The Affair Occurs Sunday After

Tlio Jjtttlo Exchange of Four or Flvo

Whl to Woman ,
Yesterday afternoon between four fine
five o'clock n soldlor and a colored man
who had eomo differences to adjust wont
Into the alloy between Douglaa and Dodge
and Eighth and Ninth streets to settle
their dispute by a fistio encounter. The
mon were followed to the lighting grounds
by a largo number of the donizonsof that
part of tlio city , who wont to witness tlio
affray. The fight was progressing warm'
ly when the loud reports of
FOUR PISTOL SHOTS
were hoard , and the affrighted spectators
Baw a polorod man run from the crowd
toward the river to escape apprehension
by the officers. Shortly afterward a
great burly negro assisted by several
companions came up the alloy blooding
from a wound in the abdomen. The
iloeing man was a negro named William
Davis and the wounded ono was James
Flowers , whoso name does not como into
print tor the Brat time in Omaha from
this affray. It appears that those two
men had boon
THREATENING TO KILL ONE ANOTHER
on sight for uayoral days , owinn to aomo
difficulty growing out of each one's rela
tions with a white woman who until yes
terday lived at a notorious disorderly
liouao on Eleventh"utroot and Capitol
avenue run by a woman named Ellen
Mitchell. Yesterday the cause of their
trouble moved into a house near the cor
ner of Ninth and Dodge and both mon
being in that vicinity followed the com-
- batanta into the alley. Some of thsso
who were present say that Davis and
Flowers happening to moot , the former
deliberately drew out his revolver and
being only two or three paces distance
fired , the bail hitting the latter just
below the stomach. Davis fired
again , but the bullet flow wide 'of its
mark. Flowers seized Davis and wrench
ed the pistol from his grasp , when the
, Iatter turned and fled. The wounded
man followed Davis and fired two shots
at him but without effect. The piatol
reports brought out
.SEVEKAL HUNDRED PEOPLE , "
mostly women and children , who , when
they saw what had been done gave vent
to their fright by screams and cries.
Officers Morryatcm and Bellamy , who
i -wore close by , followed Davis down
through the bottoms. The lleaing man
1 took down the railroad track and hid in
an empty shed near the Seventh street
i railroad crossing ) whore ho waa found by
the police. He was taken to the city
jail and the charge of shooting with in
tent to kill Hot'opposite hia name.
i The wounded man waa helped into a
{ carriage and taken to No. 203 North
Eleventh street. Drs. Lee and Ayrea ,
who had been summoned , soon appeared.
Flowers was found to have received
A DANGEROUS WOUND
from a 44-calibro revolver , on the right
aide of the median line , two inches above
the groin. The ball took a downward
imd outward course , and buried itself In
the muscles of the thigh , passing
within a half inch of the femoral
rtory. The surgeons probed for
the ball , but were unable to extract it.
The wound ia considered by the attend
ing physicians not fatal , though a very
aerious ono. Flowers stated to the police
officers that three or four of those present
saw a yonug man named Martin Konnol-
ly hand Davis the revolver with which
ho did the shooting. Upon
Ids statement Connelly was arrested
on Tenth street by Officer ( Jormick. Ho
was kept through the night in the city
jail charged with being an accomplice.
He douies any complicity In the affair.
Davis' story , as related hi the city jail
last evening , la entirely different from
that related above , who says that upon
meeting Flowers in the alloy ho ( Flowers -
ors ) made a feint as if to draw a revolver
from his pocket. The prisoner said the
wounded man compelled him to
THHOW UP HIS HANDS
Saturday evening by drawing
a pistol upon him , and that ho thought
ho was about to do it again , nnd whip
ping out his revolver fired at FJowors in
solf-dofoneo. No piatol , however , was
upon the wounded man when ho was
searched. Davis says ho bought the pistol
tel of a pawnbroker only yesterday fore *
noon , and purchased it for the purpose
of defending himself from an attack by
Flowers
The prlfionor bears the reputation
among his race of being a lurd wurkiug ,
honest man who never before has been
: v in any trouble. Flowers ia looked upon
" " by many of the colored people o s being
a desperate character. It waa cnly two
weeks ago last night that Flowers was
arrested and afterward fined f .ir shooting
at a colored brother named D xon while
in a state of intoxication at Dick Gurry's
old place on Tenth street.
The first shipment of cattle for the new
stock yards arrived yesterday , being thirty
cor loads from Mr , Swau't range in Wyom
ing.

