Arguments were made yesterday before

Wallen. The case in one of long standing in
the court nnil mnny of the acts in tlio drama
were on tlio boards several yearn before suits
were Instituted In this court. J. W. Wallen ,
tliu defendant , is a tintlvu of Sweden , who
cuitio to this country and located near Abl-

liis wife , who is a number of years bis senior.
On account of certain indiscretions , be had
married her. although , as the evidence shows ,
ho cared not hint ; for her but was deeply in
love with another and younger women. After
coming to Kansas they aceumulated n con-
nidcr.ibU' property. Then , as the plaintiff
claims , Wallen tiring of his wifo. converted
bis property into cash preparatory to leaving.
The wife , leaining of bis movement * , ap
plied at once for a divorce and alimony and
had as her attorney J.V. . Piwco , plaintiff in
the present action. A divorce was granted
her together with u Judgmiint for $ IIWH ) as
alimony. Wnllon , however , hud thocash and
with it he departed on a tour
of two continents. He. visited C'anada ,
many eastern cities , then crossed the 0101111 ,
was at Hamburg , Amsterdam , Copenhagen
and other places , where , as the defense
claims , he .spent his money lavishly. Ho
ended his trip at bis former homo in Sweden ,
and falling love with a girl the two skirted
fur Ann HIM , coming direct to Lincoln and a
short time afterward were married In

invested in some city lots thai , in the last

returned to Sweden , where she died , and her

Previous to her death , however , .she1 assumed
ono half of her Judgment for alimony to the
attoiney , and be , learning that Wallcn w.is
again married and a resident of this country
ami possessed of property in this city ,
brought suit to recover the judgement ren
dered years ugo in Kansas. The pluintilTs
claim Unit the in-esent property In Lincoln
was bought with Wallen's money ; that ho
did not spend all the cash be took from Kan-
Mis mi his long tour as lie claims , but that he
brought back enough to this country for tlio
Lincoln investment , and that consequently
the property is subject to a
Hen for the old judgment. To substantiate
tills the plmntllY claims that Wallen'.s second
wife was of a pool-family and without means ,
and that the Lincoln investment could not
have been made with money of her own. As
an offset to tins , the defendant maintains
that the present Mrs. Wullen , just prior to
coming to this country , was npproached by a
man in Sweden who said ho was her father ,
that the people she had lived with were nether
her parents , and that ho then piesented la-t
wit h a considerable sum of money out of
which the Lincoln purchase was made upon
arrival hero.

This morning is the time set by the court
for the trial of Henry Heers for the murder
of Augusta Seifert. The attorneys for the de
fense have made strenuous efforts to get the
case continued , but have not suci coded , and
It is probnblo that it will be heard to-day. It
was about two months ago that Hcorsand the
young lady be murdered were walking to
gether on the railroad track in the western
suburbs of the city when Heers suddenly
drew u revolver and shot her. blio
died almost instantly. A number of
lailroad men , near at hand ,
whn witnessed tlio murder captured I leer *
after a hard light. Heers expressed the ut
most indifference over the affair , said he
wanted to hang and expected hanginj' as a
consequence of his crime. Heers is from a
border province of Germany adjoining Aus
tria. He. bad been in this country a couple of
J. . ears living with the family of the girl be
murdered. As a rule he has liuen of a quiet
disposition and industrious. It is generally
understood that the attorneys assigned by
Ilin court forthodefeiiseof Heers arc Messrs.
Stiode and Lansing and that their delenso
will be that Heers is insane. It is said that
they will try to prove that Heers comes of a
family allllcted with insanity.

cent census has not as yet been sent to the
governor. Tills fact was not discovered un
til hist night. The papers will be forwarded
to-day.
The prospectus of the Hoof end Horn , the
new stocd paper which will soon bo issued ,
concludes with the statement that the ) inH-
lishers have planted their hoofs In South
Omaha , mean to get their hums In the stock
yards and hook out a living.
C I'ollceman John Sexton was yesterday
sUKjH'iided for thirty days for being guilty of
conduct unbecoming an ofHcer and a gentle
man. His offense consisted in permitting re
spectable cituens to bo assaulted and abused
on election day without any Interference.
Mr. N' . Nagomgast , the Union Paeillc
agent at South Omaha , has resigned , and
will bo succeeded by 1) . Mahoney , who for
merly ( Hied the position. The change takes
place December 1. Mr. Nagomgast. has not
settled on any definite action for the future
as yet.

