The parties pgamst whom the suits were commenced nro the Colorado & Nebraska railroad company , the Chicago , Burlington & Quinoy railroad , and John Fit/.gerald , the number of defendants arising from the question as to who were the parties directly liable for the wreck and attcmi- ttmt loss of lifo. The cortllicato of organization of the Kansas City & Northwestern railroad wan filed yesterday with the secretary of etate. The termini of the railroad to bo constructed by this company shall bo a point on the south line of the stale of Nebraska , near the soulhwost corner of 1'awneo county , whore the Kansas City , Wyandotte & Northwestern railroad terminates : the town of Custcr , m the county of Gustor. state of Nebraska , and the town of Kcya Paha , in the county of Holt , state of Nebraska , ami the said railroad is to pass through the counties of Pawnee , Gage , Jott'erson , Saline , Fillmore - more , Clay , Adams , Buffalo , Sherman , Ouster , York , Polk , Morrick , Nance. Platte , Boone , Madison , Antelope and Holt. The amount of capital stock of the company is 11.000,009 , whioh is divided into 10,000 shares of f 100 each. The incorooralors are E. S. W. Drought , Elian Sunmierliold , C. F. Hatchings , A. D. Yocuin and Benjamin liurch. A QUESTION OK PAYMENT. A question has arisen as to whether payments shall bo made from the appro priation for the sinking of tbo test well nt the salt basin after the on.d of the first liseal quarter of the year , and the auditor lias decided to draw no more warrants. The board of public lands and buildings lias submitted the question to the attor ney general , who tiles an opinion with tBoiu that the work ought to bo paid until May 01. The attorney general's opinion is of interest to a great many und contains much history. The question has never been passed on by our courts , nnd us the constitutional pro vision regulating appropriations oueht not to be sllithted by construction , 1 would think It far better to submit to the Inconveniences that may nrl.sa than that n safi'Kiiaid of the constitution so valuable to the people of our .state .should In the least particular bo Im paired. It Is well known that our saline lands have been frittered away for purposes other than that for which they were granted , and the nbovo remarks are made more to call thu attention of the stnto authorities to the true object for which the saline lauds were granted to the state than to strike at a whole some provision of our constitution , and It would bu well as soon as may bo to have the question presented to our supreme court to have the status of our saline lands legally de termined. 1 ho constitution providing for nil appro priations ending at the expiration of the llrst tiscal quarter after thn adjournment of thn next regular session. The hscnl year commences on the 1st day of December ot each vear and puds on the 80th day of November of each year. The legislature of 18S1 made an appropria tion of 35U,000 fur the years 18S5 mid IBM under the provisions ot sue. 10 , art. : i ot the constitution , nnd under that same.suction the same Is extended until thu expiration of the ( Heal quarter after the legislating ndjourncd. This would In my opinion extend the appro priation until May 31 , giving HIM language the most limited construction. The legisla ture iidjoiirned March HI , 18b7. The lirst lisc.U quarter of tbe year would end Februaiy 5s , 1W. This would be the tint expiration of a tiscal quarter after the adjournment The laniruaKo would Indicate the runnnlncr of a whole tiscal quarter of a year , and as the leg islature was In session a part of the second liseal quarter n fair construction of section 10 would extend thn appropriation until the expiration of the lirst full liseal quarter after the ndtoiirnmcnt which would expire August 31 , 1887 , but it is better to be on the safe side , and I should think thnt the first const ! uctlon would be sustained by our court , and as the appropriation Is made to meet the expenses of our government , nnd If the development of our salt wells should bo coiisideind such an expense , then I run of the opinion that any expense Inclined belore May 31 , 1 37 , would bo chargeable against the 850,000 appro priated , or the unexpended halance thcicof. Nelson , the druggist arraigned for sell ing liquor on Sunday , had his trial yes terday in police court nnd the evidence showed that ho had been soiling liquors Sunday , keeping an imperfect and poor record of the same. The judge imposed a line of $ r > 0 and costs , and time was given the defendant to pay the amount or appeal. The other cases against drug gists were not called and it was rumored that some doubts were entertained whether or no the charges against them could bo sustained. MINOIl NOTES. Yesterday Speaker Harlan was in the city on business his lirst visit to the city since the close of the session. Brntl Slaughter was also in the city looking after the work of completing the house journal ready for publication. The news of the death of Judge Weaver created great surprise in Lincoln , ns hardly a soul knew of his illness. ( July a week ago lie was in Lincoln arranging to become a citi/.on hero and his health seemed as good ns usual. "Major" John 0. " However , Brother Dean was the center of attraction , his brilliant conversational powers shown out on that trip with unwonted radiance. Ho was telling a story of a loving brother of the strictest sect of the orthodox faith as Imd down by John Calvin. Dean did not believe in Calvin any more than ho dirt in Martin Luther with his imposing nonsense about the "divine right of kings. " 1 wish the scone could be repro duced on paper as it occurred on the train. There was Dean with his singu larly emphatic voice , with his rotundity of | ) resenee , with ids wonderfully mag netic nnd twinkliiiii , gray eyes ; thine were learned and famous men willing listeners. Ho said : "This dear Calvinistic - istic brother came to me one dav in great mental distress.
