Judge Tiffany immediately after conven- ingcourt yesterday morning , and before Cleric Moored had read the Journal , instructed that the Jury in the Reynolds murder trial bo tnltcn through the alloys and streets where Nestle pursued the men who shot him. The jury was accompanied by the assistant state's attorney , the attorney for the defendant , Sheriff Uoyd , and the prisoner and Bailiffs Grebe nnd Hunt. The first witness called for the state was Ofllccr Mitchell , of the Metropolitan police force. The defense objected to him because his full name did not appear in the Indict ment. His Christian name Is Fiunk , but on the indictment it lead "Onleer Mitchell. " Judiro Tiffany overruled the objection and the witness proceeded. Ho said ho was n mem ber of the Metropolitan police force. Ho wns oa duty on the night of ApriL ao when Nestlo.was shot. Ho met Hoynolds on Tenth strcut in front of the St. James hotel about midnight. The fellow looked suspic ious nud was questioned closely. Reynolds said his name was McDonald and that bo lived with his aunt near the Union Pacific bridge. The man said bo was on bis way homo , but started off la a direction opposite to that of his homo. The ofilcer then placed him under arrest. Who searched , the pris oner had a billet strapped to his wrist. Knight Latham , a scavenger , testified that ho haa seen Nesitlo about i ) o'clock us ho ran out of the alley on Twelfth street. Nestle said , "I have been shot and cannot live. Take tno to the nearest doctor.1' Witness put Nestle in his buggy and took him to the pollco station. Nestle said ho could feel the blood running Inside of him and would die. Hall identified Hcynolds as ono of the men who stopped him on the night of the shooting. Reynolds was carrying an over- ntii and Howard. The mon then went over toward Ilarnoy street nnd the witness went homo. The hour was between half past 8 and 9 o'clock. ' Reynolds , the accused , was pit ] upon tbo witness stand. He denied all knowledge of thoshooting1 , claiming to have been in an other part of the city at the hour when the 'atal shot was fired. This testimony closed , ho case and the arguments will bo inado this norning. In Judge Doano's court the trial of the case > f the Nebraska savings bank against Henry sangwhi and Guy C. Matterson was on trial. I'ho bank is seeking tq recover the sum of $3,000. The facts as set forth by the plaintiff show that in September , 183S , the defendants , who nro contractors , undertook to complete .ho hank building nt Twenty-sixth nud N streets , South Oinabo , agreeing to have th6 same ready for occupancy by December 10 of that year.
