Ratikin three or four months ago opened a store on lower Broadway with n Block a atock of produce , consisting of , perhaps , a quart of apples and a pint ol peanuts at the eamo time his wife opened a boarding house inthesamostoroj by porflovorenco and a close watch to bus- inocs they have increased their business until Mrs. R. now has a very nlco trade in the produce line. Gowdy , was a sad shock to many in this city , where ho was so well known and so highly esteemed. The first telegram was simply a brief an nouncement of the fact , and the s d news wont up and down the streets al most as swiftly ai if It had passed along the wire , for all know Mr. Gowdy and all were alike shocked and saddened. IIo had not boon in good health for some time , and has lately been travailing somewhat , in the hopa of bettering it. IIo recently to 3k a trip east , and has nlnco then been DII a brief trip north. Monday evening ! io started for Denver in company with Prank Cook , and the first news received of him since his loavotaking was the sad .ologrnin from Mr. Cook yesterday morn ing stating that ho had boun killed by the cars at North Plalto. The train stopped there for breakfast , and it ap peared that Mr. Goudy , in boarding the cars again , fell beneath the wheels. Mr. Gowdy had lived here about seven roars , having boon connected with the oal estate , loan and banking house of Uurnham , 1'ulluya it Co. , and for the last four years a member of that firm , EIo was HI years of ago , and a young nan of good character and most excellent niainoBS ability. Few of his ago gave so enviable a reputation for integrity and ability in business , and outside as well as inside thu ofiico , ho was noted for his courteous , kindhoartodgenialraannors , so .hat ho fast made of his acquaintances true rionds. Do was an unmarried man and lis parents are both gone before , but ho ins three brothers and two sisters upon vhom the blow will fall most heavily , lis homo was formerly at Xoina , Ohio , vhoro ono brother and sister livo. The question of how tlio Tilling of the atroota should bo filled has long agitated the minds of the council and of the prop , orty owners of this city. The council instead - stead of improving the opportunity pro. sontod it a long time ago , of carrying the question directly to the supreme court , and having it decided promptly nnd before - fore much work was done , took the mat ter in its own hands , and wont right nlono regardless of results. The uncer tainty felt as to how and when the pay would come caused contractors in bidding - ding to cover this uncertainty by n mar- Bin so that the amount per cubic yard for filling hna bocn from twonly-fivo to thirty , five pnr cent moro than the same could hftvo boon bid for where there was such uncertainty. The auit of Boccroft vs. the city wtin started as a test of the question whether the city had the right to charge this atroot filling up to the abutting property , The city won in the lower court , but now comes the news that the supreme court has reversed this decision. While this supreme court decision has not been re ceived hero In full , yet the fooling is that ita effect will bo to force the city to pay for street filling out of the general funds of the city instead of taxing it up to abutting property. If that is the elfcct of the decision it n ill causa a fearfully muddled and per * plozcd condition of city linnncos. There is nbout 8125,000 of work , which hw bucn tlcno by the special assessment system , nnd if the court holds that this must bo paid for out of the general fund , ona can easily irnatino ; in what n condi tion the city will find itself. There ara some who have bought up the Assessment certificates issued against thoT property , nt n liberal discount , thinking that if the courts should finally hold that the property abutting the street filling must bo specially taxed , then they would have their asscssmnnta all paid , saving the cish discount nt the sarao time , and that if the court hold that the city must pay for the street filling then then would present their assessment certificates , and draw the full fncp value , thus mak ing a handsome margin. Jf the city , as seems from this decision , has to pay tor nil the street filling out of the general fund , it will therefore bo compelled to pay about $125,000 for work which it could have had done for proba bly $90,000 for cash , n rather expensive amount to pay , nnd nil on account of the dilatorincaa of the old council In ascertaining what was surely legal and what was not. City Attorney Holmes on being asked about the matter yesterday said ho could express no opinion on it until ho saw iust what the decision was , rovlowinz the Bancroft caso. It may have boon de cided on Homo moro technicality , or oven on the pleadings nnd not a decision on the real inoritn of the question. If it wns some such decision on tochicalitics it would effect nothing. Some of the council seem to think that there will bo a ro-hoariog or aomo other point gained which will ultimately result m maintaining the present system of special assessments. Judge James says that the decision only affects the question , that of the city's liability. Of that ho has no doubt any of the time , as the city makes the contract , but even if it is held that the city is liable to the contractor , the city may in turn collect of the owners of abutting property by special assessment , nnd that right is not aftocted by the decision , Bushnoll sells railroad tickets cheap to all points.
