The .salvation army has been notified
by tin : authorities thai they miisl not

The prisoners in the city jnil yesterday

other. The boys do not propose to get
out of practice while in durance vile , and
they succeed well. They ilo not have but
littlu to work on a few ohl clothes but
even a few old clothes have in times past
been .snllicient to cause quite a sensation
in police circles.
Colonel Daily , whose heroic service
during the war was recently given in the
HKI : as narrated by a southern panur , is
given a prominent mention in ( iencral
Hoauregard's new book , the description
being given of the same battle , anil the
colonel pictured , even to his bearing and
his horse , the de.siription being a differ
ent one m details only from that already
given the readers of this paper.
There are parties ot means and ex
perience now looking over the city with
a view of establishing a largo horse mar
ket here , the same as is conducted in
Kansas City and olhnr large cities. It is
proposed to make a market for all sorts
of horses , and to make it so extensive as
to make it a most desirable accession to
the now enterprises of the city. The
parties in looking over the city are im
pressed , as all must be , with the wonder
ful .shipping advantages , so many rail
ways centering here , and with the cheap
ness with which they can secure the nec
essary room.
The now lire alarm system will bo com
pleted , when ? The chief of the lire de
partment replies , "Ask mo .something
easier. " There are portions of the system
arriving daily , and the new boxes are ox-
peeled each train. So soon as they ar-
.rivo the \/ork will bo pushed to a full
completion within three weeks thereafter.
When completed it will be a police alarm
as well as a tire alarm , and will serve the
double purpose. This will bo a

slmip eyed looker-out for the interests of
thu Milwaukee ) & St. Paul In this vicinity ,
has returned from Madrid , a small sta
tion a short distance out on the line ,
where he has been attending lo an im
portant cnso. On Sunday night the
westward hound passenger train had
reached a spot about two miles and a
half west of Madrid , when the engineer
discovered tics on the traok jn .l ahead of
him. Tiie train was coming down a
grade of about fifty feet fall , and was
just entering upon n curve. By prompt
ness , and owing to a fortunate placing of
the ties , a most trrnblo accident was
averted. There hail been three tics thus
placed , with an evident intention of
ditching the train , and the escape was a
narrow one. The engine run up onto
ono of the tics , which had ( o be chopped
away before it could proceed. Had
the discovery been made a moment later ,
than it was , or had the tics been placed
on the track a short distance away , where
the curve was ( -harper , nothing could
have prevented the work of the liend
from being complete. A little further
along the track another tie was placed ,
with the apparent intention of the villain
to ditch any train which might approach
from the west. As soon as the diabolical
plot was discovered and happily frus
trated , steps wore taken to discover , if
possible , who was the criminal , inquiry
revealed the fact that a man had been
hanging about there , and hail spent the
night previous with a family who live in
a dug-out. This man had told the family
about his having been put oil" from a
train , ami he told the children that he in
tended netting oven by caiismir the road
some trouble. He .said ho would stop
their trains for them , ami would have
some satisfaction for thiMvayhi1 had been
used. From the description of tiio man
he was easily traced , and found to be on-
guired in Chopping wood for some farmer
about a mill * away , lie was arrested and
taken to the depot at Madrid to take the
train for Perry , there lo have a hearing.
lie was a Gorman , aged about lorty
years , and gave his name as Charles 11.
Froady. Ho had been at work on the
Astor branch. While waiting at the
depot for the train lie was the center of
observation for a largo number of rail
way men , who were naturally incensed
at the idea of his having inada such a
licndish attempt to destroy life as well as
property , anil more for ell'eet on him
than with any intent of carrying the
threat into execution , they talked of
hanging him. One of the men asked
where the rope was , and as he heard this
talk ho became very aii.Mou.sand worried.
Ho fairly bogged the ollicers having him
in charge , not to let them hang him. lie

In talking over the matter he admitted
lisguilt. When asked what his object was ,
u ! replied that he had been put off from
a freight train , and that ho was ' 'most
devilish hot about it , and was bound to
make the company as much trouble as ho
nut been caned. " Ho expressed himself
as sorry now that his anger had cooled
somewhat.
There seems nothing to save him from
getting at least a. long term in the pcui-
timtiary , unless it be the insanity dodge ,
and th'is can hardly be worked , as lie
talks and acts as if in his right senses. It
seems that after placing the tics on the
track , ho went into the woods near by
and there watched to see the result of his
work , and was apparently disappointed
that there was not moro of a wreck
caused.

