They continue further that in the years'1878 , 187,1880 ( ) , 1881 and 1882 certain taxes were levied upon their lands by the proper ollicera of those counties. Those lands , which amount to thousands of acres , are specifically de scribed in exhibits to the petitions. The plaintiff alleges that when the above taxes were lex led no patents had been issued by the government to those lands , _ nor had the costs of surveying , aeclocting and convoying boon paid , nor had the register or receiver at the land oflicoa received their foes for entering them upon the books of their ollicca. The plaintiff attempts to bring its case under that decision of the United States supreme court which decided lands not laxablo until a patent to thorn had boon issued by the government. An injunc tion is prayed for to restrain the do- fcudanta from encumbering , charging or convoying thcso lands so taxed , or in any way casting n cloud upon the title of the I nion Pacific railroad to them.
