When the qourt was convened yester day morning Judge llayward was on tlio bench , and listened to an argument by Judge Mason , of counsel for Dr. Doggo , Herold's alleged accomplice , on a tlo- nuirrer to the information. The position was the same as that taken by Mr. llurr in the Herald case. Itotli llerold and Doggo were nrehcntcd for trial by the district attorney , under the .statute pro viding a punislimcnt for thu fraudulent transfer or salts of poods with intent to cheat creditors. To make this charge good counsel contended that it was neces sary for the state to show that all actual transfer ot tlio coeds had been made.
