The only question for the jury to decide
was whether or not Mr. Hce.io was of

will. The jury decided that Mr. Koeso

utes.

M. II. Null , of Chadron. was brought

J. II. Shownlter , and arraigned before
Judge Dnndy on the charge of selling beer
without a license. Ho pleaded not guilty
and was released under a $ BOO bond.
Iho information in the suit of J. B.
MeKinley , et al vs Margaret K. lilnck-
law et al , a foreclosure of mortgage , was
lilcii with the clerk yesterday morning.
The indebtedness is $ i,000it ! 7 per cent in
terest from March 188. ! , and tue property
involved consists of a farm of 410 acres ,
situate near Pawnee City.
The United States circuit and district
courts will adjourn next week until No
vember.
COUUT IN CHAMBERS.
The Humming up in the case Abraham
Poole et al vs. the West Point Butter and
Cheese association , was resumed in this
court yesterday morning before
Special Master Churchill. It will
reach a conclusion to-day , but
It will bo ten days yet before
Special Master Churchill files his report
with the clerk. The case has been drag
ging through the courts for nearly four
years , and those who have neon follow
ing it up will look for thelinal result witli
no inconsiderable interest.

morning and petitioned for a writ of ons-
tor sagainst one C. Frank , who occuuie
rooms above the establishment of the
Chinaman , and according to the lattcr's

utable house. A notice to quit was issued
on Frank.

Yesterday was a calm and peaceful
morning , comparatively speaking , before
Judge llcrka.
Henry Haben , G. G. Howell , Thomas
Foster , Peter Paulson and George Bnd-
well wore arraigned upon a ehargo of
dumping c.xcicment and other tilth in an
unlawful place , but after a thorough
si ft'me of the case were discharged.
Alike Murphy , of Phil Sheridan street ,
Is a physical wreck from too close an
intimacy with John Barleycorn. Ho
was run In yesterday morning for threat
ening to shoot his better half Murphy
is just recovering from a piotracled
debauch , and while sitting on the edge of
the bed Thursday evening ho suddenly
pulled his gun and banged her once out
of the window. Then ho nourished the
cannon and made sundry ominous de
monstrations toward Mrs. Murphy , and
she Hod and had him run in. He was
placed under a $ oOO bond to keep the
peace.
The cases of William Philips , Edward
Hurley and Leo Meyer , for violating the
gambfing law. wore dismissed on the
groumis that the alleged ofleuses were
committed on July the ' 'mlor three days
previous to the day on which the law be
came operative. _

dropped in at Fred Hunsuckor's saloon ,
413 South Thirteenth street Wednesday
nftoruoon , in much apparent haste. Ono
would have thought from the stranger's
nervous impetuosity , that ho was on his
way to the stock exchange with a big
tip. In a sort of superior condescending
way ho asked :
"Will you please allow mo to lay my
top-coat in hero a short time until 1 run
up to the Union Pacific headquarters and
see about some freight cars ? ' '
Hunsueker replied that he wasn't run
ning a cheek room , but that ho might
fake his coat in the buck room and leave
It , if ho was a mind to , ho did not want it
hanging in the saloon.
The stranger stopped In the back room
as directed , remaining there a moment
or so ; but emerging minus the coat ,
In the course of an hour the shabby gen
teel business man returned , walked
through the s-iloon , remarking that he'd
take Ills coat , and stepping into the back
room , came forth again with the gar
ment , as Ilunsuokur naturally supposed ,
upon his arm.
Ho lloatml out and nothing more was

when ho himself stepped into the afore
said back room to get ins own coat ; a
nice , now , light gray cutaway , which lie
had hung up there in the afternoon , as
is his custom those Incindorating days.
It may be imagined Mr. Hunsueker in
dulged in a choice lot of expletives , some
of them much choicer than elegantwhen
ho discovered that his bran new Benny
hail 11 own , and in its stead , hanging like
n Hag at half mast , was the shabby gen-
teel's old faded duster.
Mr. Hunsuekor was mad , of course ,
and wont homo In his shirt sleeves. This
morning he came down to the station and
reported the case to Chief Soavoy , and
wants the man who stole his coat looked
up if it costs more than his whole ward
robe is worth.
In the pocket of the coat Hunsueker
lost was Ids Savings bank deposit book
and his check book on the Fir&t ISH-
tional , containing several checks , the
payment of which , however , has been
stopped.