A meeting of the city council was hold Mon
day night and the following was the busi
ness transacted : An ordinance regulating
the laying of sewer , gas and water mains
was ordered drafted. W. II. Muiiii was
granted a liquor license. The city marshal
was Instructed to see that all obstructions in
the streets were removed at once. The re
port of the police Judge was received and re
ferred to the finance committge. Council
man Smith and city Engineer Theinbart
weie instructed to confer with the South
Omaha Land companv regarding the vaca
tion of the county road within the eor ) > onito
limits. Several minor matteis were at
tended to after which the council adjourned.

Oswald Miller , the well-known brewer of
Fremont , with John V. Ilanitnan of the same
place , was in town yesterday making ar
rangements for the grand opening of the new
turn-hallo of that place , which is to take
place on the second of next month. JIo
called upon the olllcers and several members
of the Omaha tu rnverein and ascertained from
them that a number of their members would
be pleased to attend the opening and give a
gymnastic exhibition. Among those who
will go , is Henry Kummerow , whose gym
nastic work will be admired by every mem
ber of the Fremont verein. The latter now
comprises eighty members and the establish
ment of a new ball , costing $11,000 , is an evi
dence of their slice -ss.
A Five Mlle Uleyelo Uuce.
Kd Hothery and Ed Washburn signed ar
ticles of agreement yesterday for a bi
cycle race. The stakes are f 100 a side. The
race will come off at tlio fair grounds ono
week from next Saturday. It will bo a live
mile race , the winner to take the money and
the gross gate receipts. Considerable inter
est is manifested in the event as both men
are excellent wheelmen. Kaeh man is to
ride a M-ineh t'hampion. They will go iuto
tiaining at once.

Market company were tiled with the county
clerk yesterday. The general nature of the
business to ho transacted is to buy and lease
ground in Omaha and build and tit up market
houses , market places and market stalls and

called for by the board of directors. The

cessor was Mrs. Hudd. Mrs. S. H. H. Clark
was for six years head of the school , and hoi *

Callowny's resignation Mrs. Jardino has been
acting as superintendent' but she feels that
her tkirteen yours of very actlvo work
entitles her now to a respite , mid would bo
glad to heo u younger woman one more active
could not bo found at the head of the school.
Surely in this city there is ono competent
ludy who would be willing to take the duties
of this ofllco. Mrs , .lardine has been either
superintendent or assistant since the organ- !
/iitiim of the school , and during that time has
devoted the best of her time and cncrpy to
Us interests. She knows that the school has
hail a moulding intlucnce on many girls liv
ing in parts of the city nnd in homes where
the worst influences prevail. Hy contact
with Christian ladies the girls learn to imi
tate their lives.
On next Thanksgiving day , at 5 p. m. , oe-
curs the anniversary dinner of the school ,
and the managers earnestly request that all
persons having provisions to spare from
their own Thanksgiving feast will "remem
ber tlio poor , " nnd send them for the child
ren's dinner. The ladies have heretrtforo de
pended on voluntary contributions from tlio
citizens for this feast , and they trust that
"neither this year shall seed time and har
vest fail them. " Persons having clothing
suitable to bo made over for children or
partly worn shoes and hats are requested to
send them as a Thanksgiving offering to the
rooms , US North Twelfth street.

E. E. Watrous , a traveling man represent
ing A. S. Smith A Co. . of New York , was at
tacked by footpads Monday night mid robbed
of about $ tWO in money and it gold watch.
Watrous was proceeding along Dodge street
on bis way to the Turkish bath , and at. a
point between Thirteenth and Fourteenth
streets his assailants eihcrged from an alley ,
knocked him senseless with sand bags and
made way with his valuables. The jxillce
were notified from the Millard hotel of the
robbery , but at last accounts no arrests hud
been uiadc. _
Only Ono Permit.
The only building permit issued yesterday
was the one to W. Friederlckson , to build u
two-story dwelling and barn on the corner of
AVirt and Twenty-hccond streets , the cost of
the proposed improvements being ? 2bOO.
A Stolen Ovorcont.
James Dunn , a. young fellow who of late
has been associating with thieves and thugs ,
was arrested , yesterday afternoon about 4
o'clock while trying to soil a valuable over
coat supposed to bo stolen. He seemed very
anxious to got rid of the garment and offered
to sell it for almost nothing. The overcoat
is a brown ono with silk facing , and is still at
the police station awaiting an owner. As
