The ovidondo upon many of the vital facts was greatly at variance , oven so much eo that charges of perjury were openly inado byjattornoys employed in the ] cato. The great point to bo determined was whether or not Oflicor Donovan , not hold ing a warrant , had authority to moko the arrest of a party not caught in the com mission of an offence without a mandate from a court of competent jurisdiction. The preponderance of testimony wont to show that Oflicor Donovan catno into Spocht's manufactory to arrest the man Howe , who it was said , had thrown the material from the building , by which Price had been hurt. Upon going into the store , ho was asked by Spocht , the pro prlotor , if ho had a warrant for his em ployo's arrest , and upon his reply that ho had not , was forced to leave the promises "by the defendant and his laborers. Ho then called to his assistance Oflicor Bnr- dlck , by whoso aid Spocht and Hone wore arrested and taken to jail , The principal argument for the defense was made by Gen. Oowlu , who denoun ced the olllcers for their shamotul treat ment of the defendants. Ho charged them with brutality and said their "cheeks should rankln with shame for this. Inhuman act upon a poor innocent laWror. " Mr. Cornell closed for the prosecution J adgo Bonoko in deciding the case said It was not a difficult ono for him to form his judgment upon , holding that it was thcdvrty of Officer Donovan tohavo arrested armed with a warrant for the arrest of Hone , and when ho was not , Mr. Spocht had a perfect right to eject him from his premises , using only sufficient force to bring about iho desired end citing 'Bishop on Criminal Law" to support his position. In the case of Hone the judge cited the city ordinance which provides that a police officer has no authority to make an arrest unless ho seas the party committ Ing the act , in open view. The court liold that as Oflicor Donovan did not ar < rest Hone while resisting him , ho should lia\o lodged a complaint against him and proceeded to arrest him by virtue of a Tvarrr.Qt. The Judge accordingly dismissed the complaints and discharged the defend ants. SOME POK THE HOMELESS , An Unterpriso "Which Deserves En. courngonicnt. The ladles of Omaha are now interest ing themselves in a work which appeals to the sympathies of all classes of people , viz : the building of a homo for destitute and friendless women and children , an institution long needed in this city. They nave boon renting rooms for this purpose , in the City Bull building , and their experience during the past nix mouths has shown the absolute necessity for an establishment of this character and has aho shown that their present quar ters are entirely inadquato to the needs of the society a chartered organization of which Mrs. Z. B. Knight is president. The purpose of the ladies is to raise a fund sufficient to build a house , hoping to secure a city lot for a site , and arrange for employment for destitute women who are able to work , by the fitting up of a laundry and pro viding other moans to enable the institu tion to become Golf-supporting in time. Subscription lists are being circulated , and donations from 25 cents up are received. The city police have found the present homo of great practical value in sflording shelter temporarily to scores of woithy people who appeal to them for help. Heretofore the city jail was the only refuge for this class , and it is a dis- graso to our people that such has been the caco so long. In view ol the practical use to which the money is to bo applied the ladies should bo heartily encouraged in their en terprise. * MANNING'S ' NISTAKE , lie Is rAldino [ ( oljoavo tlio City , nnil Goes to Kansas , The robbery of Manning , the conduc tor , in his room In iho Millard hotel , will not bo forgotten for some time on ac count of the daring and fiucccssful man ner in which it was effected. After the examination of Ilondorahott , Badger and Clark for committing the offense , ending in their discharge , the complainant was approached by a block- iratchman of the city who offered to BOO that his watch was delivered to him for $110. Manning agreed to give that amount for its return , and upon its pay ment ho recovered his watch. Manning felt very sere over his loss and determined to bring the offenders to justice , Ho employed the services of General Cowon and Detective Noligh to look afcer the case for him. The matter ha If progressed ao far that a complaint was drawn up against certain suspected parties. When this fact became known negotiations wore entered into between Manning and a gang of roughs In this city by third parties. It was finally agreed between the contracting parties that Manning should do nothing further against them upon the payment to him of § 150 , and that ho should leave at once tor Kansas , his homo. It was stipulated that the money should bo paid in the Bluff * . Mr. Drawbaugh is of small stature with a bald head , ruddy face , aquiline nose , wears u mustache that is nonrl ; gray , and has a quick , nervous , rostlos manner. Ho moved about impatiently as Mr. Lysandor Hill , his counsel , detailed tailed the history of this inventor , whlcli like that ot many mon of his class , t story of poverty , of hardship and a con < slant battle for fortune. In the speech of Mr. Hill , the follow ing facts in reference to Mr.Drawbaugh's lifo was brought out : IIo was born in 1827 , in the village of Kborling's Mills , Milltown , Cumberland county , Pa.