The Tenth avenue project seems to
have been pretty well discussed , and
tpiito thoroughly vcntihiatiul. The only
objection raised against the project come. '
trom the few property owners who think
that they will sutler damages , if the rail
way runs along in front ol their houses.
They insist that they do not want to bo
forced into litigation with a great eor
portion , as they have not money to spend
in this way. They want the damage :
settled before Iho company secures the
right of way. They say tint if it is to
he so great a benclit to the oily at large ,
then the city at largo should bear the
burden of the damages , rather Ihan let
it fall on afowwhoso property rests on
the street in question. If they can bo
assured thai the just damages can bo
secured without ( ho expense or annoy
ance ol law suits , then they are willing
to lot the tailway company liave thu right
of way.
The citv council takes the position that
'
they will'not give the right of way unless
the rights ot these property owners can
be fully protected ,
The city attorney says that the most
the city council fan do is togivo the right
of way , as provided by law , and that no
action of the council can prevent the
property owners from recovering such
damages as they arc entitled to , and no
action of the council can help those prop
erty owners in securing those rights in
any bettor way. or in any other way , than
is provided by law. This moans in fact ,
that the city council can only give away
the city's rights on the avenue , and that
If any ono olsofiufl'uns damages , the state
law provides how this damage in lib t bo
settled , and thu council cannot supplant
a state law by an ordinance , It remains
for the city council to simply protect the
interests which the city has in the
avenue ,
The wholesale merchants and jobbers
nro a unit in asking that the right of way
bo given , Some of the heaviest houses
deolani that if they uro not given the
needed facilities for shipping , they will
bo compelled to move to Omaha. Ono of
the houses is already looking for a situ
in Oimilm , so that it may be in condition
to move quickly if this is not given , if
this house goes another , and probably
more that one. will surely foljow.
The citizens' committee claim that the
damage by the loss of wholesale business
will be greater than the damage caused to
property owners on the avenue. . They
claim that much of this damage is im
aginary , nml that if Council Binds , if it
does not improve its ad vantages , will soon
bo made up of poor men , and that instead
of n few suOering damages , all will suffer :
still more.
The Union Pacific says that it docs not
care to.como up the avenue. It declares :
that ( he citizens committee , in making its
compjamts baforo the Iowa railway com
missioners , laid great stress On tiie lack
of a freight depot for Iho accommodation
of the e shippers The.v proposed to give
Hie company the ncht of way , if the com
pany would conic nj ) with its tracks , and
build a depot. The company agiccd to

had como up. The company docs not
thjnk that HIP agreement has been com
plied with , but further than this , il menus
to thorn simply prohibition , to pass an
ordianec requiring the company to pay
such damages as the property owners
may ask before they oven gain the right
to lay a single rail. The company does
not care to accept such an ordinance at
all.

