It Bcemcd as though the Indies had known before coming that they wcro to "bo provided for , because there were moro present than upon any day thus far during the trial. . The prisoner came In with lltlto change In Ills general appearance. Ho took the closest * * interest In every little thing about him and smiled .but ouco or twice during the entire forenoon. An extra stenographer was on duty and the two relieved each other at short Intervals for the jmrixHO 01 keeping up the testimony In typewriter form for use by the attor neys. . At the opening of the session Mr. Estcllo asked that the court make a journal entry , as part of tlio records In the case , that would substantially show that nothing was said to the prisoner or hit counsel in court with reference to his going to the farm , and that nothing wa said or done to show that ho had waived this privilege. The first witness was Thomas II. Cham- pany. Ho testified to having been In the gun business for eight years and that ho was an expert. "What is the weight of aJ2-callbcr ! bulloU" ho was asked by Mr. Mahonoy. "Objected to , " said defense. "Change your question , Mr. Mahoney , " said the court. Mr. Mahoney then handed witness the bul let extracted from the body of old Mr. Jones , nnd continued : "That bullet weighs 118 # gralns.what cali ber Is It ? " "Thirty-eight caliber , " answered the wit ness. Defense put a few queries of but passing Importance and witness was excused. K A. O'Hrien ' , city editor of Tin : Bun , next took the stand. Ho testified to having met defendant in the jail at Kansas City , Kan. . Friday morning , February til. "Did you have any talk with him at that time } " asked Mr. Mahonoy. Defense objected on account of the prisoner having then been under arrest. Mr. Mahoney changed his question nnd asked If Ncal was under arrest ut that time for the murder of Allen .Tones. Defense objected , and the objection was overruled. Witness then answered that prisoner was nt the time in question under arrest for this crlino. "Did you make any threats to him or ofTer him any reward } " asked tlio state. "No , sir. " Hero witness gave the substance of his In troductory conversation with Ncal , and pro ceeded to give the questions ho had put to and the answers received from Ncal. "I told the defendant that Mott , Dee , Mclchcr and Davis were coming down to see him and ho [ Ncal ] replied 'I haven't got any thing to say about it. ' " 'About whatl' " 'About the murder. ' "Who said anything about murder ! ' "Thero was a silence then for a few mo menta and I asked Neal if ho hud over been in Omaha and when ! Ho said ho had been there nlxnit two weeks before. I asked him if ho had bought any Jewelry there. Ho said ho had bought some. "Sheriff Howling , who was present , then said to Ncal ; ' "Didn't you tell mo that you had bought all the jewelry theroi' "Neal replied , 'I never said anything of the kind.1 ' " 1 then asked him when ho had been in J3outh Omaha. "He replied , 'I never was in South Omaha.1 " 'When did you pass through South Omaha ! ' I asked. " 'I never passed through South Omaha.1 "I then tusked him where ho had bought the lady's gold watch which ho had pawned in the Central loan agency In Kansas City. [ This Is thu watch which has been identified as having boon sold to Neal by Jeweler Ko- bcrt , of South Omaha. ] "Ncal replied. 'I bought that In Denver.1 " 'Where ! ' I asked him. Ho replied.'I don't intend to tell or say any more until I can consult an attorney. ' "I asked him where ho resided , and ho said that tie didn't think It was necessary for that to bo known. "Neal then turned to Sheriff Bowling and asked : ' "Who was murdered ! ' "The sheriff mndo no reply. "Neal then asked , 'Wasn't there somebody murdered ! ' "Tlio sheriff again refused to answer whereupon Nenl said 'Yes , I know tliero was ' 'somebody murdered because I read It in the papers,1 "Neal then asked the sheriff when ho ex pected the Omaha pcoplo to call for him and was told that they would probably arrive that night. Ncal handed the sheriff a note to n Mrs. Wilson in Kansas City , Mo. , In whoso house ho [ Neal ] had roomed , asking for toilet articles winch ho desired to brinpr with him to Omaha , a copy of which I took. " The witness then testified to having visited the I'innoy farm and found bullet holes on the east and west walls of the hen-house , which was located about twcnty-ono paces from thu I'lnnoy cottage. These boarcls tlio thu witness , accompanied by J. J. Muhonoy , superintendent of the county poor farm , had brought