8 THE OMAHA DAILY BEE : SATURDAY. DECEMBER 20 , 1890 , Ho Suggesta Borne Legislation Which Ho Believes to Bo Necessary , CHARGED WITH WHOLESALE FRAUD , An Old t/n ly Grows IiXtravnRaiit and Her Son Asks 'Hint u Guardian bo Appointed Utlicr News About LIKCOI.V , Neb , Deo. 10 , ( Special to Tun Bun , ] Among tlio things that nttrnctcd the attention ol some of the alliance delegates on the sldo whllo In tlio city was the matter of state oil Inspection. Many of thorn scorned to think that It was a. useless piece of machinery that ought to bo dispensed with , whllo others deemed It a necessary Institution. Most of the alliance men labored under the Impres sion Unit the expenses of oil inspection were paid for out of the state funds , and this was presented as the inalu argument for the dis continuance of the ofllco by the coining legis lature. Smith Caldwcll , the oil Inspector , and Colonel Hoover of Blue Hill , one. of the depu ties , -wore at the state house this morning talking over the situation , mid in rarlonso to inquiries the Inspector said : "Tho law in re- gai-J to oil inspection went into effect July 1 , 16b , aim evcrslnco that time four deputies nnd myself have been actively engaged in the work. The ofllco lias paid its own expenses , the salaries of the chief and his deputies and paid Into the state treasury the sum of $2- 050.17. "During the twenty-three months ending December 1 , 1890 , wo nnvo Inspected 2JOOOU barrels of coal oil and have paid to the stnto treasurer the sum of Slb'J5.-0. ! So you see the ofllco has not cost the people one penny directly , and jet coal oil Las been cheaper than ovei before. "It would bo a grave mlitnlto to repeal the law governing the inspection of oils. If any change is madu It should ho to raise tbo test , which is much lower in Nebraska than in neighboring states. Also , the oil companies should bo prevented from putting any brand on thtlr barrels purporting to show what tbo grade Is , as they nlwnys mlsrcnicscnt the pi-ndo. They often brand a bairel 'Headlight oil' and ' 175 test , ' which , when examined by the Inspector will not , in nine cases out of ten , reach the standard claimed. This is an imposition on the local dealers and consum ers. The only brand allowed should bo that of the inspector. " A. u-.iT-iiANnnn COMW.IME > T .Tny Bunows Insists that THE BEG must have had a confederate oi' spy In the alliance convention to ohtnln such a correct and de tailed account of the proceedings. Mr. Bur rows Is mistaken. As far as Tun I3nu Is ownro theiocro no traitors nor spies In the meeting1. All the facts published were the result only of the patient and persistent pumping of members of the alliance , who un consciously betrayed piece by piece the pro ceedings of the convention. Mr. Burrows un intentionally compliments TUB BEU on its cntcpribo. wiirnu is TiicoDoncI Theodore Horn , jr. , who has been in the Implement business in the little town of llickmun , south of Lincoln , has absconded with Intent to defraud his creditors , If an ttflldnvit Jiled today In the county court by his father , Theodoio Horn , sr. , Is correct. That ho is also owner of a note signed by Francis E , Newton 'and pay- nblo to his oruer forI 17 , and that there is'a suit now pending in this court wherein Tyo is plaintiff and tbo African M. E. church is defendant , wherein the said Tyo seeks to foicdoso a mechanic's lien , but that for tbo puiposo of defrauding the plaintiff ho is about to sell and assign said mechanic's lien and snla note , so that the plaintiff will bo unable to collect his judgment , wherefore Godfrey prajs that the conveyances of the lands by tno said Gcorgo TjotoMniy Tye may bo set aside and said real estate bo or dered sold to pay plaintiff's Judgment , and thnt tbo defendant bo restrained from selling or disposing of said note and mechanics Hen until tbo further order of the court. BOYD'S THEATEll IjEASED. Thomas P. noyd to Manage the New lloiiHO Now Hulldlu . Thomas F. Boyd is to bo the manager of Boy's new theater. That fact was settled yesterday by the filing of tholeaso for flvo years , in which Mr , Boyd agrees to pay $18,000 per annum and two-thirds of the iroflts above that amount if any. This may not bo news to many people , for It has all along been thought that Mr. Bovd would net as his brother's representative in the now house. But a series of complications arose lurinc the post fortnight , nnd until yesterday it was no sure thing that Mr. Tom Boyd would manage the theater , riuch less bo associated with it in anyway. A week atjo Mr. Will Davis of the Chicago opera house camb quietly into Omaha , his prescneo being unknown oven to the nows- men. Ho saw no ono except Mr. Saper . Boyd , and they were closeted together for several hours. Ho had como to offer to lease the now Bovd at an annual rental of $13,000 and half the profits it any. There was a good deal of hard feeling en gendered by reason of this offer of Ilayman & Davis , whom Mr. Davis represented , and Tom Boyd decided that ho would take a hand la the general fight for the houso. And so , after a great deal of talk with the govern or-elect , T. F. Boyd madotho offer which wns finally accepted yesterday and the lease recorded. Long before the house now buildlnp wns commenced Tom Boyd , who was instru mental in Its being started , assured his brother thnt ho would realize 10 per cent on the investment , but by the terms of the lease ho realizes 15 per cent.
