Cody lives on tlio Pltiney farinas a renter. Ttio list real trouble that occuricd was when ttio nformatloii was convoyed to ttio United States commissioner that Cody was violating the internal icvemio law by soiling tobacco. After Ids arrest ho waived examination and was placed under S.100 bonds for trial. .At the trial before .luilgo Sutras ho showed that ho had only technically rather "than willfully violated the law by carrying out to bacco for tlio men engaged on the farm. IIo caino to town regularly once or twice ) a week and was almost invariably requested by them to bring them tobacco. Sometimes they would give him the money with which to buy it and sometimes they wouldn't , but would give him the money when ho delivered the tobacco. They also freciuontlv came to him nnd bought 10 cents woith of dog-leg. When ho case was called for trial it developed tlio fact that Lyons had something to do with the Information upon which 10 was arrested. Cody was dis charged and returned homo feeling nat- utility a little sorer than ever , and there were more quarrels. Ho was very bitter In bis ibusu of l jens nnd members of his family , ind sought every means of obtaining revenge. IIo finally hit upon a scheme which ho .houglit would operate to ttio discomlUuro of ils enemy. He begun a systematic course of : caehing the children of Lyons to disobey their pircnts , and linully endea\orod to in duce the oldest boy to become the beaier of wd stoiies to Dr. I'liinoywhich , if the doc tor believed , would have been the means of imklng considerable trouble for Lyons. The boy took the fellow's candy , ljut lefuscd to carry the stories , and thereby gained the ill-will of Cody. Day before yesterday ho took the boy to task for his fnlluro to comply with his agreement , nnd begun to abuse him severely. Ttio father interfeicd to protect his son and a brief light occuricd. Neither of tbo men was hurt , but after it was over Cody irot a coraknife and ItCKtiu to flourish it around and threaten to take Lyon's life. Ttio men separated befoio tlio threat could bo executed Liter In the evening they met In tlio Held. Cody had pre pared himself for a vicious assault and made it with a vengeance. Ho struck [ jvons vliu , a brick and knocked lilm tlcmn and tbcn boat him fearfully with a club. He lett him apparently dead nnd m.ulo his escape. Ljons revived nnd dlagged himself to the house. AVhen ho arrived thcio ho was nearly dead and pre sented a pitablo sight. One of his ojes was knocked out and was hanging down on his cheek , and was battered and bleeding from a CIO < ECII different wounds about the head and face. During the night ho gave ovidcnco of severe internal Injuries , and a physician \\as called. Yesterday morning his wife brought the news of the assault to the city , together with the report Unit there were gra\o fears that death would result from the injuries. She also swore to an Information In the superior court charging Cody with assault with Intent to commit murder"and the war rant was turned over to Deputy Sheriff Foie- num , who spent the remainder of tlio day in searching for Cody. Couy Is a very odd looking fellow , of very small statute , but heavy and with hair grow ing down almost to his eyes. Jt is stilt and bristle-like , und together with tlio stubby , wiry beard ho wears , gives him u , peculiar auimal-liko appearance. The In structions were very full , and these who had listened to tlio trial la dot-ill made very fav orable comment upon tbo fairness of clear ness. The case was given to the jury before 10 o'clock in the forenoon. Their task was not an easy one , as the case had been on trial for two weclts , and much evi dence had been introduced on both sides , coveting a great variety of matters. The Jury was given four forms of verdicts from which to seloct. One was in favor of the plaintiff as against both thobank and Charles U. Ilannoii. Another was against the two , but stating what amount was found against each. Another was If the Jury should liml a a Judgment against ono and not any against th other. The fouith was to bo used if the Jury found In favor of the defendant. llesides deciding as to a dcrdict , ttio Im- poitant nuestioii was to bo decided , in case judgment was In favor of Mr. I3urko , how much should the damage bo ? The jury was given a largo range In which to disagree , al the way fiom ft to jOO,000 , the amount claimed in the petition. At a late hour last night the Jury was still out and there scorned little likelihood of there being nn lujruomont before morning at best. The Jurv was sllll out at H o'clock la < t night , and there was apparently but little hope of a verdict being reached. Vniious reports were In circulation concerning the standing of the Jury , but the ono that was consldeied to bo the most reliable was to the effect that eight of thorn favored a , clean ver diet for tlio banic and four wanted to give the plaintiff u verdict and damages. The property Is the premises known ns the "Mint , " on middle Broadway , owned for years by Dan Cnrrigg. The purchasers were the committee appointed by the Oddfellows of this city to select and purchase n loca tion for their imv palace. The price paid for the lot was $13,000. The lot has a frontage of forty-one and ono thiid feet , and this makes the price about $1500 a foot. It Is among the mos > t valuable property on the street on account of Its loca tion and the number of feet it contains , All the other lots in the vicinity nro much smaller , and for this reason it is claimed the Oddfellows obtained a gieat bargain. The purchase is important , for It will in- biiro another modern palace on Bioailway , The order Is very strong in this city , nnd it numbers among its members some of the wealthy men of the city , The palace they propose to build will bo nt least four stories high , ana the prob ability is that two more stories will bo added before the plans are completed. The splen did location is very favorable ) for a line build ing and the members of the order nro am bitious nnd very desirous of making tuolr temple the tlncst in the west. Mr. Carrigg says tie will reinvest every dollar of the purchase money in Council Bluffs realty. The rain that ha ? so persistently endeav ored to spoil the races for the Council Bluffs driving park association ever since It has been started lias como around with Its old time uniformity for the past two days. The dripping clouds and bleak wilds would bo sufficient to discourage almost anybody , but thodrhing park people hnvo determined to keep up ttio flglit , and will make another attempt - tempt to complete the proguimmcs that have been arranged for the piosc-iit mooting. Thoraces races yesterdavere not postponed , but were dcclnied off on account of the rain and inuil , nnd it was thought for a time that there would be no further attempt made to complete tbo programme , but this did not suit many of the horsemen who were hero. Thoio are some splendid stallions In the park whoso owners are anxious to have them make a record , and they are satisfied that there Is no better track In the country for ttiem to do it upon thin the splendid stretch hero. An effort \\as miido to have the races occur today , and the scheme was looked upon with n great deal of favor by a largo number of the horsemen and some members of the association , but there were too many of the others who voro , opposed to Sunday races , and they strongly protested against It. It \\IIH argued on ono slue that there wcro thousands of people who had no scruples against Sunday racing , and who could pet away from their work and their business on Sunday when they could not find any other time to attend the races , and if the day AMIS f uvorublo a crowd of several thousand might ho expected. Tlio argument was also strengthened by the assertion tlint the races would Interfere with no person with con scientious scruples against It unless they pild their fifty cents and \\ent Into the park.