A Hard Tussle With a Woman
Itentor.
Yesterday morning word was sent to the
police station that a man was attempting
to kill a woman at the corner of Twen
ticth and Pierce streets. Ullieer ( iilligan
on Thirteenth stiect was Informed of the
matter by OJllpor Ormsby , while the pa
trol was out on another c.ill. When the
latter returned Ollleor Ormsby rode tn
'scene , Jim O'Brli'n , the driver , making
'the run in about four mliuilob , the LHMI
run ever made uy the wagon. At the
street in question a crowd of people were
fguud , among ttiem a brutish-looking
man with heavy ,
whom the crowd seemed to desire to
treat to bodily castlgation , His victim
wni soon found , n petite handsome wo
man who displayed a largo contusion on
the back and front of her neck where
the brute had caught her in
his vise like crip. How she
got away from him. scorns n mystery
because ho Is ono of the most powerful
men the police have handled in many a
day. The woman's name is Mrs. Schlenk ,
nnd she tells the story that Jensen en-
tcred her house and demanded beer. She
told him she had no beer , and ho immed
iately seized her with wicked in
tent when she succeeded in ef
fecting her escape. Officer Gilll-
gan arrived on the scene about the sumo
time as the wagon , and Jensen was put
into the patrol. As ho landed on the
lloor ho turned and narrowly missed
kicking Olllccr Gilligan on the head.
Both the officers then bestowed attention
upon him , which was kept up until the
wagon landed in the station , because
during the ride ho made frantic efforts to
bite , scratch , bruise and escape from the
officers.

From present Indications , It would ap
pear that the strike among the painters
will erelong die n natural death. Out of
the 300 men who struck there are
only about llfty remaining in Iho city
who arc out of employment. "You see , "

A grand basket picnic and excursion to
Calhoun will bo given on Sunday next
for the benefit of the strikers. The pro
ceedings will bo under the management
of the Calumet Glee nnd Social club.
The Musical Union band will furnish the
music , and other arrangements for a
pleasant trip have been clliciently at
tended to. Trains will leave St. Paul
depot , corner Webster and Fifteenth
strcctH , at 8:15 : and 10:40 : a.m. , returning
at 4:15 : nnd 7:40 : p.m.

terday morning , where ho was called by
the death of his venerable father.
W. A. Austin , of Concordia , Kan. , lias
been appointed freight agent of the B. &
AL vice Major McClintock , resigned , and
will take charge Alonday morning next.
A tramp , name unknown , was dragged
beneath the wheels and killed in attempt
ing to boaul a moving freight train at
Plattsinoutli yesterday morning.

The Tumors Excursion.
The excursion of the Omaha Turn-
vcrcin to Rural park , near Plattsinoutli ,
next Sunday , promises to bo a magnifi
cent aiuUr. The committees in charge
have labored earnestly for its successand
the splendid programme they have pre
pared will bo appreciated by all. In
order to sco that no disturbances of any
nature shall occur , the committee has
arranged for a largo number of repre
sentative citizens to take charge of the
grounds and see that the best of order
is preserved. From present indications
the allair will bo a huge success , and at
tended by hundreds ot Omahans.
The musical piogrammo is m itself a
credit to the management , and all who
attend can count on a good time.

D. C. Patterson , the real estate agent ,
offers a reward of $50 for the arrest of
the party who suggested or engineered
the Papillion mortgage forgery. Bozo-
zcclia , the German who came so near
turning the trick , now says that ho had
three accomplices , that they did all the
planning , and that ho was but a tool in
their hands. However , Bezezccha isn't
as big a fool us ho looks , and is fully
capable of managing just us stupendous
a fraud all by himself. Ho couldn't have
bcou drilled to do the work ho did and
do it as well and unerringly in a month.
Ho is naturally a man of a limitless stock
of low cunning , and it is seen in every
glance of his restless eyes.
The North Oin.ihn Sewer.
The building of the north branch of the
North Omaha sewer will bo immediately
pushed and carried out with all possible
dispatch. The contract was let yester
day to Thompson & Delanoy. The latter
is already well known in this city , while
Mr. Thompson is from Kansas , and has
recently done all the scwor work in
Sioux City. This contract is the largest
casli sewer job over done in Omaha ,
involving $40,000.
A Nuisance.
Much complaint is made of a gang
that Is in the habit of congregating in
the rear of the Tenth street engine house ,
and "rushing the growler , " and other
wise making themselves obnoxious to
respectable people. They uro warned
that it would bo best to "co hence. "
Sunday Observance.
Tlura will bo a public meeting under
the auspices of the "Sunday Observance
association" in the Tabernacle Congre
gational church on Monday evening
next at 8 o'clock for the discussion of the
Sunday question. Speakers from var
ious churches will bo present.
Overcome.
At about 3 o'clock this afternoon an un
known man was overcome by the haat ,
while walking along the postollice pave
ment. Ho was removed to St. Joseph's