The board of trade , by 1's ' representa
tives , declares that it is not quite time to
make known nil the advantages which
will accrue to the city by giving Ihis right
of way. There is a project on foot for a
union depot up town , and the success of
this project depends largely on the Tenth
avenue one. If the latter falls , then a
union depot is surely killed for years to
come , at least. One member of the board
in throwing out these hints about a union
depot , was asked by the Bi.i : why the
union depot was not at once promised ,
out and out. "It is not an easy matter
to seeuro a union depot , it doc.s not de
pend .simply on the Union Pacific , or any
other one road. There are many tilings
to consider. I am not prepared to say
all that I believe , and all that I know of
the situation. I am willing to bet ,
though , that if Tenth avenue is given to
the Union j'aeilic. just as oilier streets
have-been given , the damages to be set
tled as other damages in such cases arc
settled , if Tenth avenue is thnsgiven up ,
I'll bet r. hundred dollars that willuu
two 3ears you will sec a union depot
being built here. "
It is , as admitted by all , a very Impor
tant matter for the council to determine.
Hardly one of the aldermen can feel like
taking the responsibility of doing any
thing to cheek or retard the boom that
has already struck Iho city.
The clti/.ens can hardlynbc blamed
for a feeling of uncertainty about relying
much on the whispering about some
great and mysterious improvements
which this Tenth avenue project will
calico to follow. If any one is to blame
for the lack of faith , it is those who have
banked on this faith before. When Union
avenue was given up to the Union Pa
cific , just such whispered assurances
wore given of some wonderful changes
being about to come The first of these
changes was the removal of the stock
yards lo Omaha , ( several times Hie
people of this city have been asked to
pin their faith lo some unseen something
in the future , and while tins city has , it is
true , gained sonic advantages , Mill the
expectations have not been reaii/.ed , and
disappointment has made them sus
picious.
The city , can , however , afford to lake
some chances , ll has to take chances ,
whether it will or not. It simply remains
as to which chances it will take. If the
giving of a right of way up Tenth avenue
will be for the city's interests , then it
should be given , even if that of itself docs
not constitute a full Hedged boom. Every
slop forward is a gain , whether it is a big
stride or a short one. As to the property
owners directly affected , tliev certainly
have Hie rights given them by the laws
of the state , under which they acquired ,
and under which they hold their property.
If Hie city can by ils council throw about
them any further protection , without in
juring the interests of the city as a wliolc ,
then the aldermen should surely do it. It
is urged witli much force , however , that

an injury to all alike for the
sake of giving a few property owners
more protection than tiie laws of llioir
own state afford them. It seems now
that the whole matter has been so thor
oughly discussed that there remains but
little to be said or done , it remaining to
seek some way of satisfying ; the property
owners , if they can be satisliod , and if
not for the council to act so as lo do the
greatest good for tbo city , the property
owners havinir their rights secured in any
event under the state law.
The ordinance , as now pending , cannot
pass , unless Aldermen Kellar , Hammerer
or Danforth change in opinion. They
want the property owners fuliy satisfied
before the right is given. The matter
will be brought up again neM Monday

The case of Thomas McFaddon ,
charged with the seduction of Maggie
llnggu , of Walnut , was yesterday
brought to a closc so far as the evidence
and tiio arguments were concerned.
Judge Aj lesworth reserved his decision
until to-day but intimated thai ho was
satislied that the evidence showed that
llm .young man promised to marry the
girl' , and that he hud been guilty of inti-
nmey with her. The point which the
court desired to consider was chielly
the question as 10 whether she was up to
the time of her alleged seduction of
chaste character or not. On llio part of
the defence a number ol wilues es had
been introduced to show that she had
acted immodestly , and been gu illy of in-
descrclions of the worst nature with oth
ers before the delcndanl was acquainted
with her.

has in abundance , He is preparing to
open the new boom season by starting
brick making by a new process , which
will doubtless prove a great success It
seems that there is no end to the now
plans and purposes of those who are
bound to be at thti front and keep abreast
of the growth of the cily the coming sea-
son.

" A boy. giving his name as Clem Fuller ,

an express stamp. His case was in
quired into ye-terday , but nothing could
lie learned to pinch him , and ho was re

Stuart Barton Slyter. son of W. C. and
Emma Slylor , died .yesterday morning ,
aged leu months. The funeral will be

Mrs. Hoagland as matron. The enter
prise will start in modestly , but is certain
to grow into an institution of much help
