charged with disturbing the peace by uslne
loud and profane language , was called in
police court yesterday afternoon and con
tinued until next Wednesday. Ciowoll's
offense was In loudly calling to one oQlcer to
protect him troin an assault lhat was being
made by another , at the meeting of the po
lice commissioners. The olllcer who made
the assault still wears his star.
Paving Estltnntrfl.
The finance committee of the council has
boon put to considerable trouble oy the re
ports of the bo.ird of public works on the es
timates In favor of the paving contractors.
The amounts are paid out of two funds , the
Intersections out of general paving bond fund
and the bal unco out of the district paving
fund. It has boon the custom of the board to
submit the total of these estimates \vithout
specifying the funds from which they are to
bo paid.

The Union Pacific Yellowstone park excur
sion which loft Omaha two weeks ago , ar
rived in Salt .Lake City at 10 o'clock yester
day morning. A telegram from Clarence
Brown , manager of the advertising depart
ment of the Union Pacific , who has the ex
cursion in charge , states that tlio party are
all in the best of health and spirits , and are
having a grand tlmo. Tne weather during
the visit to the park was olcgant. The party
will return to Oiunlm on Wednesday next.

made their escape by digging a hole through
a brick wall.

Major Bnloombo nnd Fred W. Gray
Clnflh" Again.
The meeting of the board of public 'works
yesterday was varied by u spirited vor-
bnl contest between Mr. Fred W. Gray and
Chairman Ualcombo. Mr. Qrny appeared before -
fore the board to nsk why no many of * the red
colored cellar blocks furnished by htm for
paving purposes wore rejected. Chairman
Ualcombc , who was evidently very agitated ,
said that it wan not the color of the clocks
ttint caused them to bo rejected , but their
Inferior qualities. Ho said further that the
city of Omaha bad contracted for bright ,
fresh and sound blocks. When
the board went to the yards
to see the timber they were shown
bright , sound poles , but when it came to the
delivery a lot of cheap Job lots nnd odd lots
of inferior quality are furnished , nnd an at
tempt made to force them on the city. This
ho iclteratcd a number of times ,
Mr. Grnv rctcrtcd that Major Halcombo
was theorizing and drawing on his Imagina
tion , nnd was prejudiced against Mr. Gray to
begin with.
Major Ualcombo replied that they would not
have such blocks , pointing to n worn-eaten
block which was the cause of the former
trouble between him and Gray.
Mr. Gray replied that that kind of n block
was not now under discussion , nnd Intimated
that ho wouldn't give much for Major
iJalcombo's Judgment of any kind of n block.
Uoth men then oceanic very excited nnd con
siderably earnest , and for a while it looked
as though a fight was imminent.
Mnjor Hnlcombo paced up and down the
room , with his hands under his coat tall ,
which ho kept "Hipping" In n tantalizing
way , as though ha was inviting Mr. Gray to
"tread on the tall of mo coat. " Thu other
two members of the board endeavored to re
store pcaco and harmony between the two
belligerents. The matter was finally patched
up by olTcrliigthofollowingrcsolutton , which
was adopted on motion of Mr. KIcrstead :

A Runaway Accident.
While A. G. Collins , of the city water-
wotks company , was driving along Cumin ?
street about 9 o'clock yestcrnay morning , a
whiniotree on the buggy broke , scaring the
horse Into a run. The buggy tipped , and Mr.
Collins , soelngthat it was going over , throw
down the lines and jumped. Ho foil
on the pavement with considerable force , se
verely but not seriously bruising his leg
from hip to ankle. Ho was brougnt down
town to Ills ofllco nnd attended by Dr. Sum
mers Jr. , who louml no bones broken and
thought ho would soon recover. The .horse
was caught after a short run.

The origin of the flro is a mystery , as the
house was unoccupied , Mrs , Hopkins being
absent from the city , and Mr. Hopkins stop
ping with u friend in the neighborhood , The
house was handsomely furnished , und all of
the furniture was destroyed at a loss of
$3COO. The damage to the house will am ount
to $1,000. The loss is but pattially colored
by Insurance. _

wrangle that lasted through the session of
the police court , bonds were made out bind
ing the whole party to keep the peace.

The news of u racy flirtation , Implicating
D. W. Kyle , who formerly worked in the
Western Union olllco hero , reached tnls city
yesterday from Laramio. The story Is that
Kyle , now stationed at Rod Uuttos , Wyo. ,
had Mr. and Mrs. Booth , parents of his inam
orata , arrested last week for assault and
battery , us n result of his acquaintance with
their daughter , und this is the way it all
came about.
While traveling on a freight train before goIng -
Ing to Red Buttes , Kyle mot Birdie Booth in
the caboose. She was lying down and while
quenching nls thirst at the water cooler she
spoke to him. This was sufllcicnt oncour- '
agcmcnt for the young man to sit down be
side her , whereupon she not only inaugu
rated a huuglng match but indulged in the
thrilling pleasure of kissing him a few
times. With an acquaintance and affection
thus established the couple felt very happy.
Subsequently Birdie wrote Mr. Kyle sev
eral letters and proposed that they go out on
a hunting expedition together. Ho finally
answered her , agreeing to the proposition ,
nnd s.iylng that ho would show her that an
Omaha man was equal to the emergency.
When Mr. Booth saw this letter his eyes dis
tended and ho armed himself and sallied
forth. Ho bearded the young man In his den
at Red Buttes , but the latter took ref ui > o In
his sleeping apartments and after a respect
able length of time issued forth with a Win
chester and routed the opposition com
pletely.
Next day Mrs. Booth and herson appeared
at lied Buttes station armed with bluck-
snakns , und the old lady calmly Informed
Kyle that she would show him what Rocky
mountain lifo was. Ho was too quick , how
ever , to permit any damuco being uono hy
her , though the son succeeded In getting in
some pretty good licks , and It was only after
a lively scene that Kyle ousted the attacking
parties.

Frank Murphy , the president of the Con-
solIOatcd company , was seen and asked con
cerning tlio projected lines of his company.
Ho said positively that it was the Intention
of the corporation to build all three of these
lines und to do so as soon as possible. When
the rumor of the consolidation of the Benson
motor with his line was mentioned ho fol
lowed the example of Mr. Benson by saying
ho had heard nothing of it. In re
gard to the laying of track lines on
Lowe and Military avenues , Air. Murphy
said that ho believed his company could se
cure a permit for so doing , as ho believed
there was no limit to the number of tracks
to bo laid on any street , citing Twentieth
street as an example.
OMajor Bulcoinbo , of the board of public
works , says , however , that there Is a limit to
the number of car trades to bo laid on n
street and that it is the intention of the
board hereafter to have only two tracks hud
on any street , und to avoid , If possible , the
monopolizing of streets by street railway
companies in such a manner as Twentieth
street has been gobbled up. In case
two companies wUh tno same
street and each is willing to
lay but ono track , a permit will bo issued to
each , but under nu ether circumstances.
It Is rumored that Assistant Supctlntcnd-
ent Todhuntcr. of the electric motor com
pany , will again enter the service of the
consolidated street railway company. The
reason of his resigning his position with Dr.
Mercer's ' company is that ho was not given
the position of superintendent as he was
promised , but was made assistant superin
tendent Instead. _
