, 'ihero was a spirited session of the
fitatu board of printing at the ofllcu of the
secretary of state yesterday , the contest
being over tlio letting of the printing of
thn house and seriate journals and the
nossion laws passed by the last legisla-
lure. The bidders were numerous and
jtho figures uisr page on 2,000 copies each
of house and senate journals were aa fol
lows : Hastings Gazette-Journal , $3.3' ) :
jUmaha Herald , $1.74 ; Omaha Republi
can , f ' 2.75 ; State Journal company , $ 1.38.
/These bids were submitted separately for
the sciiatu and liouso , and the contract
warded lo the State Journal company.
I For printing 0,000 copies of the session
' aws the bids were per t > agu , as follows :
Omaha Republican , ffl.fiO : Omaha Her-
nldi.r.l , ! ) ; Iowa Printing company , $7.18 ;
{ lasting Ua/.ette-Journal , | 0.t3 ! ; Slate
.Journal company , fl.iW. The contract
, was awarded to the Journal. It is inter
esting lo note that tw o years ago the
' .Journal comuany printed the senate and
jliouso journals at $3,35 per page and the
iOtnnha Herald the session laws at $0 33 ,
itlie Journal's bid two years ago being
f 10.3.1 for the session laws. The question
irises if Iho Journal was working for a
fiiir prolit then , what will it logo the pres
ent year ? The state , however , is getting
a cheap job of work.

A QUESTION OK PAYMENT.
A question has arisen as to whether
payments shall bo made from the appro
priation for the sinking of tbo test well
nt the salt basin after the on.d of the first
liseal quarter of the year , and the auditor
lias decided to draw no more warrants.
The board of public lands and buildings
lias submitted the question to the attor
ney general , who tiles an opinion with
tBoiu that the work ought to bo paid
until May 01. The attorney general's
opinion is of interest to a great many
und contains much history. The follow-
inn ; is the gist of it :
To tlio Honorable Hoard of Public Lands
nnd liulldliiiis : lnans\\er to your Inquiry
whether or not the appropriation mnde by
the legislature of 1SS5 for the sum of 850,000
( or the development ot the saline interests of
Olio stntf , or rather the unexpended balance
ou hand Is still available. 1 will bee leave to
hay thnt under thn provisions of our consti
tution It Is provided thnt each leclslatmo
shall nmke appropriations tor the expenses of
tbo government until the expiration ot the
lirst tiscal quarter after the adjmunmeiit of
the next regular session , and all appropria- '
tlons shall end with sucti quarter.
The net nbovo referred to provides for
Belli UK so much of our saline lands as will
raise tlio sum of S'iO.000 , tha amount appro
priated. Under tlio inovlslons lands were
sold to tlio amount of 320,000 and a contract
rnteicd Into In writing for boring a well to
thodupth of ' . ' ,000 U'oiou what Is known as
theblirsnlt basin nnd for \\hlch the board
agreed to pay the Mini or $10,000. The con
tractor entered upon his \\oik and on March
III , 1837 , Imd bored t' ' > the depth of 1,500 feet.
Now the question presented Is can thn con
tractor continue boring after tlio Slst of
Mnicn , 18s7 , and still receive his p.iy from
the unexpended balance ?
Thiiso fands weie donated to the state by
the UnitedStaU-s under the enabling act.
Section 11 of said net provides that all salt
Bprltms within the state not exceeding twelve
In number with six sections of laud a J join-
In e , or , us contiguous as may be to each ,
shall bo granted to said state for Its use ,
the Innds to bo selected by the governor
theroot , within ono year utter the admission
of the .stale , and w lien so selected to be used
or disposed ot on Mich terms , conditions and
regulations us the legislature shall direct.
Wlu'ii wo view the enabling act , wu llnd
nil sections numbereil Irt nnd ! W within our
stale has been grunted to the state for the
biinpoit of common bchools.
Twenty sections of lands have been
pr inted to the state to nrrct buildings nt the
c.ii'ltol lor legislative nnd judicial purposes
m such manner as the legislature may pie-
sorlbe.
Soventy-two other sections for the use and
suuport ot a state university.
Fifty .sections also for n penitentiary.
These lands are all trusts created for the
Bucclflc purpo-.es tor which they w ere ranted ,
and it can be just as truly said that
the Innds umnted with the salt
sprint's wore to bo used In the
development of the springs ns It Is tint tlio
other lands were to bo Used for tlio specltio
objects for which they \\ero granted , and the
not ot IbbS Is the lin > t time that tbe legisla
ture of our state has directed these saline
lands to be used In developing tha Salt
Sprlues , and muter said act U was never
contemplated that the advertising and sell-
jni ; the lands , the contracting tor the well ,
thu building ot dykes , ditches , reservoirs
ind aqueducts , and the completion of said
' Work should bo performed within the space
if two y * ni. .
lands were granted to tha Uteo
t
April 10,1V , and our constitution contain *
ing thn section first nbove cited was Adopted
In Is.1) , and It would seem to mo that the
trust created 1ms rested In abeyance until the
legislature of 18-Ci directed the same to bo
carried Into t.'llect , prescribing the condi
tions and regulations for cnrrvlnt the same
Into operation , nnd would seem to bn an
order for the board to continue until tht
work has been accomplished.
The question has never been passed on by
our courts , nnd us the constitutional pro
vision regulating appropriations oueht not to
be sllithted by construction , 1 would think It
far better to submit to the Inconveniences
that may nrl.sa than that n safi'Kiiaid of the
constitution so valuable to the people of our
.state .should In the least particular bo Im
paired.
It Is well known that our saline lands
have been frittered away for purposes other
than that for which they were granted , and
the nbovo remarks are made more to call thu
attention of the stnto authorities to the true
object for which the saline lauds were
granted to the state than to strike at a whole
some provision of our constitution , and It
would bu well as soon as may bo to have the
question presented to our supreme court to
have the status of our saline lands legally de
termined.
1 ho constitution providing for nil appro
priations ending at the expiration of the llrst
tiscal quarter after thn adjournment of thn
next regular session.
The hscnl year commences on the 1st day
of December ot each vear and puds on the
80th day of November of each year.
The legislature of 18S1 made an appropria
tion of 35U,000 fur the years 18S5 mid IBM
under the provisions ot sue. 10 , art. : i ot the
constitution , nnd under that same.suction the
same Is extended until thu expiration of the
( Heal quarter after the legislating ndjourncd.
This would In my opinion extend the appro
priation until May 31 , giving HIM language
the most limited construction. The legisla
ture iidjoiirned March HI , 18b7. The lirst lisc.U
quarter of tbe year would end Februaiy 5s ,
1W. This would be the tint expiration of a
tiscal quarter after the adjournment The
laniruaKo would Indicate the runnnlncr of a
whole tiscal quarter of a year , and as the leg
islature was In session a part of the second
liseal quarter n fair construction of section
10 would extend thn appropriation until the
expiration of the lirst full liseal quarter after
the ndtoiirnmcnt which would expire August
31 , 1887 , but it is better to be on the safe side ,
and I should think thnt the first const ! uctlon
would be sustained by our court , and as the
appropriation Is made to meet the expenses
of our government , nnd If the development
of our salt wells should bo coiisideind such
an expense , then I run of the opinion that
any expense Inclined belore May 31 , 1 37 ,
would bo chargeable against the 850,000 appro
priated , or the unexpended halance thcicof.