HiB Art.
Ooronor Maul hold an inquest Satur
day evening on the body of Elijah Fields ,
the colored bartender from Kansas City ,
who made the desperate attempt ton
days ago to take hla wife with him in hla
tragic ending. A number
of witnesses were examined , the
testimony of each going to aliovr
his desperate design to accomplish the
double tragedy or compel his wife to re-
j , turn to him , Mra. Field's testimony to
V JT her phyaician was repeated to the coron-
'iu ' ' er * ° * no ofloot that her husband had
XufeCvisited * her proylous to the tragedy and
jv threatened to kill her If she would not
"f" " live him , On the latal Friday ho came
to the house again and called to her to
come out She replied "I'm afraid to. "
JIo went up the atops from the yard
to the kitchen and bog an firing at
her. Pho waa hit twice and then
throw up both hands and implored him
to shoot no more. Instead , ho fired an
other shot which cut off part of one
finger. She rushed out of the kitchen to
thostreet for help and her husband entered -
tered it and turned the revolver
upon himself. The jury verdict of
suicide waa in accordance with the facts.
The body waa snnt yesterday to Loavon-

The case of the stale of Nebraska vs.
T. May , O : W. Raworth , M. J. Roche ,
John Byora nnd Mr. Sutor , nil of Omaha ,
on n charge of assault with intent to
commit rape , was called at Genoa last
Monday , and a change to Fullerton -
ton taken. M , V. Moudy andF. W.
Critchfiold appeared for the prosecution
and J. M. Thurston and George D ,
Moiklojohn for the defense. The
case was taken before Harry Magoon on
Tuesday , nnd as usual iu such cases the
; ho court house was full of mon and boys ,
curious and eager to hoar the alckoninf
details of the horrible atrocity. Twelve
witnesses appeared for the state , olovor
of whom were Indian girls , nnh all agreed
that they Troro bathing in the turbid
waters of the Bonvor , n few rods below
the railroad bridge on the day nnd date
of the alleged assault ; that the
rain stopped nt the bridge
to take water , and that two cowboys
who were on the train , and n largo man ,
whoso identity waa a little mixed , np-
> roaohod and exchanged few words
Tith the sun-browned beauties of the
orost , and the assistant matron of the
school , Miss Steele , vrho superintended
.ho ceremonies. But ono out of the
twelve testified to hearing any indecent
expression from the mon , and she was
unable to identify the offender.
After all the testimony had boon given
> y the prosecution , the defense moved
a dismiss on the ground that the state
tad failed to make a case. The motion
was of course granted , and the prisoners
liamissod. The gentlemen against whom
he suit was brought are mon of families ,
md are respected in the community
n which they live , and the testi-
nony did not show that they had
[ ono anything ont of the way in the.
matter. Probably the cowboys were a1
ittlo bold and did wrong in going near
(
ho place whore the girls were bathing ;
> ut it would have boon difficult to run1
ho train out of Its accustomed course'to
avoid coming in near proximity to the
> athera. It Has , over been suggested
hat a loss conspicuous sand-bot
tomed bath tub might have boon
elected , so if there really , is
ny ono to blame , it is not entirely ono- ,
idod. It seems very unfortunate that
o trivial a matter should be brought into
ourt , and thus add to the burdens of the
ax payers without doing any good excent ,
o exonerate the accused from any evil
itentions. Colonel Tappan , like the
rontleman wo believe him to bo , ac-
aiowledgcd that h'o had been misled in
, he matter , and asked the pardon of the
; rain boys forthaving brought an unwar-
anted suit against them.

