A. .1. Patterson is a gentleman of color who
was recently sued in Justice Ilarnott's court
for ? -J by a colored lady named Mrs. Hnek-
uor. llo pleaded the exemption clause of the
law , alleging that , he had a famllv , but it was
ascertained that his funiily Is in North Care
lina , and the justice held that tint law of that
Ktato must govern , and the exemption was
not allowed , Patterson was not .satlslled ,
and brings the case to the superior court on a
writ of error.
Tlio assault and battery ca o against Jmnes
li rooks was called in Squire llantett's court
yesterday afternoon for the fifth time. It had
Veil repeatedly continued nt the request of
the prosecuting witness , one Hrown. The
assault was alleged to have been committed
on election day. AH the parties appeared in
court j csterday and after briefly discussing
the case Hrown stated Mint he had no desire
to prosecute and It was dismissed. The only
msult was the running up of a bill of costs for
the comity to pay.

Will Purchase Union Driving Pni-k.
A deal is on foot that promises tomakoa
material ehmigu In Union driving park. A
syndicate of Omaha gentlemen has been orga-
ni/eil for the purpose of either purchasing it
outright or of purchasing a part interest , the
remainder to bo owned by Council Bluffs
capitalists. Negotiations uicnow In progress ,
and the matter will probably ho settled in a
few days. It is proposed to inakcsuch changes
as will put the pant on a paying basis.
This is something thai has never yet been
done , and the park has thus far proved any
thing but a paying investment for the stock
holders. It is stated that Mio Omaha track is
not what it should be , and as the track at
Union park is recogniml as one of the best in
the country it is argued that there is no rea
son why it should not pay. It is proposed to
make it essentially a twin city park and give
such attractions as will bo certain to draw
a liberal patronngo from Omaha as well as
from the Bluffs.
The projectors of the now scheme argue
that this can bo done and they nro willing to
expend several thousand dollars if necessary
to demonstrate that Union park , if properly
managed , would bo a bonanza instead of a
sinking fund for the stockholders. The horse
men of this section will be glad to seethe ex
periment tried and will do all in their power
to make it a success.

Yesterday was the day set for hearing the
arguments "in the now celebrated motor pass
injunction suit , but owing to the rush of other
business it was not reached and will not bo
for three or four days.
The only now move yesterday was the tiling
by the plaintiff of u supplement to the amend
ment to his original petition , which was filed
several days ago.
The supplement among other things alleges
Unit of the defendants Stewart owns 1.-.M )
shares of stock ; Wright , 7.10 sharesoBarton ; ,
7.MI.shares ; Mlllard , 7f > 0 shares ; Wells , "fitl
shares ; some unknown paitners of Wells ,
itflo shares : Fred L. Ames , 2,000 shares ; Sid
ney Dillon , 7."iO shares ; and Miese , with Mio
shares owned by the plaintiff , are all the stock
issued by the bridge mid motor company.
The plaintiff alleges that when it comes tea
a vote of the directors of the company the
stock owned oy the partners of Wells Is con
trolled by him , Milhird handles not only his
own stock , but also that of Dillon
mid Ames , and by reason of these
facts Steu'iirl , Barton Milhird and
Wells control a maturity of all the stock of

of morphine. Two grains of this drug
will cause many intense itching sensa
tions , with parched tongue and throat.
On the other hand , i have known pa
tients , even tlio o unused to morphine ,
to take much larger doses without show
ing any evil effects. Thorn is a litllo
doubt bul there nro quinine habitues as
well as slaves to chloral , morphine and
other narcotics and drugs , yol its use as
a stimulant has not become general ,
