THE JUDICIAL CONTEST ,

As already stated in TUG DEC the
oraocratio committee of this judicial
iatrlct la urging that Judge Ajlesrrorth
hould contest the election of the ropub-
lean candidate , Judge Loofbourow , aud
ppointcd n committee to wait upon
udgo Locfborow and ascortiin if ho
would not Bgrco to nome statement of
act * , to bo presented and passed upon by
n court of contest , without going into
ho troublesome work of introducing
witnesses and fighting every bit of testimony
mony , word by word. The committee
ms waited upon Judge Loofbonrow and
aid the matter before him , but did not
ircsa for an Immcdiato reply , courteously
ioucoding that ho would naturally want
a Uttlo ttmo to think the matter over.
Fho commlttoo got no definite reply to
.ho proposition , but got intimations
, hat did not awaken much hope for n fa
vorable reply , when it should come. Of
conrsu Judge Loofbourow is not axious
'or n contest. Ho is declared elected.

some statement of facto to present for
court of contest , it is understood that ho
ooks upon the proposition as absurd.
The situation to his mind acorns to bo lu
subatanco that all n conrt of contest
would pass upon would bo which candi
date really had the most votes. To agree
on n statement of facts would thoroioro
bo to agree upon which candidate had the
most votes , and if an agreement was
reached on tins there would bo no need
of n court of contest. The contest seems
to bo really on the corrected returns of
[ 3rcon county , by which n majority of I'.Ms '
[ inured out in Judge Loofbourow's favor.
IIo and bla friondo say that to ngreo that
ho did not receive these votes , would bo
to agrco that Judge Aylosworth was
elected , and thence no court of contest
would ba nnoded. To agree that Judge
Louf bourow did really receive those votes
would also do away with the necessity of
a contest.
Un the other hand Judge Aylesworth
and his friends put it thus : The ques
tion ia not : "Dldjtho parties who opened
the ballot boxes , days after the election ,
in Grant , Scranton , and Jefferson
townships , in Greene county
actually chnuqo or substitute
ballots' ' ) " The real question is
"Did they unlawfully take the opportu
nity to manipulate the ballots ? " and II
they did take such an opportunity , though
they may have loft them as they wore ,
the law is clear that an official result
once made and declared , before such an
opportunity was unlawfully taken ,
must stand as against one made up , after
the ballot box ' 'us unlawfully been tam
pered with , oven if by doing so Innocent
an act as merely counting the votes over.
What they want-to agree on is the facts
concerning the revision of the votn in
Green county , and present the same document -
umont and questions to a court of con
test , which wore presented to the state
board of canvassers. In other words
they want the court of contest to simply
review the action of the board.
Both sides agree that they do not wish ,
to'enter a contest where there will bo a
hunt after illegal votes. Such a contest ,
however , it might result , would be un
satisfactory , or it would bo simply the
question of which party could do the
best hunting , and got the largest number
of cases.
'Judge Ayleaworth himself does no
seem anxious for any contest , but the
anxiety seems more on the part of those
who have an Interest In having Judge
Aylesworth vacate the superior bench seas
as to glvo a chance for some other dom
osrat to rise.

An Interesting Episode Concerning
Scalpers' Tickets.
By the recent narcoment entered into
by the pool linen , which went into effect
December 8 , the roods are compelled to
redeem at full price all tickets sold by
them at cut rates. Gnnoral Agenf
Keith , of the Chicago , Burlington &
Quincy , thinking to got the whiprow on
eomo of the other companies , secured
sixteen Chicago , Milwaukee & St. Pan'
tickets , issued about a year aud a hall
ago , and two Wabash tickets leaned in
1880 , and presented these for redemp
tion. The companies refused to
rcduom , the St. Paul claimIng -
Ing that the agreement die
not cover tickets sold before December
8th , and the Wabash tickets refused bo
cauao the courts have decided that these
old tickets , issued before thoappointmem
of a receiver , were not to bo recognized.
The railway men think that the joke is
on Keith , claiming that ho has invested
about § 200 in tickets , which are not redeemable -
deomablo under the agreement.
