I'reslilont Charles Francis Adams and Vlco President Holcomb finished their tour of the Union Pacific system and returned to Omaha yesterday morning. Speaking of the trip , Mr. Adams said : "We found the road in very fair condition. 'However , tlicro was nothing particularly noticeable ono way or the other to call for Hpocial comment. "So far as our business Is concerned , wo nro moving a largo tonnage In fact It Is the largest , proportioned upon our mileage , wo ever had. "Tho outlook that's hard to predict. I never undertake to speak of outlooks. The unexpected so often occurs that tt Is impos sible for mo to forecast the future. Every thing seems to be moving along smoothly and satisfactorily. "Yes , wo have planned to build an exten sion of about ono hundred and eighty-live miles from Portland , Ore. , lo 1'ugct sound. That will develop a prolific region and open to us a source of general tralllc which wo have not heretofore been able to reach. "So far as I am advised the company docs not promise any hirUvor outlays , except the Pnget .sound scheme. As you know , wo are changing this Kansas Central and Utah Northern from narrow to standard gauge lines. "There is no foundation whatever for the report of extensive improvements at Garllold beach this year. Anything that has been given publicity concerning that matter is en tirely premature. " When questioned regarding rumors of nioro changes to bo mndo in the ofllclal staff , Mr. Adams declared that he knew of none. "Mr. Dickinson's resignation , " ho con tinued , "is tlio last , and it there are others to follow , it is something I know nothing about. If an oulchil circular lias not been issued ap pointing J. " On being asked what Nebraska should dote to distinguish herself at the world's fair , Mr. Adams said : "It has always been and is now , in } ' opinion that the world's fair should either lie. abandoned entirely or deferred to the year I'.WJ ' , tin' . On general principles , it striked mo that a more lilting or proper place could not have been selected. But ns to what the several states , corporations and societies ought to do as regards displays , I sec no reason why they should not follow the line carried out in the centennial exposition at Philadelphia in 18TO. " "Tho country , " said Mr. Adams , "is looking very prosperous. " As to the condition of railroad matters , general mto wars particularly and schemes for organizing new associations , he had not read the papers very regu larly and consequently know too little about what was going on. Wilson , claim agent of the Koek Island nro in Omaha looking after business connected with tlio proposed cut off from this city to a connection with the Chicago , Kansas & Nebraska system. They are engaged in seeming Iho right-of-way and have already paid several thousand dollars to property owners between South Omaha and the Sarpy county lino. An Important question undur consideration at present Is whether to cross the Platte at North I lend or near Ashland. The former point is very much in favor. The threatened scheme of going direct to Beatrice and leav ing Lincoln out has been abandoned. In coming before the Jury ho said that had a feeling of hesitancy nnd weakness , not as to the position occupied by his client , but regarding his own as bolng called upon to stand between the decision of twelve of his fellow men and the life or death of ono poor , Ignorant man. Ho referred to the ilrst legal hang ing in Omaha , which occur rod thirty-one years ago , and made capital out of the fact that the victim was ono of circumstantial evi dence nnd that the real culprit confessed , upon liis death-bed , having committed the murder for which a victim had already been sacrificed. .This was followed with the read ing of number of cases of a similar nature. Mr. Crowell spoke for two hours , and was followed by Mr. Mnhonoy for tbo state , who addressed the Jury a similar length of tlmo. In tlio Afternoon. As Mr. Mahoney proceeded In his work of wcavinir tbo web of damaging facts about the prisoner us they were found in the testimony , Frank listened with apparently far less in terest than any ono of the few spectators. Indeed , all throughout the trial this man has shown an almost total lack of concern In the proceedings which would drive many another to Insanity. It is no exaggeration to say that had it been a trial wherein ho was being examined for the slightest misdemeanor ho could not have shown less interest. Mr. Mnhonoy spoke until 3 o'clock. At 11 o'clock last night the Jurors ceased their labors and retired to rest , stretching themselves out upon benches about the room. It Is understood that at that hour they had taken six ballots , and that upon the last bal lot the vote stood 7 to 5 in favor of conviction. District Court. Miller has applied for a divorce from Benjamin F. Miller. She states that they were married August " 1 , 1880 , in this city , nnd since that time tlio defendant , who is a conductor on tlio Missouri Pacific rail way , has contributed only twenty cents to wards her support. She asks that he be com- nelled to allow her money to prosecute the divorce suit nnd prays for divorce and res toration to her maiden naino of Sarah S. Uittcr. County Court. Elizabeth Gallighcr has sued George S. Smith and Elmer D. Frank for $150 on a note. note.W. . J. Council has sued John Chollnrm for SoOU for legal services. United States Court. In the United States court tbo case of Joseph M. Walter vs Miles McAleer , the Chicago grain broker , was continued before Judge Dundy. The testimony was all sub mitted to thojury last night and the argu ments will bo made this morning. A New Sustention Kesnrdlnj ; tlio U- ( dining of tlio Milkmen. A meeting of the board of health was heldnt tbo city physician's oflico yesterday morning , with a full attendance of the members. Dr. Uiipcn presented a copy of the rules of the St. Paul health department bearing on contagious diseases , for tbo consideration of the board. ' These were examined in detail and several were recommended to tbo city attorney with the request that ha frame an ordinance to bo presented to tlio council. They recommended , among other things , that school children from families articled with scarlet fever bo not allowed to attend school until llvo weeks after tlio disease bad disappeared and in the case of