to Tun Bun oflloo nnd then turned over to the sheriff. Tlio boards from the east side of the building wcro marked Nos. " 4. " " 5. " " ( I , " respectively , Indicating . the order in which they stood with reference to the north t'nd of the coop. The two boards on the west pidu wcro numbered " 10" and " 11" respec tively , with reference to the same end. The latter were situated at a moro southerly point than those through which tno bullets entered nnd received the latter after they had passed through the east wall. Tlip direction of the holes showed that the shots had been from soni'i point In an oblique line from the house. On cross-examination Mr , Estello asked witness : "You have taken a great Interest In this easel" "I have taken some. " "As n newspaper numl" ' Yes. sir. " "To liiul the perpetrators or the cause of the death of thase old people ! " "You know that Tin : BKE goes outside Ne braska ! " "Yes , sir. " "And you know It goes into many other states beside Nebraska ! " "I presume so , sir. " "And Into Kansas and Missouri ! " "I am not informed as to all the points to which TUB BIB : goes. " Tlio attorney for the defense then sought to liow that TUB BKB exchanged wlthjmpcrs in the leading towns In Missouri and Kansas , which wild admitted. He then took up the boards from the hen house and sought to show that the shots which left their marks on the west wall of that Btructuro were not In a straight line through those on the east side running to the lMnm\v cottage. This was admitted , but ox- iiliilmil that they were In thu same general direction , and the fact that they were fur ther south on the west wall was duo to the dellectlon which resulted when the boards on the tMstTSIdo were , perforated by the bullets. U ho wltneas stated as his opinion that the shots were fired by some party south of the Plunoy eotuiira ua from the direction of 'hat ' cottage. This was attested by the fact that the poInU of exit both on the eai nnd writ hoards wcro further south than th place of entrance , The defense endeavored to ascertain drfl nltcly the date on which the boards had been removed from the shed , for the purpose o raising the presumption that the holes In question could have been made oy others than these who hod committed the murder , Chief of Police Soavoy was the next wit ness. ness.Tho defcnie objected to the chief testifying Inasmuch as ho had been in the court root ) nnd heard some of the testimony. Mr. Mnhonoy Informed the court that Ohio Seavey was out of the room when the orde excluding the witnesses was made. Ho als staled that ho would not ask witness anythini , regarding the matter that had previously bcci testified to. The expression upon the faces of all the at torneys connected with the case plainly ludi eated that they had been surprised. Judge Clarkson finally ruled that wltncs might testify , as suggested by Mr. Mnhonoy anjmy subject which had not previously been touched upon. The witness was simply asked to Identify the white silk municr worn by Neal , which ho did. and was then excused. Mr. Mnhoney then proceeded to have th the spectators carefully looked over by th bailiffs. Two or three witnesses who liai been on the stand were found occupying scats In the audience.1'hcy were specdllj hustled away to the witness room. Bernard Blum , who runs tlio Wisconsin house and a saloon In South Omaha , took th stand. Neal had stopped tit his house , coin Ing there on Monday , February 3. Ncal gave no name. Witness didn't sec him on Tucs day , but did on Wednesday. * Lcroy Jones , a thirteen-year-old grandson of the murdered couple , who lives at IrVlng ton. was called. Handing the lad the old gold ring whlcl Ncal had traded to Mr. Kobcrt , the Soutl Omaha Jeweler. Mr. Mahoney said : "Examine this ring , Lcroy , and state whether you ever saw it before. " Taking the ring , the little follow looked a It closely and long , mid-then replied : "It looks Just cxactlv like iny grand mother's ring just exactly. " Defense mndo no effort to shako the boy's convictions. John Q. Jones , a grown son of the oh couple , who now lives in Fremont county Iowa , came next. Mr. Mahoney handci him the ring and asked him if ho could Identify It. "Yes , sir ; I think that's my mother's ring she had it In her pocket-book when she left my house the last time she visted me. ' Defense declined to question Mr. Jones. Howard F. Shromp of Omaha testified to having seen the ring worn by.old Mrs. Jones while she was visiting him. Ho was asked if he could Identify the ring then produced. "It