TMtUGCiIST riN'KD.
Nelson , the druggist arraigned for sell
ing liquor on Sunday , had his trial yes
terday in police court nnd the evidence
showed that ho had been soiling liquors
Sunday , keeping an imperfect and poor
record of the same. The judge imposed
a line of $ r > 0 and costs , and time was
given the defendant to pay the amount
or appeal. The other cases against drug
gists were not called and it was rumored
that some doubts were entertained
whether or no the charges against them
could bo sustained.
MINOIl NOTES.
Yesterday Speaker Harlan was in the
city on business his lirst visit to the city
since the close of the session. Brntl
Slaughter was also in the city looking

A STORY OF MENRY CLAY DEAN.
"He Tiiou Ut or Hell nml fin Kelt
Ha freshed. "
Iowa Kcgister : It was not long ago.
There was a car load of passengers going
from Keokuk to DCS Moino.s Among
them were Judge Clugott and Judge
Jolmstono and Rev I. P. Peter and Hov.
Burgees. Clagctt called Uev. I. P. Peter
"Beelzebub , jr. , " and , by soiic : strange
mental ana chronibin , dubbed Hov. Bur
gees as "St. Paul , jr. " However , Brother
Dean was the center of attraction , his
brilliant conversational powers shown
out on that trip with unwonted radiance.
Ho was telling a story of a loving brother
of the strictest sect of the orthodox faith
as Imd down by John Calvin. Dean did
not believe in Calvin any more than ho
dirt in Martin Luther with his imposing
nonsense about the "divine right of
kings. " 1 wish the scone could be repro
duced on paper as it occurred on the
train. There was Dean with his singu
larly emphatic voice , with his rotundity
of | ) resenee , with ids wonderfully mag
netic nnd twinkliiiii , gray eyes ; thine
were learned and famous men willing
listeners. Ho said : "This dear Calvinistic -
istic brother came to me one dav in great
mental distress. He stud ho liad lieon
reading the daily impcrs , and found a
dreadful record of crime ; hero a murder ,
there an arson , here incest , adultery ,
theft , betrayal of trust , infanticide , ingratitude -
gratitude of children , baseness of every
kind from son to father , from man to the
beasts of bunion he used , defaulters ,
and the world seemed given away to wick
edness. Then ho said , ' 1 thought of hell
nnd I felt refreshed. ' "
"That is , " said Dean , "these follows
will bo caught some daywhile I escape. "
That is what the good Calvinistie brother
thought. Ho looked out over tho'wilder-
ness of wickedness in world. Ho saw
no euro for it in this lifo , so "he thought
of hell ana ho felt refreshed. "
The expression is epigrammatic. It is
certainly original with Henry Clay Dean.
Polled Court 1'nlnts.
John Kane' , John Brown and William
McFarland were lined § 10 and costs by
