The preliminary hearing of W. P. Talbott 'or forgery was hold beioro Judge Ayles- worth yesterday afternoon. Colonel Daily conducted the prosecution and Mr. Wharton , of Holmes & Wharton , of Omaha , appeared 'or the defendant. Three witnesses were examined in behalf of the state , C. P. Bent- oy , bookkeeper for D. C. Dunbar & Co. , Marshall Gunnolla and S. P. Sargent , of Sargent & Evans. It seems that Talbott en tered the employ of Dunbnr & Co. about the first of March nnd was engaged in canvass ing this city for a new directory. Ho be came short of funds and issued n check of * 10 on the firm for which ho was nt work. He passed it at the Sargent & Evans' shoo store in payment for a pair of shoos for his wife nnd received the change. The check was drawn on the Omaha National bank , nnd was protested when presented for payment. The prisoner's counsel asked the court to llx the bail for his client's appearance before the district court at a low enough figure so that it would not necessitate keeping the de fendant locked up in Jail for the next three months. Colonel Daily suggested that the bond bo fixed at $1,000 , but after n llttlo dis cussion the court placed it at 8600. The prisoner was taken back to the county jail but an effort will bo made by his wife und friends to obtain the necessary amount. Mr. Dunbar la making arrangements for a careful ro-canvass of the city so that the directory will not bo in any way impaired by any noglccton Talbott's part. Ho proposes having the now directory accurate and com' pletc , and in view of the revelation of Tal bott's career l/ro ) , will not depend upon the data gathered by him. Tlio Hoard Still Ijooked. The school board met last evening. Bui one member , Mr. Rain , was absent , and con sequcntly no attempt was made to break th < dead-lock In regard to the plans for the $10,000 building. Architect Maxon has al tcrcd the plans originally presented by hlu in competition , and has also presented a nov plan , so that there are arc now three plans ir by him. It remains for the board to deter inIno whether competitors , after the plane orb presented in accordance- with advcrtisci request , can go on changing their plans am filing now ones. Another meeting Is to b < held this evening , nnd if a full board ia pros cut some action will probably bo taken. At the meeting last night the action of Presl dent Atkins in stopping work on High Schoo avenue was approved. The cutting down ol that street was deemed by the board danger ous to the Hill sctiool building , and it was dc elded to have the board confer with the citj council iu regard to it. . Robbed Wliilo Drunk. Jeff Green had n hearing before Judgi Aylesworth yesterday afternoon for the lar ceny of some money from "Slim Jim" Kings ley , The evidence showed that the pros cuting witness was very drunk at the time o the alleged robbery , and was unable to gh'i any account of the affair. The court con sidcrcd this evidence rather light , but though that three months in Jail would not hurt tli defendant , and bound him over to the gram Jury In the sum of (300. Kmgsloy promise. . to kcnp sober until the meeting of the gram Jury , und the Judge allowed him to go on hi own recognizance , but instructed the mar shnl to lock him up If ho found him incllnci to break his promise. Iolnts oftlio Court. In the district court yesterday there wa little to bo done. The case which was t have been tried , und which It was expcctc- would occupy the whole dayt was reported t bo in process of settlement , and as Judg Carson remarked , "It Is always better to set tie than to try a case. " The bottom fullin out of the day's asslgnmont , there was not * Jug else to do , beyond a few motions , and a early adjournment was had until this morr inc. Judge GUI so a is | irc ! dlug hero now in c > change with Judge Dccmer , who is at Avoca , presiding at the trfal of the caeo of Benjamin v Coffman , This suit occupied on. n prev ious trial eight or ten day * , and resulted In n dlsamwpcnt pftho Jury. By this suit Xrrc- ju6ntBeniamln seeks to recover from Arch Coffmnn $2r > 00 ns attorney fees. The claim is based on Benjamin's service rendered , ait the ( ime that CoTTman was first nrrfistcd for the killing of Main. Coffnmn. Piping off the Park. During the past winter the water pipes in Jayless park burst In many places and to inch an extent was the damage done that a : omplctc overhauling was necessary. The vork of repairing has been In progress dur- ng the past two days atid several moro days vill bo required to complete It. H would com that this Is the golden opportunity tor urthcr beautifying this popular resort , or rather protecting the beauty it already pos- , csscs. During all seasons of the year , per- ions desiring to cross from Miller avenue to .ho Baptist church corner , save steps and ime by going directly across the park. The csultisthat the green sward Is cut up by vnlks running In all directions. It would com to bo good judgment and economy on he part of the park commissioners If they vould have sufllcleut walks put down to pro- cct this property from spoliation. This is me of the most beautiful of the many nt- rnctive spots in the city nnd any reasonable xpenditure to protect It will bo gladly sane- 'oncd by the people at large. The Strikers Still Out. Butts , the well known fruit man , returned yesterday from California , where 10 has been looking after the trade. He Is very enthusiastic over the season's outlook. Ho considers