worthy 13 indicted for collecting and re-
ccivlng excessive fees in pension cases ,
and in the indictment as drawn there are
ten counts , each of which recites the fee
received in an individual case , the amount
ranging from &IOO down to $200 and S'.iO
in other cases. The United States stat *
titcs recite that the fee for securing pen
sions shall bo $23 in each cnso and no
more , hence the grounds upon which the
indictment is based. The maximum
piinlMinient recited for each oll'unscof
this nature is a line of $ M)0 ) or two years'
imprisonment , and it may be graded
downward in the discretion of the court.
It is understood that Mr.Jb'oxwortliy's de
fense will bo that the extra and over
charges are for expenses incurred in the
case , and on that ground evidently the

The state university lias In its employ
one Dr. Hillings , ultnough why the re
gents thought it was necessary to spend
money lor as little needed a position as
lit ) fills is one of the inscrutable things
never found out. One of the regents , at
least , was not in favor of hiring this Dr.
liillings at all , and he has not changed
Ills mind since. Hillings has written col
umn atter column of verbiage for the
Lincoln .Journal. In fact , h has como
well up with the editor-in-chief in thu
capacity of idling spaco. So long as Dr.
Hillings conlined himself to a mass of
generalities in the columns of that paper
there was no disposition to criticise , even
if the regents were paying money in a
useless way. Hut of late Hillings lias
taken to a good deal of acrimonious talk
and criticism upon the live Block com
mission , and the time has como when this
barking should cease and the state uni
versity stop nn indirect warfare upon
the live stock commission that is entirely
without its jurisdiction. The university
does well enough at the hands of thu
state and gets enough without having
some portion of its faculty attacking
men who are atrictly attending to
their own business. Dr. Gcrth ,
the state vecrlnarlan. is a man of few
words but a good deal of industry , and
when Ii2 is not out through the state on
olliclal business ho can always bo found
nt his ollice and at work for the state
rather than swelling iroiind through the
lobby or stiilllng the columns of a paper
with , \ mass of stuiTthat no once cares to
read. So far as observation goes , the
live stock commission as well as the
stale veterinarian , are attending strictly
to business , and the annual report of this
department itself shows that little idling
could bo done. It would seem therefore
meet and right that the university call
tlioir man Hillings in and put a gag in
his ink well for a season.
WKAKIXn AN ANOIttNT LOOK.
There was delivered at the office of
Ilio secretary of state yesterday
: i large consignment of annual reports of
the state board of agriculture , but when
one was gathered up with the thought
that something of interest had arrived a
glance at the work showed that it was
the report of 1835 , a document so aged
that as they are distributed over the
slate Ihcy will hardly receive a passing
notice. That the long delay in their
publication is not duo to the secretary of
the bociety is shown by the certilicato
just beyond the cover which itself shows
that ou tho. ! M day of last
January the report was transmitted
ly the secretary to the state as
required by law. Where it has boon the
long months since is probably answered
iiy the imprint on the covers , " .Journal
Company , state printers , " and if it has
taken that company twelve months to
publish reports of that kind and put
them before the public at a time when
thr.y are nearly ant-dlluvian and practi
cally without interest , "rotorm is neces
sary , " would bo a proper statement to
engraft In discussing state printing here
after. It is very certain that the object
of thn state in publishing these reports is
not to pay for something to bo gotten out
a year after date , and in auditing vouch
ers it would bo wise to find whence comes
the trouble.

Johnny McClelland was arrested j'estcr-
morning on a warrant sworn out in Jus-
: ice Anderson's court by Fallen , charg
ing him with malicious destruction of
property. Ho was brought into court ,
promptly waived examination , and gave
bonds in the sum ot $1,000 for his ap
pearance before the district court , when
ever his case should bo called for trial.
Later in the day McClnlland appeared
in police court with his bondsmen , to
mswer to the charges of the haokmen
whom ho assaulted Tuesday night. As
Judge Stenborg had gone home , no
bonds were fixed.
The sensational report about McClel-
land's leaving town is absolutely without
foundation. Ho is still here , and says
that ho proposes to remain hero nnd
light the case to the last ditch. N. J.

who constitute the "Kennedy family of
sharpshooters , " and whoso wonderful
skill in all kinds of shoot , ng is well known
here , were on the ill-fated Missouri Pa
cific train which was wrecked near Dun-
bar , Neb. , the other night. Colonel Henry
to-day received a letter from Kennedy in
which that gentleman says that his wife
was sevorly injured in the wreck. She is
suHVring from a broken shoulder blade ,
mushed brca l and arms with a suspicion
of an injury to the spmo and of ievcro
internal contusions. She will require.

rest and quiet before she will bo in condi
tion to bo about again , Kennedy him
self escaped with a badh sprained knee
and ankle. His little daughter escaped
with a few bruises. The three are now
at Fort Loavenworlh , Kas. , under the
care of the army surgeon at that post.