of the Pullman Company.
As stated In these columns a few days
ago , Air. L. AL Bennett , who for some
eighteen years has boon superintendent
of the Pullman Car company in this city ,
has resigned. The Pacific division , of
which Air. Bennolt was the superintend
ent will on the 1st of August bo merged
into the Chicago division , of which Mr ,
K. A. Jowett , of Chicago , is the su perin-
tandont. The sleeping car lines which
run over the Union Pacific rail way will
bo under the charge of Mr. N. P. Skinner
as assistant superintendent. Mr. Skinner
has boon with the Pullman company for
some eleven or twelve years , ana will as
sume the duties of his new position at
this place August I.

Resolution In Favor of Nine Hours
Each lny Adopted.
The contracting carpenters to the
number of about seventy mot at Clark's
hall yesterday atternoon to consider the
nine hours' question anil also to decide
whether eight hours should be the rule
on Saturdavs. A discussion took place
on the sublect and a resolution was
passed adopting nine hours per day ,
Saturdays included. The contractors
Were unanimous on this point and as a
number of the men are in favor of the
uniform nine hours there will probably
not bo any dllhculty In adjusting matters
on this basis.
Shooting Accident.
The danger of playing with firearms
was evidenced at the United States sa
loon , South Omaha , when Mrs. Kun/el ,
wife of the proprietor , after getting into
n playful soulllo with James Formanck ,
her brother-in-law about the
- - , possession
of some money , picked up revolver ,
and , pointing it at Formanok's head.
pulled the trigger. She was considera
bly horrified to see her brother-in-law
fall to the ground , apparently dead. Dr.
Ernhaut was immediately called in , and
found that a 32-ciilibre ball had entered
at the side of Formanck's neck and
lodged under the skin at the back. The
wound was pronounced serious , though
not necessarily fatal.
Jumped the Track.
The Union Pacific company were put
to considerable inconvenience last even
ing in the moving of their trains , in con
sequence of engine No. 1150 and three
cars having loft the track on Fourteenth
street. The accident was said to Imvo
been caused through a "lip" or expan
sion existing at the junction of two rails.
Engine Foreman U. P. Alorris was
slightly bruised. Both the main lines
wore blocked to such an extent that it
was necessary to use the old main line
on the lower track tor the admission and
discharge of trains.
Another Union Pnciilc Accident.
Whilst Jerrry O'Brien was yesterday
morning engaged In removing false portions

construction on the Union Pacific road at
Seventh street , ono ot the beams fell on
his right foot and inflicted n serious
bruise. O'Brien was taken to St. Joseph's
hospital , where his injuries were at
tended to.

Angus AlcCurd , who was run over by
a coal car on the Union Pacific track
Thursday , is progressing favorably.

A ViciniiR Dog.
Shortly before dark last evening John
Ellis , a well known colored man , was
badly bitten by a bull dog belonging to
Sam King , the proprietor of the saloon
on Dodge , near Twelfth street. Ellis en
tered the saloon to pay a bill , nnd a dis
pute arose as to the correct amount.
While disputing with Bartender Hill the
dog rushed at Ellis and bit him about the
body and legs. Judge Borka issued an
order for the killing of Iho dog and De
tective Horrigan executed the decree.

The axe has fallen among our Boys' and Ohildrens' Clothing and is
making havoc with the prices of some of them. Those who visited 119 J
during the past season must have noticed that since the enlargement !
ol our store , we carried in this line a much larger stock than formerly.
Naturally , of such a big assortment , we have more left , especially of j
the better grades , and we are determined to close them all out before
the opening of our new juvenile department , which next season will
be on the second floor of our building. A large line of Boys' and Chil"
drens' suits of all sizes some very fine goods and elegantly made also
a lot of knee pants and long pants are marked down to one-half their
value.
A manufacturer who heard that we are doing a large business , and
thought that we could dispose of most any quantity of goods , sent ua
last week a big lot of striped summer coats Mens' and Boys' with
instructions to sell them for his account. We did not want to a
them , as the lot is too large and the season late , and told him so , but
he wired us to dispose of them at any price we pleased , so we have de
cided to mark them 15o APIECE. It is almost giving them away ,
it is not our loss. They are new patterns and all sizes.
