"WHO OAVXS THl7 l OhICW A Bniikcr Seeks for One Issued to Another Gcnlmiaii. An interesting action has been commenced in the district court by Willard B. Mtllanl ag.Unst the JEtnaUfo insurance company of Hartford , Conn. It appears that on November 23 , 1SSO , D. \V. Saxe , tlio druggist , took out n $10,000 , policy on his life , payable to plaintiff , and as the solo security to the latter for an indebted ness In that amount. The policy piovidoa for the payment of n quarterly premium of SI0.10 December ( I , ISM ; March C , 1MO ; Juac 0 , 1890 , and September 0 , Ib'.W , nnd so on through cndi year of the life of the policv. Saxo paid the first two quartcily premiums and received the company's receipt therefor On December li , Ib5' ' ) , the plaintiff says ho wrote the company's agent , stilted his In terest In the policv and said that he stood ready to pay an } subsequent premiums which might fall due , In cuso of bn\o's jailing to pay them. On the next clay the plaintiff re ceived an answer la which ho says the nsont iwreed to notify aud call on him in case Saxo failed to pav. On Juno U , wlicn the third quartcily pre mium fell duo , the plaintiff s.iys bo sent his bookkeeper to the agent to make the payment. It seems that the company's nsent was moving his ofllco when the plaintiff's ' clerk called and tola the latter that if Mr. Mlllard would mnlco a check for the nmouut and leuvo at Ills ( Mllliml's ) oflico In the Omaha National bank building ho ( the agent ) would call for It. The bookkeeper reported to the plaintiff what the nentliiul said , and Milhml did as the agent had suggested , but the agent didn't come for the check. They Millard made anotlicr call on the corapatij's ' njjent , and tendered the check but the agent declined to accept it say ing that Saxo had made certain false luprcsentatloiiM in his application for insurance and therefore the company was not liable. The plaintiff's next step was to mall a cer tified check to the vlce-piwident of the com pany , It was icturncd accompanied by state ments similar tothoso made "by the ugent. When the fourth quarterly payment became due , Millard again iniulo u tender of the amount duo , this , tlmo 83020 in cosh. The agent refused It nud added that Saxo' a policy had boon cancelled. Tlio plaintiff concludes his petition with the statement that ho 1) without adequate remi'dy nt law , and that unless n court of equity shall intervene nnd compel the de fendant to cairy out the teinis of the said contract of insurance , lie will suffer great and irreparable dntjngo and injurv. Therefore , ho asks that the said policy bo adjudged and decrerd valid and In full force , and tliat defendant ho ordered to receive , when properly tendered , the premiums now due and that its o.llccw and , . , agents repre sentatives he enjoined from denying the validity of the policy and from Interfering In any way with the rights of tlio plaintiff thereunder.
