The probabilities are , however , that ho has a Bflfo "plant" some where nnd at the expiration of his servitude In the stuto prison ho will emerge to enjoy the fruits of his colossal rascality. Tlio de fendants sued conjointly with Simpson , were the sureties on his odlcial bond. Ho is charged in this case with having In tentionally neglected to cancel three war rants issued at the instance of the county commissioners , two for $1,000 each , and ono for $ SOO , On tholr redemption , but in lieu of this proper procedure , marked on them "Pre sented , and not paid forwitnt of funds. " Thus they appeared to bo still unpaid nnd valid obligations of Otoo county , nnd to bear interest at the rate of 7 per cent per annum. Subsequently Simpson disposed of the war rants tor valuable consuloratln , and upon their presentation for payment the sccord time by the parties who had purchased them of the dishonest treasurer , the fraud was discov ered. Suit was brought against the county for payment of the warrants , and it natur ally enough resulted In favor of the defen dant , as It was clearly proven that the orig inal holders of the same had been oacc paid by the treasurer. Suit was then entered against Simpson himself , and sustained , but ho never paid the indebtedness , and was fin ally landed In the penitentiary for embezzle- inont. Now the plaintiff brings suit against Simpson nnd his sureties , District Court. Clerk Moo.ros is busily at work on tlio docket for next term , which begins the llth.