THE TEXAS FEVER ,
A Trntlifiil Statement as to Lsses : of
Cattle ia the Vicinity on
Brady Island ,
Some Interesting Inrornmtlon Con *
corning tlio Dlsonao.
MAXWELL , Neb , , August 8.
Editor Orrwha UKE.
I notice In your issue of the 7th itiit.
nn Item headed "An end of the plagu
and the Texas cattle fever gradually dtt
appearing from Nebraska stock , losao
greatly exaggerated , " otc. The nboro report
port ia said to taken from John A. Mo
Shane , who started with n herd froir
Ogallala numbering sixty head , and ayi
fifty-throe out of the sixty are now dead
I don't ' know anything about the Ogallala
cattle but it ia said Mr. Soarls had
seventy head of graded cattle and I learn
from good authority that all of those are
dead. Bull am speaking of 'Maxwell
vicinity. In the first place , Mr. McSliano
has failed to put in an appearance at this
point , therefore I beg leave to correct his
errors. In the statement ho haa
made , concerning the losses and
cause of the disease amongst
the cattle hero and at Brady's Island
ho says Lynch and McOullough lost forty
head each out of herds of not great size.
True , Lynch had only forty head all told ,
thirty-oicht died. Ho has two skim
milk calves left. But McCullough had
700 head and 200 of them are dead at
ihis date and lots more in a dying condi
; ion. Ho also says out of Plumer'a herd
of 300 between fifty and sixty head have
lied. I would say to McShauo ho had
) otter visit Maxwell before making anther -
> thor report and got posted concerning
; ho cattle interest hero.
Plumor & Jowott had 1,500 head bo-
'ore this epidemic sot in 52 died last
Sunday out of thatgnumber , and to-night
hey count 200 hides taken oil' dead
eattlo from the "P" biand , pastured
rom four to ton miles northeast of Max-
roll , instead of along the line of the
Jnlon Pacific road , as Mr. McShano
states. This shows how utterly ignorant
.his . gentleman is when ho says all of
.hose cattle wore shipped in from
vostorn Iowa or eastern Nebraska ,
svhon as a matter of fact not one head of
.hoso cattle were shipped in hero except
JO head of cows ho speaks of belonging to
3roon & Burke , seven of which died a
ow days ago , south of the Platte river.
Chose were culled by Mr. McShano ,
, nd Mr. Burke left thorn at Brady
island , where they contracted the
llsoaso from the Rankin herd , shipped
rom Texas and unloaded at Brady Is-
and on the 27th day of last May. Of
course Methane's old cows were not to
ascapo because they came from Blair , nny
nero than the native cattle raised hero ,
> elonging to several parties , besides those
.foremontionod. Jeremiah Snyder has
est CO head out of 100 , George Roberts
30 head out of 250 , and P. F. Dolan 25
jut of 150 , Dolan has 31)0 ) head in a pas-
uro that did not como in contact with
ho trail of the lUnkin
lord , and are free from ; the disease as are
also several small herds in this vicinty ,
; hat wore not exposed to the trail of the
tlankin herd , which is proof positive that
the disease was contracted from the afore
said Rankin cattle instead of Western
[ owa and Eastern Nebraska herds , as in
timated by Mr. McShano in his partiou-
ar phase where ho says none but those
Tom the above points were infected with
the disease. This is not only absurd but
idiculous on the whole , and shows how
gnorant he is in the matter.
It ia well known that the Plumor
3ros. were extonsire stock raisers , and
s now known as the firm of Plumer &
Fowett. John McCollough has boon in
the cattle business the last twelve
roars ; also Dr. A. L. Flict , and others
oo numerous to mention , whoso cattle
, ro on a well matured range north of
Brady Island station , whore the
Tranklin herd was unloaded from cars ,
ind driven out on this same range ,
ningling in with the above herds , and
is is proven by Professor Hopkins , vet
erinarian of Wyoming territory , who
rcrifios that the Texas cattle will convoy
ho disease in thnir system and although
pparently well , and will
envoy the disease to any
lorthorn cattle they como in contact
rrith. This Rankin herd not only inocu-
atcd our native herds hero with the dis-
aso , but they also infected them with
ho Texas wood tick. Cattle that are
iok and dying with'tho disease are liter-
lly covered with those ticks , a thing
lever known to exist in this locality be-
oro. We now believe in Mr. Hopkin's
hoory and find his statement true wlinro
10 says ne native herd will not carry
ho disease to another native herd. This
jausoa a more quiet fooling in the com
munity , as wo are in hopes of saving the
tvttlo that did not come in contact with
ho through Toxans.
Tlioro were about 2,500 head exposed
o the disease on this range , vrhero
ho men in charge of the Rankin herd
iuld thorn for several days to rest and
ocruit up before driving on their own
ango , which goes to show that they lost
ho virus in this vicinity before they
were driven off , thereby , perhaps , saving
> oth 'Rankin's own herd , and all herds ;
idjoining his range , including Mr ,
tratt'a and others. But I assure you the
ossos hero are suppressed more than
exaggerated. Out of the above number
of cattle there are at least 700 head dead ,
and no sign of its letting up ,
ilthough not dying as fast as they did
ast week.
1 would write more on this subject ,
3Ut it might tire your patience , and per-
laps would destroy , or convoy it to the
wosto basket , but there is no use in sup
pressing the truth of the matter , as it is
Toll known that the disease ia not con
tagious amongst native cattle , and only
.hose exposed to the thorough Texans
will bo liable to infection , and as you bad
no true report of the disease since it
started I would bo pleased to BOO it in
> riut for the benefit of stockmen at largo.