looks like the same ring , " said witness with great earnestness. Again did defense decline to push inquiries regarding the matter. Neal wiisn't enjoying this testimony con cerning the ring nt all. Ills faeo was a sick ly , yellowish , perfectly bloodless colorand ho was very nervous while it was being given. Ho tried to get some comfort out of sucking an orange , but gave it up after ono or two trials. Nothing could have been plainer. His mind was too deeply occupied for him to do any thing else whatever but hear and think. At this point Mr. Mahoney left the room , suspending proceedings for several minutes. When ho returned ho told the court that ho had been unable to llnd a certain little thing nnd as it was n quarter to 113 o'clock ho asked that the noon adjournment bo taken. Ho added that lie had very little moro testi mony to offer. Mr. Kstellc asked that the court prepare its instructions before hearing the arguments In order that counsel for defense might know what they are. Judge Clnrkson replied that ho would do so , but that of course the Jury was not to bo ap prised of the contents of tlio instructions. Court was then adjourned for the noon recess. In tlio Afternoon. The state called James II. Davis , who said ho was a detective and had lived in Omaha for eighteen years. Ho was locked up with Neal for ten days in the county Jail hero. "What , if anything , did Neal say regarding the calibre of the bullet with which Allen Jones was killed ! " Mr. Ourley sprang to his feet , exclaiming : "Objected to ! Objected to ! " Catching his breath , lie continued very ex citedly : " .Now see here , your honor , I not only ob ject to this witness but I ask permission to question him a little before ho replies to Mr. Mnhonoy's question. " "Proceed , " said the court , "but I overrule your objection. " Never did questions come faster from the lips of a lawj er or answers from a witness. "You say you're a dctcetivot" "Yes sir. " "How long have you been a detective i" "Moro than ten.years. " "Where have you worked at the business ! " To this the witness named n dozen or twenty of the largest cities in the west. "Consider yourself pretty slick ! " "Reasonably so. " "Must be , to earn $10 a day , mustn't you ! " "Oh , I suppose so , " ami the detective smiled at Gurloy's phrases and excitement. "Who employed you ! " "Sheriff Boyd. " "To impersonate a prisoner ! " "I don't know that ho did. " "Did ho ov didn't ho ! " "I don't remember. " "And you went , eh ! " "Yes , sir. " "And was locked up in the cage that Neal occupied ! " ' "Yes , sir. " "How did tlio jailor come to lot you in ! " "Tlio sheriff went with mo , and gave the jailor a paper. " "What was that paper ! " "I don't know. " "Who tooic you up to the solitary ! " "Pat Lynch. " "Neal wasn't in the cell when you were taken up , was ho ! " "No. Neal was brought In about half an hour later. " "What did you go there for ! " "To" hear something about what Neal know of tno Jones murder. " "And you took notes of what Neal said ! " "Yes. sir. " "How much wcro you to got for going there ! " "Ten dollars a day. " "And you wont there as a paid witness ! " "Yes , sir. " "And you distinctly understood that you wcro to give paid testimony at this trial ! " Mahoney sprang upon his feet and ex claimed : "Stop don't answer ! " Then , turning to the court , Mr. Mahoney added : "Your honor , I object to counsel , for de fense putting questions that way it's not proper , and Air. GSurloy knows it ! " Uurloy's eyes snapped llro. Ho sprang upon his feet , and in very vehement tones de clared that ho proposed no paid testimony should go in. Then ho proceeded to lire a volley of questions at the witness , repeating many that ho had previously asked him. Finally thu court called a halt , and repeated thai the objection of defense to witness testi fying was overruled. Gurley subsided and Mr. Mahoney repeated his question : "What , If anything , did Nenl say regarding the caliber of the bullet with which Allen Jones-was killed ! " And witness answered : "Neal told mo it was a 33-callber , from a Colts. " ( ! uiley then asked : "Mr. Davis , how did this conversation about the bullet come around ! " "I can't romemlor. " "That's all , " remarked Gurley. Mahoney then nskcd : "Did you ever do detective work InOmahul" ' * Yc9 , sir. " "Under whom ! " asked Gurloy. "Under Boyd , Just previous to Chaso's term. " The court nskods "Before you had this talk with Neal hod you boon shown the bullet that has been pro duced hero In court ! " "No , sir. " "That's