California the great national fruit farm , nnd knows from experience that his Is one of the best points for the sale nnd distribution of a large portion of the fruit there raised. Ho has arranged for u largely increased trade this year , for ho has prac tically an unlimited supply from which to draw. Matters of transportation are being arranged so as to give greater advantages in in the handling of this fruit , and a larger territory will bo supplied from hero than over before , nndnioro satisfactorily supplied. Mr. Butts is energetic as well as thoroughly experienced , nnd being the agent for the fruit union , he is In condition to handle the trade to the best possible advantage. The New Police Force. Thp resignations of the members of the police force came in thick nnd fast yesterday , n accordance with the expressed wish of the mayor. The head ofllcial of the city yester day informed a BEE reporter that it would probably bo some time before ho would make appointments to fill vacancies. In regard to what these appointments would bo ho de clined to talk , giving as a reason his desire that the present force should continue ef ficient , whereas if they were sure of being "left" when the new force was appointed it would tend to make them careless. Ho said that as yet no ono has any intimation of the result of his appointments , cither members of the old force or appointees themselves. Ho predicts a surprise party for many of the "knowing ones" that will provo a complete ono. SOUTH OMAHA NEWS. A. New Enterprise Spoiled. Alex Winters came west to grow up with the country , and ho was growing a little too fast , yesterday he was languishing in the city jail , in order to give the country a clianco to catch un. His first venture was running a lifbh counter in Bohncr's saloon , and when they gave him notice to quit ho sol'da half interest in the notice for $200. Of course ho told his purchaser ( who was a German school master named John Busch ) that ho conld stay there as long as ho liked but when the two of them were bounced the day after the sale , ho advised him to go somewhere- else , ns he couldn't earn n living at washing dishes. BuHCh did not go , und Winters then swore out a warrant charging nim with steal ing $00 , but the charge was not proved nnd Busch regained his liberty. Ho in turn swore out a warrant against Winters for fraud , and Alex was run in. Ho first got Charles Singer to go on his bonu , but within nn hour that gentleman heard something that made him withdraw , and his pluco was taken by James Hayes. Within two hours Hayes asked to bo excused , and at midnight Justice Levy and Rosalie Levy went on the bond. This let Winters out for a time , but ho in cautiously announced that it was his inten tion to skip the town before daylight and was overheard by a creditor , who at once presented a bill for 130. Ho was told to em igrate to a much warmer climate , and for satisfaction awoke Judge Reuthcr and told him that a prisoner was about to escape from Justice. Winters was found with attor ney Lane and his bondsman , nnd after some legal quibbles , was again arrestod. If the charge , is proved , it means penitentiary. His hail was raised to f 10,000 , und ho hasn't raised it yet. Tlioso Saloons. * Now that the council have met and had a quiet talk on the subject , it may bo ns well to tell the saloon msn what is going to hap pen to them. Tnoy will bo allowed a license at the old (500 rate , and the first payment will bo $125. At the same time they will bo duly notified that the next payment will be | 375 , for they will bo called upon to pay the balance of the year's license In ono payment , just as the BUB said they would. They won't bo charged any occupation tax , although it was suggested that they should put up another (100 , but they will be expected to close sharp at 12 o'clock , and in some other ways live uj to the Slocumb law. Their petition will bo carefully examined , and their bondsmen musl bo gilt-edged , but oiherwiso things will run as before. A Mammoth Establishment. The management of the stock yard com pany Is still alive to the importance of mak ing South Omaha the packing center of the west , nnd at their last meeting voted a $30,000 bonus to the Armour-Cudahy com pany. DUNN WANTED A PASS. For some time past the Union Pacific offi cials have been trying to detect a couple of pass fiends who in their anxiety to work the road for free transportation went so far as to commit forgery , nnd their efforts have been successful , although the would-be dead heads escaped. The forger gave his numo ns John Dunn , assistant to General Manager Jeffrey , of the Illinois Central , and wrote Mr. Kimball on March 27 , signing himself as above stated. The letter stated that the writer was contemplating n trip to Munitoti Springs , and would call upon Mr. Keller , the general ngcnt , for Mr. Kunball's reply. The request was for a puss for Caleb Dunn to Kansas City from Denver , nnd ono for Will iam Jeffrey from Denver to Omaha. Mr. Kimball was too old a bird to be caught by any chuff , nnd at once telegraphed Mr. Dunn , of the Illinois Central , und at once received a reply " ! nave sent no such letter. " Subse quent developments showed the entire affair to bo a put-up Job , and it is not the only ono the party is engaged in , as Mr. Choot , super intendent of the Union Pacific at Denver , states that without dnubt ho has worked the Chicago , Burlington & Qumoy nnd other roads for passes.
