Mr. Norllng , who is doing the deco
rating of the now county court house ,
has become a permanent resident of this
city. Ho has leased a house on the cor
ner of Main and Fifth avonuo.
The funeral of Miss Ilattiu Stoflfon will
bo held this morning , the friends gather
ing at the residence , No. 1810 Fourth
avenue , at 0 o'clock , and the services at
St.Xavier's Catholic church at 10o'clock.
Several of the hangers on about the
5ambling houses In this city went to St.
oo in thu hope of making a stake. The
authorities placed them in jail until after
the crowd left town , fearing they would
do up some one.
The Citizen's club rooms are to bo
lighted by the now gas. the piping for
Which is already in. The manufactur
ers are so crowded with orders , that the
fixtures cannot bo sent until next week
sometime , so that there will be a little
delay on that account in the opening of
the rooms. * _ _ "
Elder Mark II. Forscutt , of Omaha" ,
will reply to the Hev. Mr. Lamb's lec
tures against the book of Mormon , on
next Sunday morning and evening at
Saint's ehapol on Pierce street. An invi
tation is extended to the clergy of the
city , and to Mr. Lamb's friends. All
who have Mr. Lamb's published book
bring it along and compare quotations.
Charlie Lie bold chanircs about a good
deal in his saloon business. When the
injunction was obtained against the use
of the building for saloon purposes his
landlady served notice upon him to quit
and ho hastened to comply. Ho made
the announcement that ho was going into
the cigar business , his old trade , and the
prohibition organ gave him a cheering
send-on" . Hardly had the praise been pub
lished when ho changed his mind and
concluded to keep on. Ho furnished
bonds to secure the owner of the prop
erty in ease of trouble and opened up.
Ho found that a war-cloud was gathering
especially for him , and ho hurriedly
closed again. This tiuio it is said to bo
for good.

The whole of yesterday was taken up
In the district court In the arguments in
the case of Herb Hothory , charged with
stealing a diamond from Mrs. Ourhorn's
jewelry store. Attorney Mynster made
the opening argument for the defense ,
followed by Attorney Ualclwin , of Omaha.
Colonel Daily closed on behalf of the state.
There was a good deal of time and
strength spent in pounding at each other ,
until it seemed that the attorneys con
sidered themselves on trial instead of the
prisoner at the bar. It was a hot contest
of words , and the jury as well as the at
torneys looked pretty well worn out when
the end was reached and the case given to
the twelve. AH soon as the jury had re
tired , Colonel Dally asked that the court
order the sheriff to take Hothery in
charge , and also take Morse , who was
indicted jointly with him , though Hoth
ery was tried separately. The county at
torney called the attention of the court
to the fact that the two men were non
residents , and that the bond was only
| 1,000. Judge Dceiner accordingly Is
sued the order , and the nherill took
charge of the two men.
The jury retired about 5 o'clock in the
afternoon , and general predictions
seemed to be that they would hang or
else convict.
The jury were still out at a late hour
lastnight , with prospects of staying until
morning.
During the evening an effort was made
to get Hothery and Morse out on bonds
of 11,000 , to prevent their being locked
up all night. Judge Dcemer examined
into the proffered bond signed by Mr. Iler
of Omaha , and John binder , of this city.
The former not being a resident of this
county that barred him out of being a
bondsman under the statute. Mr. Linder
appeared and was examined as to his
real estate in this county , but Judge
Dceiner decided not to approve the bonit ,
and those interested in the release of the
two prisoners went after Conrad Geise ,
it being decided that his signature , with
that of Mr. Linder , would be satisfactory.
When Rothcry and Moss were first
arrested tor the larceny of the diamond ,
Ed Hothery is said to have secured the
services of W. S. Williams to look after
his brothers's interests. Attorney Wil
liams has commenced suit now , claiming
$250 for his fee. Ho got service on Ed
Hothery yesterday , and the case is dock
eted in the superior court. Hothery
claims that he got Williams to look after
tiio ease in the police court and paid him
iho full amount agreed upon , $10 , and
that ended Williams' connection with the
case.
The City Mnr hal' Fee Bills.
The county refused to allow the bills
of City Marshal Guanclla several months
ago and Frank became wrathy. Ho de
termined ho could .sue them , but thought
he'd wall until the September mooting
and see if they'd allow his bills for the
previous quarter , if not , ho would sue
for the whole six months' bills at once.
Ho went to the county auditor and pro
cured the old bills to copy. Ho then
asked the city clerk for the bills for the
last quarter which ho wanted to cony
before they went to the board. After ho
had copied the six months' bills ho took
them all to the auditor so he could put
the old bills away and file the now ones
for the consideration of the board of sup
ervisors when they mot.
When the supervisors mot the city
marshal was in daily attendance , pa
tiently waiting for his bills to como up.
Ho was extremely anxious to bo there in
person when the board was considering
them. Ho waited and waited in vain , as
finally the board adjourned until Decem
ber without considering the bills in which
Guanella was interested.
Upon inquiry , no one seemed to know
the cause of the absence of the bills , but
finally it was discovered that the county
auditor , when ho was handed the old bills
ho had allowed Guanella to copy , the now
bills being in the same package , put
them all away together in the old file ,
where they were discovered.
And now the city marshal and the wit
nesses who were on the bills will have to
wait until the December meeting of the
supervisors before they can draw their
pay.
It is a little joke that will cost the city
marshal the trouble of waitinc three
months longer for about f400 , besides
inconveniencing the witnesses , provided ,
however , the supervisors allow them
when they see thorn.
It wouldn't do to mention it to
Guanella though , as ho keeps it quiet.
A MI88QUUI FUGITIVE : .
Ho Proves to He Badly Wanted For
Safe Blowing and Other Crimea.
II. C. Miller , or Millard Harmon , as
his name turns out to bo , was taken back
to Gallalln , Mo. , yesterday afternoon on
the Wabash train by the sheriff of Davis
county.
Gabo W. Cox , sheriff of Davis county ,
Mo. , arrived in the city yesterday noon
on the Wabash , and after consulting
City Marshal Guanolla , proceeded to the
county jail tor his prisoner. Upon the
opcmnc of the jail door the marshal
said , "There ho is , " at the same time
pointing to the prisoner.
"Hollo , Gabol'1 ' shouted Harmon , "How
are you ? 1 didn't expect to see you
again very soon. "
The sheriff says Harmon is a very
dangerous crook , as well as a slick safe
blower. He was wanted for the rob
bery of the postollico , which was located
in a general merchandise store , and had
broken jail after his arrest. He hasn't
been scon nor has thcro been any track
of him since July 8.
City Marshal Guanolla says ho recog
nizes the fugitive from justice as being a
man whom ho has seen on the streets of
Council lilufl's , on and off , for thrco
weeks or so and to corroborate this Har
mon said tie had seen Guanolla so often
ho had got over being afraid of him. As
ho put it : "When I first saw you I ex
pected to bo seized , but I'd gotten .over
that , seeing you so often. I
have been here , on and off ,
for a month or more and
was in this city every night during the
Omaha fair. "
Had it not been for the accidental
meeting on the train of an old neighbor
of Harmon's , no arrest would have been
made , as when the train arrived at the
transfer the man carefully and quickly
told officer McMilhan. on Wednesday
that "that man is a fugitive from justice
hud It wanted in Davis county , Mo. Ar
rest him.McMillian was in doubts i\i
to the advisability but obeyed the couv
uiand and a dangerous man was placed
in custody.

