Seward , southeast corner Center and Eleventh , this evening , The fund is for repairing the church building. The price of Ice cream will bo 10 cents. The h MO ball management have failed to secure the Ptlckly Ash team of St , Louis to play the coming Sunday , and are now en deavoring to aosure the lied Oak club to play two games hera Saturday and Sunday. It is quite probable also that a game will be ar ranged between the U. P."a and the base ball club of Havorly'a minstrels , to tnko place Sunday , July 20. The four double-scull boats of the rowing association arrived hero Tuejday , while tha largo pleasure bingo Is expected hero to-day or to-morrow. This will complete the num ber of boats to ba ordered by the association 'or the present , though some of the members will order private boats of their own. Of the deceased , the llondricks County ( Ind. ) Republican says : John Reed Shannon died at his residence north of Now Winchester , last Saturday evening and was buried on the following Sunday. Mr. Shan non was a noble Boldler during the war , and while in the service of his country contracted a disease which was in all probability the cause of his death , lie was an upright man , a good neighbor , and respected and honored by all who know him , WARMER AND WARMER Grows tbo Fight Over the Smith Stock The IiateHt Fliaso of Iiltigktlon. The fight ever the Smith stock of dry goods still continues , Tuesday afternoon Lpwls Oolo , who holds under the sale made by Smith , brought in the district conrb his action In replevin to secure from Sheriff Miller the atock of goods. The replevin papers were issued late in the afternoon and placed In the hands of Coroner Drexel , that official bolng able to conduct such proceedings against the sheriff. The papers were served by Coroner Drexel In the afternoon , and ho took possession of the stock. Ho appointed Messrs. George Ames and D. J. Donahoo aa appraisers to make a re-valuation of the atock. All persona were then excluded from the atoro by Coroner Drexel except the watchman , the appraisers and their clork. The work of appraisement waa then conduotod with locked doora. A rumor became current toward evening that the appraisement R VO to the stock a valuation of ? 55,000. Immediately moaanroa were actively taken to throw suspicion upon the action of the apprais ers , because the amount of valuation was not up to that found by the attachment appraisers , Coroner Drexel was not sat isfied with the appraisement aa made , and rejected It , as well as the bond tendered dored him by Mr. Colo. Ho then appointed now appraisers. Moanwhllo the plaintiff In the replevin proceedings has removed the case Into the United States court. Now papers in replevin have been secured. Voiysuon In all probability Marshal Biorbower will step in and take possession and Cor oner Drexel trill atop out. The charge of improper practices In the matter of the appraisement by Messrs Amos and Donahi ( ) are mot by counter charges made by Mr. Cole and Mr. Lowy against the justice of the appralsemon made on the attachments. Those gentle * men charge that Smiths selling mark was taken by the appraisers aa the valao and that they acted under the direction of merchants in Omaha who wished to pat the value BO high that no bonds could bo given , and that thus the stock might bo kept ont of the market , These atatementa are In accordance with the story told by Messrs. John Dfiines , the man whose arrest created auch a tens 'ion last night on Douglas street , on account of the terrcfi : manner in whiohhettraggled and howled , waa fined $10 and coato. A man by the name of John Peace , who waa caught Monday in the act oi stealing a worklngman's dinner pall , waa discharged. It was explained that ho hid had no work to do for a long tlmo , and being very hungry had attempted the theft for which ho was jailed. Peabody vs the city o Omaha , a suit for $10,000 damages onac connt of street grading at the corner o Fourteenth and Jonea streets , done in 1873. The case ia similar in Its nature to u largo number of others which make the rulings of the court of general Importance portanco , and being nlao the plonoor case It Is very closely oontostod , Abou the most Important question involved Is whether benefits to property by reason of grading ttroots can bo offao in an action to recover damages as agalns the cost of changing the property so as to make U conform to the street grades This question Is ono concerning whlcl there has been a widely diversified difference once of opinion. It originally arose a the tlmo of the appraisement of damages by reason of the change of grade on Far nam street. The city attorney Oonnoll was called on then to glvo his opinion In the matter and ho hold that the benefits to property should bo taken into account , and considered as an offset to the damages , That is the question the attorneys tornoys in this particular case , who are Kennedy & Gilbert and W. R. Eedlck , for plaintiff , against W. J. Connell , the city attorney , for defendant , have beer arguing for the paitday , and waa dccldec by Judge Wakoloy. Ho hold that It was proper to consider special benefits re suiting from the grading of a street as against the coat , and ho instructed the jury that they might consider such bcno fits , as if , for Instance , rendering property orty desirable for business purposes which prior to the grading would have no value for such purpose. About fifteen mlnutoa after 5 o'clock Diatrlct Attorney Estollo finished the closing Argument , and Jndgo Neville delivered his charge to the jury. That body retired , and waa out abont half or three-quarters of an hour , when they re turned with a verdict of acquit tal for defendant on the grounds that ho had been proven to bo inaane. Ho agreed to pay for it by monthly Installments , and gave a mortgage which was never filed. "In Utah , and especially in Salt Lake , ' said Gon. Howard , in answer to a qnos tlon of the reporter , "I found things in a very unsettled stato.
