Speaking of the affidavits Lawyer Knemp- fcr said : "I do not remember Just now wheth'er Kopald or some one else about the hotel told mo of the proposition Olmstcad is alleged to have made. It was talked over in the hotel ofllco three months ago and I beard tlio talk. Just ns soon as thing oc- rcd Kopald told it to all the people in the pfllcc , a dozen or more and it would bo strange if the man should invent such n story on the spur of the moment. I consider Kopald's word perfectly good. Tlio story which I heard wns in effect about what the affidavit states. " Mr. Kopald wns seen. "What do you think of the Olmstead-Birk- hnuser affidavits ! " "What do I think of them ! I think they nro a pack of lies and I can prove it when the time comes. . "Birkhauser says that ho never hoard any conversation between Olmstend nnd myself. Ho didn't eh 1 Well then Olmstend is a liar. It was like this. My wife mid Mr. Schhink and some other people wore sitting in front of the house one ovcnfng In the middle of Febru ary lust , when Olmstcad and an older gentle man drove up. They had a bay horse and a top buggy with the top down. Tlio man with Olmstcad was heavy set , had n full partly gray beard and wore a cloth plug hat. I never saw him before , but could pick him out from among a thousand. "Olmstoud got out or the buggy nnd stood on the wallc. The old gcntlcinun sat In the buggy , not ton feet away. Wo talked so that any ono in the buggy , not deaf , could have heard us. "Olmstcad said , 'if you wi l sign over your claim for damages against tlio city I will glvu you a receipt in full for the Spetmnn claim.1 Then ho turned and waived his hand toward tlio buggy said 'Tills is my father-in-law , ho is the chairman of tlio board of appraisers. You had better do ns I say or you will get - little damages nnd maybe none nt all. ' I said I would do no such thing and he went to my wife. "Ho was right ; I got - little damages. Ho say I rent from month to month. I have n saloon license. That holds mo for a year and if ho will go to my landlady Miss Ken nedy ho will learn that I have a verbal lease renewable every three years. Would anyone- iio fool enough to run n business like this in n house bo might lese nt any time. I have nearly twice ns many rooms as Thlelgaard who got ? T. > 0 while I got Si-Jo. I have witnesses to prove nil this ; tny wife , Selihuik nnd my clerk. " Mrs Kopald would not bo able to identify the gentleman in tlio buggy but heard Olm- stead refer to him as liis latlier-in-lnw. Olm- stcnd , she says , came to her and said : "Mrs , Kopald you had bettor got your husband to assign these damages to mo or ho won't get very much out of it. I will give hinm a re ceipt for the Spetman bill. Changed Ills Mliul. A man named Brldgoa of Crete wished to purchase some machinery from Allis , arid asked for time for $15,000 on the amount asked for tlio outfit ) and this was granted him after ho had biiou rated as being worth $50,000 by the Cruto bunk through Its cashier. Duritii ; the process of th trial yrsterday morning Judpro Dundy rendered a very U-jportuut decision , William Wai- Inco , cashier of the Oirmlm national band was placed upon the witness stand and asked If It was customary for banks to answer questions put to them concerning n man's credit. This wns objected to nnd the objection was sustained , The witness was then asked what officer would answer sucli questions If they wore asked. This was nlso objected to nnd the Judpo sustained the objection , ruling that both questions were Irrelevant ns it wns not tbo duty of bankers under the law , although com mon usage may have made It a rule with such institutions to do so. Ashcnhurst lias sued the Midland publishing company In the county court for $7oO. In his petition ho alleges that ho en gaged with the company as secretary at $1,500 per year. Ho nlso subscribed for ? 1,000 worth of stock with the understanding that he waste to pay § ) .jO each year on the stock , the nmount to bo deducted from his salary. The grading contracts which were let by the board of public works last Saturday will bo carried out ns originally intended. Away down in one corner of the city treas ury a little wad containing about $ -10,000 has been discovered and turned into tlio general fund. Somebody happened to think that city warrants nro never drawn for more than IX ) per cent of the levy each year , leaving a bal ance of 10 per cent , which is counted on as being non-collectable. As the years go by , however , this amount is gradually collected nnd forms a surplus. Acting on this idea a search was made through the books of the treasurer and comp troller yesterday , which resulted In finding tlio amount of $10,000 which had been accu mulating during the period from 1800 to 18SI ! . This sum was turned into the general fund nnd the board of public works was noti fied that the contracts for grading might bo signed , as there was money to pay for the work. Accordingly the contracts were signed yes terday nnd the work will proceed. A great deal of comment was heard around the court house last evening when this fact became known. Several gentlemen thought it a strange proceeding that ns large an amount as $ 0,000 could bo on the books of the city and nobody know anything about it. A Traveling Man's Experience. F. S. Vcrbeck , who represents the typo foundry of Messrs. Barnhardt Bros. &Spind- ler , Chicago , says ; . "On my return homo from a trip I found our little girl sick with summer complaint.
