MASTI2KMAN , The Ongo Comes Up For Hcnrlng in .Justice WndoV ) Court. The case of the state vs. Albert Master- man camoAip for hearing In Justice Wado's court tills afternoon. The first witness called wasT. G. Mngulre , who owned the saloon nt which the shooting took place , on No Man's land , on September 8. Ills testimony developed nothing oxcont what was rotated In thnso columns nt the time. Mailorman had been knocked down in the afternoon whllo trying lo preserve order. Magulro carried him Into the saloon and told him to stay thoro. Some time after ward ho heard shots outside and looked out of the door. Ho saw the flash of a pistol nnd Immediately closed the door nnd went out the back door. Ho saw Mnstorman sitting down , surrounded by the crowd who were striking ami kicking him. Ho did not sco any ono shot. The next witness was Jacob Vandorsloot , ono of the men who wiw shot. He acknowl edged that ho was roaring drunk nud did not romombur anything except that ho wai shot in the loft breast above the nlpplo. Ho thought ho was about six or eight feet from Mastcrman when ho was shot. Did not know who shot him. Did not remember using any strong language , or saying any thing at all lo Mastcrnuin. Acknowledged having hiu ) trouble with Mnstorinan the jirovlous Sunday. Mastormnn was put on the stand noxt. Ho test I lied that ho had ordered Vandorsloot off tlio dance platform on account of his using obscene language and trying to run every thing. They refused to go and threatened to do him up. About dusk Vandorsloot catno over to Magulro's from another saloon nnd as soon as ho saw Mastorman ho called his crowd and said they were going to do him up. 'ihey attacked him nnd ho retal iated by shooting. Ho shot ilrst at Vandcr- sleet , but did not know who ho shot nt after wards. After the second shot ho was knocked down nnd tired throe shots whllo on his back on the ground. A SCHKMB TO OI3PI3AT JUSTICE. How Two Yotine Men Proposed to 1'rove Their Innocence. On Saturday night two young men named William F. Faulkner and F. T. Lacey en gaged In a fight in which the former had his Up badly cut open while the latter received injuries that will necessitate the hand paint ing of an oye. They wore arrested and taken to the police station and confined In the same cell. Whllo there they concluded that It was best tp fix up matters and escape the payment of a flno so they shook hands across the bloody chasm of their recent un pleasantness and swore eternal foalty. Lacey has a couple of sisters who llvo at Sixteenth and Leavouwoi'th who saw the row and the boys thought that they would make Rood witnesses. So they wrote the following letter : "May and Addio como down at 2 o'clock. My trial is set for that time and I think I will get free. Bring some money down in casa I don't. A fellow will pay it back to-night. Ho is working nnd can't get off. Toll May if she is brought , upon the witness stand to say wo wasn't lighting. The young fellow that I fought with Is all right. Ho and I are friends. Ho will swear that I , , did not hit him and so do you. F. E. LAOIY. " But the letter was not delivered for the police intercepted it and although the girls were present they could not testify. Faulk ner was lined 515 and costs and Lacey $3 and costs.