Why So Many Ties ?
Carload after carload of railroad Uci
are arriving in the yards of the Chicago
Hurliagtdn & Quincy. There are now
80,000 piled up there , and ; th& anxiou
query Is , what for ? No one scorns to
know. Even the railway ofllcials are as
silent as tombstones , and act almost as
if they thought the ties were not there at
all. They simply don't know , or at least
that is what they say , and like news
papers they always tell the truth. Thcro
are numerous theories , and the most
reasonable ono is the company is plan
ning on building the talked of branch to
Fontanelle , la. , at oneo. If the work Is
to bccln on this end , the prcsenco of the
ties hero can easily bo accounted for.
There has been some running of lines
and some grading done , and it seems
now that the road irom Fontancllo would
be pushed to a speedy completion , thus
making an air line into this city. The
advantage of this line can easily DO seen
by a glance at the map and a compari
son between the present main line of the
Q. and the prospective route.

Admitted New Guilt.
Yesterday afternoon , jnst before the
adjournment of Iho district court , two
prisoners were brought up from the
county Jail to plead guilty. Ono was the
tramp , giving his name as llccdor , who
was arrested In the country for making
an indecent exposure of himself In a
farm house , where ho had begged the
privilege of sitting down and resting.
The indictment was for assault with in
tent to commit rape , but ho concluded to
plead guilty to exposure of person. At
least that was his wish as expressed by
his attorney , W. S. Williams , but when
the fellow was asked by the judge , hi < de
clared ho was not guilty. Ills attorney
whispered to him hurriedly and ho con
cluded tnat ho was guilty. Ho got off
with u two months' jail sentence , the fact
being taken into consideration that ho
had already been locked up for six
weeks.
A colored man , Winters , pleaded guilty
to burglary. He was caught in Iho act of
croing through a saloon on Main street.
Ho was remanded to the county jail to
await his sentence , which will bo pro
nounced Saturday.

A Change of
Yesterday morning Charlie Keith , the
general agent of the Chicago , Burlington
& Quincy at this point , transferred the
ollico to M. M. Marshall , who Is selected
as the successor. Mr. Keith has been ap
pointed to look after the company's in
terests in East St. Louis. As he de
scribes it , the change is "an Irishman's
hoist , ono peg down , " but it is understood
that the change is not so downward a ono
as the gentleman jokingly and modestly
suggests. The position to which ho is
now called is an important ono , and ho
will doubtless bo found filling it well and
faithfully. Ho has made many friends
here among the business circles , and the
interests of the road have been zealously
oared for.
Mr. Marshall has been the agent at Pa
cific Junction. Ho is succeeded at that
place by J. T. Pugh , an old Council Bluffs
boy , who has been Marshall's assistant for
four years , and who was formerly in the
ollico hero.
