The Stnto Endeavoring to Find Who In ItCHponsible Tor Taking It. The defense , in the Tony Frank murder trial Introduced their testimony yesterday morning. The first witness examined was J. C. Reeves , who was recalled to show that from the position In which Mr. and Mrs. Strublo were sitting In the front room they could not BCO Chronistcr and Mrs. Hood in the kitchen , olthoug they had previously testified that they could see both of them. Observer L0. . Welsh of the signal ofllco was the next witness and testified as to the Into of the weather on the night the mur der was committed. Ho stated that snow fell and the weather was generally cloudy. O. O. Connors was the next witness and win called for the purpose of showing that , in 'tho position In which It had been shown Chronlster was sitting , his head would have been so low down , with reference to the window through which ho was shot , that tbo shot would have blown the whole top of his head oft Instead of having the effect It did. Judge Uoano and a jury took up the case of Anilelucin , Murray against Judge L. H. Bradley. The suit was Drought to recover $200 for n horse which was killed and a car riage which was damaged in u runaway ac cident on July 4 of the present year. The petition alleges that Judge Bradley hired tlio carriage In question at the plaintiff's ' livery ittnblo and the torses ran away , smashing the carriage and injuring ono of the horses so that It died. The plaintiff seeks to recover $200 for the horse aud the damages to the vehicle. The trial of the case of Edward Nelson against William II. Long was commceccd in Judiro Doan's court yestcaday uftcrnoon. Both of the parties are wealthy farmers re siding near Waterloo , in the western part of the county. There Is trouble between the two men and it Is of long standing. In his petition Kelson asks for $5,000 to patch up a damaged reputation , and he also alleges that Long is the cause of all his trouble. Accord ing to the testimony Nelson borrowed some money of Long , which ho did not pay. Long Insisted upon payment , but the money was not forthcoming , ana n tow nights later an ciley was hung la n nubile place and plac arded , "William U. Long , 10 per cent per month. " This made Long mad , and ho turned In and circulated a remonstrance against the appointment of Kelson to the po sition of postmaster of the town. In addition to this , Nelson now charges thnt Long circu lated a report that ho was a thief and ought to be In tlio penitentiary , and would bo there if ho got his just dues. Federal Court , Judge Dundy held a short session of court yesterday afternoon , at which the case of Davis & ICelloy against tbo Kansas City & Beatrice railroad was disposed of for the present. Uuvls & IColloy were contractors , and in the construction of the roadbed per formed labor and furnished material to the amount of $ ll,5U9.U7. Shortly after this the road went into the hands of a receiver anO the contractors werq loft without their pay. Suits were brought , but in the meantime a mortgage was given to the Now York secur ity company. The attorneys for the cred itors held that the labor claims should come in ahead of the mortgage. This question was brought up yesterday and un a showing the receiver was enjoined from paying any claims until the case can bo hoard , as to whether or uot the mortgage Is n prior lion. Judge Dundy will hear the arguments on this point on January SEJ at tbo Lincoln term. County Court. In the county court Joseph Karan has brought suit against Frank J. Bholauy to recover 1003.70 , duo on eight promissory notes , Milton Roger * < & Sons have sued Mattlo Martin and seek to recover $772 , duo on a bil of roods sold and delivered. "The city hereby agrees , in case it is do- idcd in the suit of Douglas county vs. Viiliam Coburn. now pending in the supreme : ourtof Nebraska , that the city of Omaha is [ able for the charges and fees for receiving , teeping , lodging and feeding sold prisoners n the county Jail ot Douglas county , Job. ; that the city will reimburse ho county for nil charges , and ees incurred or paid under this contract for iccplng , receiving , lodging and tccding said irisnners in the county Jail. 'Captain Huhlen , assistant quartermaster , has been ordered to report to General Brooke for temporary duty In tno depart ment of the Phitto. Captain Ruhlon will ar rive this nftornoon. Captain Markland , First Infantry , sta tioned at Fort Niobrara , has been grantc4 a leave of absence for ono month , on account of sickness. Captain Charles Parker , the senior captain of the Ninth cavalry , died In Washington , 1) . C. , on Friday last nnd was burled at the Ar lington national cemetery on Sunday. Private Finko , company C Sixteenth in- fnntry , stationed nt Fort DuChcsno , has been ordered transferred to company D , Twenty-first infantry at Fort Douglas , Utah and ordered sent to his new company.
