Soars , Esq , nppoatod for the plainlitr ,
and Ooorgo A. Holmes , Esq. , for the
defendants. The cases were argued nt
length and authorities cited , after which
the judge took the cases under advise
ment , the points raised being new onus ,
and the importance of the matter justify
ing careful thought nnd oxauiina
tion. It was thought by some
that Judge Lyman would put oil
rendering a decision until after tlio com *
ing election in which ho is so much in
terested , but he forced the ticklish ques
tion yesterday , giving as his decision that
the injunction asked for shall not bo
granted.
His chief reasons for refusing the in
junction were two , ono because of defects
in the petition , the other because of the
unconstitutiouality of the proceeding.
The more technical faults in the papers
are of little interest to the public , and
little stress was placed on these by the
judge himself. The main question on
which the matter wasdocidod , waswhoth-
or it was constitutional to issue an
injunction restraining a man from
violating such a Inw'/ / The judge hold
in effect that as it would not be in accord
ance with the constitution to issue an
injunction restraining a man from steal
ing a horao , ao an injunction could not
issue restraining a man from committing
an oflonso , which , under the prohibitory
law would cause htm to bo fined or im
prisoned.
Undo Tom's cabin , as played last night
at tlio opera house , was a miserable fail
ure , Topsy and the jubilee singers being
all that was any way near good.

tured , by the report that ho lost ? 1200
at faro Saturday , but by some nimblc-
fingered follow slipping it out of his vest
pocket. Lacy always has ono or moro of
these lat rolls about his person , and that ,
too , oftentimes wtion follows of easy consci
ence are near him. Hut yesterday someone
ono took advantage of him. The police at
once commenced a hunt , and two parties ,
against whom suspicions rested , were
searched , but the missing money was not
