S A RELAPSE AND COLLAPSE , Isaac Well's Bankrupt Store Made So in Fact. ' A FATAL RAILWAY ACCIDENT. Hani Andornoii KlllrdYlilloTrying to Itoard un KtiRlnc SlenlliiB Hnnd Cupld'H Capture * A Fire man lli.-tni'inlicrcd. Tim Well Failure. Yesterday morning the "Bankrupt stock" ' of clothing , etc. , nt No. 5Kl ( Broadway was taken possession of by the sheriff nnd the doors closed. On inquiry the following facts were devel oped : For thirty-one years past Isaac Weil had conducted an immense retail clothing business , having houses nt St. Joseph and Kansas City , Mo. About a year ago ho was forced by the tide of adversity to make an assignment. The failure was for $429,000. Ho settled with his local ei editors at 70 cents , nnd with his outside creditors at 40 cents on the dollar. In order to continue busi ness and realize as much as possible from his assets he s-ecured backers to his paper in the persons of J. and N. Lorlie. lie was to make his payments in four installments. The fif-l ono of $ -10,000 was paid last August. The second ono is not yet due , but find ing it impossible to meet these pay ments when duo , ho made a full assign ment on Tuesday. Soon after the first break n portion of the St. Joe stock was shipped hero and another lot to Clay Center , Kan. These , stores were conducted by HHIS of Mr. Weil , Benjamin F. being assigned to the Council BlulTs store. Mr. Weil ban attempted to bridge over his present dilllculties by instituting small commercial loans. One was made by Ollieortfc Pusey a short time ago to the amount of $2,000 , another was made by Benjamin F. Weil for $1,808. When these loans wore made it was expressly stipulated that in case of difficulty these parties should bo amply protected , and as security chattel mortgages were given un the stock hero. Tuesday evening last Olllcer & Pusey were notified by Weil of the impending crash , and yes terday morning at 8 o'clock the mort gage of Benjamin F. Weil was filed for foreclosure , and ten minutes later Olll cer ft Pusey followed. The first was made subject to the latter and the stock- was taken possession of on Olllcer & Puijoy's mortgage. Within a short time the claims of other creditors appeared. Seligmnn , May iV Co. , of New York. $1,000. and Morris. Newburger & Co. . of Philadelphia. $4 , < X)0. ) These claSms.wSth many other which are expected to ap pear , are .against the original.stock/and were covered bv the first settlement. Everything the Weil's possess is being taken by their creditors to satisfy their claims. Jt is a significant fact that for years not a single failure has occurred among the merchants who have been in busi ness long enough to establish them selves and become identified with the business and interests of the city. There have been several failures , it 'i.s true , but they have been , without an exception , similar to this of Weil. Be coming embarasbod elsewhere , and find ing moving a necessity , they have como hero. Another loud-speaking fact is that these persons , like Weil , have gen erally done well on their local business and made some money , and had they not been cmbarasscu before coming here failure would not have followed. Council Bluffs has a good , reliable pur chasing public. This is the testimony of the merchants. No important line of business is overdone , which is evidenced by general prosperity in all departments of trade. This city is willing to father its own reputation and in all points of advantage compare with the world. * For best quality coal and wood , call on Gleabon , 20 Pearl street. Wadsworth , Etnyrc &Co. loan money Under the "Wheels. A sad accident occurred about 7 o'clock yesterday morning at the Chicago cage & Northwestern crossing on Fifth avenue by which Samuel A. Anderson lost his life. Just how it happened no ono knows , but it is supposed that he attempted to stop upon the front of the switch engine and ride down to his work as ho was in the habit of doing , and slipped on the icy tics. The body was discovered by a brother-in-law of the deceased shortly after the accident , and was removed to the undertaking rooms of Morgan , Keller & Co. The engine carried the unfortunate man over ono hundred feet , and the wheels passed directly over him , completely cutting him in two. The fireman was oiling the valveat the time , and the victim was on his side of the track. The coroner's jury returned a verdict of ' accidental death'but did not attach any blame to the railroad company or em ployes. The jury consisted of S. B. Heft , II. Hortnmn andW. L. Walker. The deceased leaves a wifa-atid three children , ono of whom is adopted , being the daughter of John Sandusky , who was killed by the cars about two years ago. The family reside at 1108 Avenue B , but are not loft without support , as the deceased was insured for $1,000 in a New York company , and they will also receive a benefit from the Switchmen's and Masonic Aid associations , to both of which ho belonged. A brother , J. Q. Anderson , arrived last night from Oska- lousa , where ho is agent of the narrow gauge. A telegram was received from thu father of the deceased , stating that ho would arrive to-day from Pella , la. The deceased was forty-two years of ago , and has long been a faithful and trusted employe of the Chicago ic Northwestern company , nnd had charge of all the pas senger switching. He was a sober , in dustrious citizen , and his loss will bo felt among a largo circle of sincere friends. The funeral will take place at 2 o'clock to-morrow afternoon , and will bo attended by Excelsior Lodge , No. 250 , A. F. & A. M. , and the local branch of the Switchmen's association. There were many others , but space forbids par ticular mention. Both bride and groom are well known to the readers of the BKI : , having re sided here during the mostof their lives. It is currently reported that certain teamsters at work on lower Broadway are taking sand from the levee , and cither selling or using it themselves. It is to bo presumed that those who have bought snnd from these men were not aware that they were laying themselves liable to prosecution by so doing , but such is the fact. It is hardly possible that the men who are drawing it away do not know that they are committing theft and arc as liable to legal prosecu tion on such a charge as though they tpoK another thing that was not as pub lic as this , but it is so. The city author ities should take such action as will sc euro them against this sort of petty thieving. In this appropiation of wind , a double wrong is done , as the levee is liable to be weakened. The levee is an important protection to a largo portion of the city. J. W. nnd E. L. Squire lend money. For an elegant birthday gift or Christ mas present , a Domestic sewing machine leads them all. A Short Stop Train. Parties wishing to come from Omaha to the BlulTs on the 0:10 : dummy are very liable to make an annoying mis take. The regular Union Pacific train pulls into the depot just before the dummy train from South Omaha ar rives , and many passengers for Council BlulTs scramble aboard. They are in a happy frame of mind until they arrive tit the trnnsfcr , where the train stops , and the o who wish to come to the Broadway depot have to wait for the dummy train , and then pay mi addi tional 10 cents. Several Blufliles have been caught in this way , and their feel ings wore considerable hurt at being compelled to pay the extra amount. They indulge in a vigorous "kick" and then enlarge on the great benefits that will accrue to this city from the now bridge now in course of construction. You Want Them.