all , " added the judge , Gurloy couldn't resist taking another go at Dotertlvo DavU , and delivered a final brisk spatter of questions which were as briskly answered in monosyllables by witness , Davis was then excused from the stand , but after he hud left the court room Mr. Gurloy requested that ho bo recalled , and ho was , Gurloy asked : "Mr. Davis , you said you wont'ln there on the 3d orIth of March and stayed there about ten duvs ! " "Yes , sir.1 "Now Lm't it u matter of fact that Ncal was In nnd out of the celt several times prior to Ills preliminary examination , while you wcro theroi" "Yes , I guess ho was , " "That's oil , " said Gurloy for the third time. But Mr. Mahoney had another question : "Isn't It n fact that Neal didn't say any thing to you about a bullet being exhibited at the preliminary examinationt" "Neal didn't say anything about any such thtng-nbout n bullet being exhibited at his preliminary. " Davis was now allowed to vacate the stand. Tlio prisoner's face was whiter than over all the time that Detective Davis was on the stand , and his smile , now almost ghastly , came and went like a spectre. Davis was doubtless the greatest surprise of the entire trial to him. Dr. Harrigau was again called for , but could not bo found. N. .T. .Tones was recalled by the state. "Mr. Jones , can you state whether there was a ring on the body of your mother when it was found ! " "I don't think I can state whether there was or not. " Mr. Mnhonoy then offered In evidence the boards brought from the farm by Witness O'Brien nnd the old gold ring. Defense objected , particularly as to the ring. The objection1 } wcro overruled. "With this , " said Mr. Mahoney , "the state rests. " Slowly arising to his feet , Mr. Gurley said , addressing the court : "Your honor , wo did not anticipate that the state was going to close so soon , it having twenty witnesses yet uncalled on Its list. Wo are having some "stenographic notes copied and they are not done , but wo we will have them In time , however. Wo will call Frank E. Moores. " Clerk Moores took the stand nnd Mr. Gur ley asked : "Did Mr. Mahoney file any Information In ! the district court on May ! ) , ISiK ) , charging I Joe Shcllcnborgcr with the iflurdcr of Allen nnd Dorthy Jones ! " Mr. Mahoney objected to this ns hearsay , ' incompetent , immaterial , etc. i The objection was sustained and witness was summarily excused. ] Defense next put Mr. Mnhoney himself on ! the stand to Identify the much discussed I bullet , and ho did so. Mr. Shea , for the state , recalled Mr , Ma honey and asked him If nt the pllmlnary ex amination ho had named the caliber of the bullet In question. Mr. Maiioncy replied that he had not. Then came n quiet little examination of typewritten copies of the testimony by thu attorneys on both sides , counsel for dofcaso striving to get some few answers stricken out , but in all except one Instance thu court overruled such effort. The exccptlo'n was comparatively inconsequential to the state. Judge Clarkson then said that he would have his Instructions to the jury prepared In time for opening court this morning , so that the attorneys might see them before be ginning their arguments , Free. OsmiA , Neb. , May IT. [ To the Editor of Tun BKB. ] Tlio article in yesterday's BII : : under thu caption "No Right to Exist , " smacks of thu misinformation of J" . J. Don nelly. It is true that J. B. Powell , an agent of tlio endowment rank , who is no better informed than thu above named gentleman , has filed a complaint against the Pythian life associa tion , which , for lack of legal grounds , will.be easy to knock out. That the Pythian life as- soclation is not legally organised under the laws of Nebraska , as can bo shown by our ' charter and annual certifii-ato from 'Stato Auditors Babcock and Benton , is as fulso as that J. B. Powell ever had a policy in said association or over applied for one. That this association was not entitled to a charter was argued two years ago before Auditor Babcock - cock , but ho Issued the charter. That the institution's birth was legal is no moro to bo questioned than that of J. J. Donnelly or J. B. Powell. The supreme lodge will no doubt take some action , but it Is n question with that body what to do with the "elephant. " When Brother Powell called a mass meet ing in Omaha , he met his "Waterloo. " Now bo is out in quiet places practising with his pop-gun. The Pythian life association is an Omaha institution , and at its present rate of Increase will soon bo an important one.