diphtheria the pupil should bo kept from school for at least one week. Other details regarding the duties of phy sicians were also provided for. The board also considered Iho milk busi ness. It was decided to recommend a license of $1 for each cow instead of each vehicle , as Iho ordinance now stands. A largo number of rules and regulations for tlio conducting of dairies were also acted upon , bearing upon every detail of the business. lUUKIIAUSiCU'S PLAN. Henry Bolln , a republi can , is said to have been the Ilrst to sign it. Many of these approached politely evaded the petition and through these men It was learned that Birkhauser wa * making this lust supremeelTort to induce the mayor to appoint him. Henry Pundt says that the pelitlon was presented to him last Saturday morning and that hu signed it. The list of names then numbered not more than ten or twelve.1 thought , " continued Mr. Pundt , "that Birk- hauser was the only man after the appoint ment for chairman of the board of public works. Ills friends represented to mo that ho was the best man for that position and I signed his petition. Had 1 known more about this matter I would certainly not have signdd his petition. " Just then Mr. William J. Kennedy passed by and be said : "Tho.ro goes mv choice. I was very sorry to have to tell him the position I had placed myself in. The only railroad company complying with the request o the board of transportation to furnish information as to cost of railroad , op eration , net carninpH , etc. , Is the Fremont , KlKhorn & Missouri Valley. The notorious Dr. Slominskl , whoso dark ways and means have been so often exposed through the columns of Tim HUB , Is hero in Lincoln running an alleged museum of anat omy. Ho is distributing about the streets certain pamphlets which in Omaha would cause his arrest on the charge of circulating obscene literature. A MANIAC surnnns. Richnrd T. liansen , a young man who be came Insane from vicious habits , committed suicide yesterday at the asylum. He was twenty-tour years old and was taken to the institution only about a week ago. The exact time of the suicide is not known , as at the time the body was found last evening it was still warm. Hanson ended his existence by cutting himself with glass. Ho smashed the window of his room , and tauing a sharp- pointed fragment gashed himself across the abdomen until bis bowels protruded. Ho then attempted to cut his jugular vein and loft several ugly gashes on his neck. This failing to produce death , he thrust the glass between bis ribs into his heart. The coroner was summoned but refused to hold an in quest. The body was sent to Bennett tliis after noon for burial. THH NOTKI ) M'AI.USTCIl WIMj CASE. The heirs of John McAllister have gained a signal victory toward proving J. H. McMurtry and J. S. Gregory guilty of fraud in manipu lating the will and other papers of the de ceased , as today in the district court the Judge declared the will null and void. The case has attracted more attention than any of the kind in Lincoln for many years. The his tory of the case is as follows : John McAllister was a crazy sort of fellow who , through his penurious habits , managed to save over & > ( ) , UOO. Ho would allowhlmself only 15 cents a day to live on , and in case ho grow hungry ho would 1111 his stomach with shavings. Ho was a crank on a certain theory of logic and lie often offered to make any one his heir that would follow his insane ideas concerning that science. Ho was twice con- lined in art asylum. During his lunacy it is claimed by the heirs that J. II. McMurtry and J. S. Gregory cunningly took advantage of the old man's imbecility to get hold of his property , and when he died it was discovered that lie gave McMurtry a claim in certain valu able lots on O street , and gave all the rest of his property in trust to Gregory , cutting all ids rightful heirs off without a shilling , ex cepting Ephraim McAllister. The heirs were very indignant over the state of affairs , and commenced suit. Among these heirs are General Scholiold , U. S. A. , Uov. James Schotleld , James McAllister , William Mc Allister , Emily Langworthy and others. The will wsis filed for probate in Septem ber , IBS' ' ) , but October 22 the heirs contested. They set forth in their petition that "J. H. McMurtry attempted to cheat and defraud McAllister by having him execute a mort gage for $7,500 , and later on ono for ? -J,0)0 ( ) , which are void. " They also claimed that "tho instrument was not the legal will of John McAllister , but ono which John Gregory Induced the deceased to sign through rraud and under influence. " They entered a protest against Gregory and McMurtry acting as administra tors. Later the contestants said they discovered that a young man employed In McMurtry's office know all about McMurtry's actions In the matterand that as soon as the real estate dealer discovered that the heirs were after his clerk as a witness ho offered him f.X ) ( ) to leave town or 200 to keep quiet. Last Saturday , however , the young man was sent to the penitentiary for forgery and after duo deliberation yesterday it was decided that the case against McMurtry and Gregory was strong enough without his tes timony. The judge ruled that tit the time the papers were made out McAllister was insane and the papers are therefore void. C1TV NEWS AND NOTES , Mrs. Thayor's symptoms are a little more favorable today , but she is still very low. The only nourishment her stomach will stand Is half a cup of beef tea and the same amount of milk and llmo water every twenty-four hours , Still the governor has hopes of her recovery. Anderson , aged thirty-eight years , died at his home , K street , between Twenty-third and Twenty-fourth streets , Sunday morning at 10 o'clock , after a linger ing illness , with pneumonia. Mr Anderson leaves a widow , Mrs. Mary Anderson , and an infant son , Edwin D. Mr. Ander son was one of the oldest residents of the city and has been a member of the police force for nearly threoycars. The meeting was to act on the contemplated improvement In the yards. The now building for the Union stockyards bank will bo erected Just east of the exchange building. The elevation to the northwest of the yards will bo graded down to a level and the removed earth will bo used to till up Lake Plvonka , east or the oxchungo.
