Ilo did not know when the bod. > was brought lo town. The doctor strangely i iiiil that when he learned the rumor that : i corpse had been discovered in the city ho unin-iiil the grave in which this man had been buried to be opened , and it was found thai the collin was open and the lid brokt-n. The doctor would notgivo tin1 name of the man because ho said his friond.4 lived in the state , and ho feared it might pain their feelings lo liavo them know anything about the desecration of their relative's grave. A further curious statement of the doctor's was that he had written to the man's friends , but that this was subsequent lo the linding of the body in the stable. In answer to some of the questions the doctor hositatcd before replying through the telephone , by which method' the interrogatories had been put. Another gentleman , who seemed to bo well ppstcil. < tavo the following theory of the alVair : lie believed Unit a regular svHlom of body switching had been car ried on between Ihu asylum and the med ical eollcgo of this city. His reasons lor thinking .so nro even now in a state of absolute demonstration. A physician , who claims to know a great deal about what is going on at the asylum , says that there are many abuses there , lie darkly hinted th.it tlie present instance vriio not Ihu lir.st time that bodies had been taken from the same .source. There is no doubt that the statement of Dr. Malhcwson to the reporter i.s 1111- jointcd , unconnected and unphiu.sjb.lu. Why ho should withhold tlm man's name whim , in almost the name breath , he. de clared that lie. had written to tlm man's relatives who , he wild , lived in Nebraska does not well appear. From all the sources and points already obtained it is almost a certainty that the body wa" taken by01110 unknown per son from the asylum to tlm barn , pre paratory to further removal to the medi cal eolk'go of the state university for pn'r- iioscB ot di.s-ection. This fact 'H well borne out by the presence of Dr. Mitehell nt the .niutifl room in the barn Saturday night. It is known that ho and thu clini cal doinonstrator were both aware of tin- fact llmt thu body would bo taken from thu iisvliim to the stable , where they were to get it and take il to llio college. Tim minutes of the coroner's and court proceedings and thu tiles of the local papers of that time have been ransacked , and the. tell-tale records have lir t anil signally caught .lack Nugent in either a mistake or a lie , and at the same time brought corroboration in a measure to I'ierson'o story. When fir.-t approached on Sunday with this convict's oonfosMon , Xtigont is said to have betrayed evident trepidation , but ho has since regained an equanimity of temper that fairly linf- lies inquiry. A reporter for the llr.i : he'd ' a long conversation with Nugent la-t evening , in which the latter contemptu ously scouted the whole story , and said he would niuki : it hot for Warden Nobes who , he says , fattened the whole lie. To wreak vengeance upon tin : warden , Nugent claims he has accessible a letter from Nobe.s' hand so compromising that it will cost his ollicial head if exposed. This letter Lon licorgo says 'he has in his possession , and claim * lie can use it to very good advantage in making Xobes squiivn. He further slates that he was once offered 200 for the letter by parties who wanted to conspire to Nobes' downfall , but refused the tender for rea sons he prefers 10 retain himself. To prove his innocence of the crime. Nugent could siib tantiatc an alibi. lie says that he left Omaha September 27 , 1SS1 , with a minstrel show and did not return until December 11 following , when he sold out his show. Local paper. * of that time chronicle his return to Omaha November ! , and lie might have been hero unob served' for -evernl days prior. Col. Smith was murdered on the night of November 4. Nugent says he never saw 1'ierson , the Nebraska eo'nvict , but by a strange coincidence there was concerned in the variety show business here with him in IsS'l u Julin Pierson , now in the Iowa penitentiary. The ( Jnited States district attorney , when asked yesterday jf under the circumstances he did not intend to arrest .luck Nugent , replied solely by venting his anger ai the prema ture publication of the confession and concluded with Hi'- statement thai lie iiad nothing to say. A big point scored in Jayor of the credit of 1'ierson 's story is brought out from Hie coroner's records. A man named Bunco , a little Swede boy and a po.-tal me.isongor ail swore thai , pas-ing the federal building at 11 o'clock on the fatal niglil , they heard two pistol shots from within. The evidence indicated that only one -hot had been lired and that from Col. Smith's own pistol , which lay at his feet partly thrust up his trou-urs leg. The testimony of those three man was never believed , but I'iert-on's confe-sion now conies to sustain it and solve thu my.sti-ry. IIu states thai after tiring the pistol shot which killed Colonel Smith , he Tilled his pockets and finding his revolver di charged it in tin * air and threw it at his victim's side to create the appearance of suicide. This random shot may have been the onu lodgi-tl in < liu lintel of the court room door and , although cnlirelv out of range , was accepted as the "ball which had passed through Smith's head.
