and CushluB & Osborno wnro each to
have one-fourth of them. Fitzgerald claimed ,
however , that ho was bound to furnish only
one-third of the money and receive one-half
the proflts , whllo the others did the work.
Alter the .work had been completed the
railroad company refused to pay tlio contrac
tors and suit was brought to recover the
amount , some jOO.OOO. A compromisewas
cllcctcd , however , on a basts of SrlJ.OOO , which
amount was pnid to Fitzgerald. Ho kept the
entire amount , claiming that lie was entitled
to itas it only coverall what ho had advanced
on the worlc , together with interest on the
amount.
Osborno then commenced suit apnlnst Fitz
gerald nnd Cushlng for an accounting , nnd
each of the defendants lllnd a cross-bill , that
of Cushlnp being practically n corroboration
of Osbornu's claim.
The court held that the construction of the
contract as claimed by Osborno was correct ,
and that Fitzgerald was not entitled to inter
est on the money advanced. H wns
further held that Fitzgerald was bound by
the contract to furnish. all the money nnd
receive ouo-hnlf the profits. Fitzgerald was
ordered to pay to each of the others one-
fourth of the proUts , together with interest
from the time they should have received
their share of the proceeds. The amount
which Osborno & Gushing will receive will
bo in the neighborhood of ii,000 , each.
The Chicago lumber company has entered
suit in the United States circuit court against
the E. E. Nouglo company to recover
? U , 102.04 , alleged to bo duo for lumber fur
nished the defendant.
Some time ngo it looked as though the end
of the long fought contest between the two
rival companies , the ICit Carson cattle com
pany and the Harlem cattle company , was at
an cud. The former company had obtained n
Judgment in tno United States court and an
order had boon issued to sell the property of
the hitter nnniod company to satisfy n
clnira of 833,000. The property consists of
5,000 acres of land , together with the
horses , barns and sheds thereon situated
in the counties of Chase , Dundy und Hitch
cock. The time for selling this property was
set for today , but yesterday un attorney for
the defendant appeared before Judge Dundy
and secured nn order postponing the su\o \
until further notice.
J. J. Lnrkin , who was formerly engaged in
the dry goods business in this city , is ilgur-
ing on buying the property , nnd should the
sale po through it Is probable that all pro
ceedings will come to u sudden termination ,
but If ho does not , then 'there Is a chance for
a merry war in Unit portion of the state
where the land is situated , ns the settlers
claim tlint nearly four thousand acres of the
land held by the company is covered UP , nnd
by rights is still n portion of the public do
main , They claim that the title to this largo
tract was obtained by fraud and that it was
held down by men in tbo employ of the cattle

Pint riot Court.
Judge Doano's court wns in session yester
day for the purpose of hearing motions. The
case of Ada E. Flegg against Jamua Steven
son was argued at length , the former Judg
ment set aside and n new trial ordered.
Some months ago Mrs. Flagg was driving
on South Fourteenth sticet , when she was
run into by n cabman , her vehicle wrecked ,
nnd she was seriously injured by being
thrown to the pavement. Suit to recover
$ T,000 damages was brought , and at the trial
Judgment for $1,000 was returned by the Jury ,
In deciding the motion for the now trial , the
court hold that it was not proven thutono of
Stovcnson's men was driving the cab that
injured tbo woman. _
