They cmno very near to doing it now , John Leonard , "tho kid" whom Ofiicor Dunn shot the other night , was before the police court yesterday , but the charge of vagrancy was dropped on con dition that ho would leave the city. "Tho kid" has the reputation of being a bad crook , but is lot off easy , while some of the honest sort of mon , who are un fortunate enough to got drunk , are compelled polled to pay a fine or go to jail. Walker , was on trial before Justice Vaughan yesterday on a charge ot pick ing pockets , the victim being Mr. Walsh , of Mills county , who in the crowd on the corner of Bryant street and Broadway lost § 10 40. The bond of J. II , Wheeler , as po- llcoman , was presented and approved. Properly owners complained of the horrible condition of Tenth avenue between twoon Third and Twelfth streets , and petitioned to have the avenue filled up to grade and a sidewalk laid along ono sido. Referred. A petition was proaentod or a aide walk on Third street from Ninth avenue to Sixteenth avonuo. Referred. The bill of P. J. AIcMahon & Co. , for S305 for abstracts furnished the city , for making paving assessments was allowed. Aid. Mynsltor , of committee on streets and alloys reported in favor of granting petition for sidewalk on Lincoln avenue ; also in favor of granting that In regard to sidewalk in front of Lot 2 , Block C , Grimes addition , in favor of filling lower Broadway from Stroolsvillo to the pum ping works to as great an extent as the council thought best ; in favor of allow ing the Egyptian sidewalk to bo laid on lower Broadway as asked for by John Short ot nl. : in favor of allowing the cement - mont sidewalk In front of No. 714 Sixth street nnd in that vicinity to remain as low for the present , although a little jolow grade ; also in favor of asking the city attorney to look after the proposed revising of the license ordinance ; also , hat the committee had soon the Supt. of the government building hero , in re gard to the curbing taken by the city , ind that lip was willing to settle the mat ter by having the city olthor replace the curbing or pay for it , at any time before ; ho i building should bo completed. The report was concurred in. Alderman Siodoniopf at this stage of the proceedings entered the council chambor. Alderman Hynator called attention tea a circular ho had received about a street ; rador , which ho thought it would bo well to try hero. lie was instructed to correspond with the manufacturers. The mayor road a letter from Judge Dillon aoknowlodging the receipt of § 250 : or consultation foe , and thanking the city fur its kindly expression to him , Aid. McMahou reported in favor of nl- owing the petition of Mrs. Royal Amy , isklng to bo relieved of paying taxes on lor homestead , aho claiming to bo unable , o pay thorn. Seine of the aldermen ob- ootod , the homestead being a valuable ono. The motion not to concur in the report was carried , nldormon Hynstor and BIpMahon nlono voting in favor of remitting the taxes. The finance committee reported in fa vor of reducing the personal assessment f Joseph Knotts , on the strength of the attor'n allidayit , concurred In. The attention of the council was called > y Harry Birkinblno to an article pub- iahod in the Evening Globe , and copied nto The Investigator , an insurance pa- ier , claiming that this city was without iron protection , that the hose was rotten , hoiro / alarm unreliable , etc. The chief engineer , committee on fires , nnd city onIc lorlc were instructed to ' gather data and aflidavita showing the falsity of the state ment made by "tho oflicial organ. " * The city marshal was instructed to on- orco the gasolineordinance. . The city attorney was instructed to draw an ordinance requiring the hotel to irovido fire escapes. The city attorney reported that in case of the vacancy caused by Judge James' resignation it was necessary to hold a special election. Aid. Mynstor moved to postpone the matter until the next mooting , rfo sec ond. ond.Aid. Aid. Sicdontopf said that the citizens of the Fourth ward wanted au alderman and did not want any dplny. The city attorney expressed it as his opinion that the council could not go on with business , if there was a vacancy , unless it took otops to fill the vacancy. nt The city attorney further expressed it as his opinion that there already existed vacancy. Aid. Siodontopf moved that as Judge James had not yet filed an apology , that hia resignation boaccoptod. Aid. Mynstor moved to adjourn. Aid , Keating seconded it. The talk was roauinod without the motion being voted on. Aid. Mynstor did not agree with the city attorney. Ho did not think there was any vacancy un , til there waa n formal acceptance of the . resignation. The concurring in the re port of the committee favoring the ac ceptance of the resignation , was not Bulllciont. This report was hunted up and road again. The motion to adjourn was withdrawn but renewed it , and would not allow Aid , Siodontopf to road the motion ho had prepared on Judge Jones resignation. The motion to adjourn was carried. Aid , Siodontopf and Aid , McMuhon voting no , Aid , h'iodontopf notified the council of that ho would not take nny part in the transaction of business until stops were takou in the James matter. The mayor notified the council that ho would call a apucial mooting for Saturday evening. The motion which Aid Siodontopf prepared - pared but which Aid. Attorneys Soars and llhodnbock iftor waiting until nearly noon , for the appearance of Lacy sr hia attorney George Holmes , insisted on having the bond of $300 de clared forfeited. They insisted that tha : aso had boon trifled with long enough , that Holmes had boasted that it shall not bo brought to trial , and that Judge Aylcsworth ought to face the music. Mr. Ilolmoa was sent for and on his appear- inco ho declared that Lacy was willing to lave an examination before Judge Ayls- worth , but not before Justice Schurz. If they insisted on a hearing before Schurz do would take a change of venue , and Llio eager attorneys for the state shall ; an nothing. Ho said ho waa willing to iiavo the caao taken up at any time when J ndgo Ayloaworth could attend to it , and intimated that after bothering Capt. Hays and the attorneys so long ao possible , Lacy shall waive examination , if that would be the end oi it. Soars de clared that if the prosecutor could not jot justice in town that ho would hlro liimsolf to some country justice , and commence cases there , and predicted very confidentially that ho would yet convict Lacy. There was a good deal of plain talk , but J ustico Schurz concluded t to put his finger in the pie , knowing .hat n change of vonno would bo taken 'roin him at onco. Ho decided to lot .ho matter rest with Judge Ayleaworth .nforo whom the case was started. It is said that Capt. Hays who started .he case will bo led a merry dance before lie gets any great satisfaction out of it , and the wcy in which the matter opens up indicates that this prediction will irovo truo.
