The County Architect Seems to Have Been 1'nlil In Ailvnnoe. County Attorney Mahouoy is preparing an answer to the petition of Architect E. E. Myers Instituting suit against the county for tlio balance of $200 which ho claims to bo duo him on the bill of $300 which ho put in some time ago for his expenses in coining hero from Detroit , March 23 last , to examine the now hospital building. The answer will bo that the balance of $200 will bo held to apply on the § 1,000 , which Mr. Myers' contract with the county provides shall bo held back until the building is com pleted. This turns up anotlipr mistake made by the commissioners. Hight In the face of a dear and verv explicit clause in tlio contract with Myers that ? 1,000 shall bo held back until the completion of the work , the board , has paid 300 of that amount. This $300 wns the premium offered for the plans , but which should have been , according to the adver tisement for the same , deducted from the 4 per ccat compensation given to the success fully competing architect. The chiefs who are generally known to bo connected with the club Indig nantly denied the charge that the Tammany bushwhackers wcro fighting annexation un der cover and would vote solid against it. On the contrary they claimed to bo in favor of annexation and the purification of elections. Their club had tabooed the use of money in politics. Less than half a do en men could bo found among the o who are known to bo Twcnty- eightcrs who would admit that they know anything about such an organization. Jt was flll newt ) to them. No , they wouldn't go near the polls all day long. Annexation , to them , was a matter of supreme Indifference. " Joe Schiller , one of the gang that trains in with the Twenty-eightors , met a reporter and threatened to do somebody violence if the statements made in Tim Bii : : Wednesday concerning him were not re tracted. So fur as ho was concerned , ho says , the statement was purely a fabrication. Following are the facts as gathered by TUB Biu's : South Omaha representative : Tun Bin : reporter ran across Joe Schiller about ! J o'clock in Tom Hock's saloon. Ho wns talking for annexation , but ho was heard to inrpairo for men who the reporter know to bo secretly opposed to annexation. The lat ter became at ouco iiitctested and suspicious of Schiller's mission and followed him down N street. At the corner of Twenty-sixth Schil ler mot Dave Anderson and they stood talking for some minutes. Then Schiller handed Anderson u letter which the latter rend and shoved In his pocket. From that part of the conversa tion overheard by TUB 13ii : : man it was evi dently a request upon Anderson to use Sclill- loras a worker at the polls and to furnish him money , The reporter could not hear all the conversation , but ho heard the remarks : "About 1000. A BKB reporter yesterday took a long , careful and all-over look at the Eleventh street viaduct which the city engineer has rciwrtcd as being in urgent need of repairs. As ono general result of the visit it may safely bo asserted that if any ono of the sev eral hundred owners of horses whoso animals cross and rccross the structure dally had accompanied the reporter ho would give orders to have the viaduct shunned just as much as possible. It docs not require a skilled eye to see that when the flooring was laid , planks wcro used that wcro several Inches too short , and , In deed , that Just barely touched the iron sills upon which they rest. As a result , the con stant Jarring of the viaduct has caused ono end on forty or fifty of these planks to drop off and away from all support , while some two hundred moro arc nearly out and will bo entirely so in a very short tlmo. Tlio paving above thcso lese planks has fallen so as to inako great holes in the road way , nnd It seems simply marvelous that a dozen or twenty horses have not broken their leps on account of these depressions. But this is not the worst thing noticed. Several of the little Iron shelves which sup port the ono center iron beam upon which rests the tip end of the flooring iilnnk , have broken off leaving thcso parts of tno roadway resting simply upon sheer luck moro than anvthlng.clsc. It is noticeable that about everything in connection with the structure of the floor is very seriously disjointed In almost every part cxccptrtho main span and the extreme cuds. The plank portion of the flooring from ono end to the other appears badly rotted. This is evidently duo to the fact that largo quanti ties of dirt are allowed to accumulate and re main on the roadway from ono month's end to another. This dirt holds the water and remains moist a greater portion of the timo. Tlio Iron railings and guards are pulled apart and bent out of place In many parts of tho.structuro. Chairman Balcombo of } he board of public works was asked what ho had to say regarding the charges preferred against him by Sidewalk Inspector Bermlnghain In a communication to the council Wednesday night. The charges are that , out of about three \iuudrcd cross-walks laid in the city , only about seventy-five liavo been laid according to the contract and specifications , which re quire all material used to bo of good quality of while pine , nnd that Mr. Balcombo ordered the contractor to use yellow pine without say ing anything to him ( Bermingliam ) about ft. Mr. Balcombo said : "Neither the sidewalk contractor nor the , sidewalk inspector were ordered to use yel low pine ; but , after Ed. Burns , the contractor , had been placing walks about a niontlrunder the instruction of the sidewalk inspector and using yellow pine for crosswalks , they called at Hiis office and questioned me as to Its uso. During tlio conver sation , I said that yellow pluo must not bo used under any circumstances what ever for.sidcwalks , but that I had no objec tions to its use for crosswalks because I thought it bolter for this special u o than the other , that it was tougher and had moro , flex ibility without brittlcness , and hcnco would last longer under the pressure of heavy loads passing over it daily than the other. "Two or three days after this communica tion , , the sidewalk inspector demanded a writ ten ruling from mo as to this matter , and it was given him , Mr. Bermingliam to the con trary , and is on file in this office.
