Capt. Hayes was discharged Saturday ,
the court holding that the prosecution ,
had not proved him to be the kind of a
vagrant charged in the information , bat
having brought other damaging testimony

filed , worded so as to cover a multitude
of sins , but virtually meaning the same
thing. The case was continued two
weeks , it being understood that if he
leaves the city it will not bo tried. It Is
