this continent , where sporting men hold
forth.
Dan Allen wiw born at Folia Mills ,
Jefferson county , Now York , in April ,
1830. At an early ngo ho commenced
work upon the Erie canal. After remain
ini { tliuro n few yoata ho wont to work on
the Michigan canal in Illinois. Ho wont
from there to stonmboatin ) ; . Later , ho
upuncd a saloon in Puoriu , Illinois , which
place ho run but n short tiino , wlion ho
bought n steamboat of his own. Ilo run
this boat about thrco years , during which
time ho madu coimiilorttblu nionty. In
18(10 ( ho came to Omaha tind opened a
saloon. After this ho opened n faro bank.
Ho wns the proprietor ot iiRiiinbling house
in this city for oror thirteen yoara. About
eight yeaia ago ho was uttauked with kid
ney trouble , from which ho never recov
ered. List Juno ho went ttnrious
places in search of relief , but found it
not , and returned to this city in Septem
ber to dio. Since his return ho was con-
lined to his bed , excepting a lew days in
January , when ho VMS able to bo nround.
At this time ho contracted u severe cold
which terminated in pneumonia. From
this came consumption which caused his
death Saturday morning at 0 o'clock.
D.m Allen was always known us a fair
and eiiiiaro man in his business , and was
honored by all his associates and friends.
Ilia word was always regarded as good as
hij note and all were ever ready to take
it. Ho was liberal nt all times and never
needed asking todonato to any charitable
cause. During his early days , when upon
the canala and river ho was regarded as a
hard man to handle and it was seldom
( hat ho found his match in any athletic
sport. Ho was a good man in every re
spect in his class and his death , which
lias long been expected , ia deeply de
plored by all the sporting fraternity.
His funeral will occur tnis _ after
noon , at 2 o'clock , from his Into residence ) ,

Mot a merry but a lively war in prom
ised by the antagonistic attitude of two
rival attractions of a novel character.
These are what are known and have been
advertised us "Tho Wild West. " It
seems there are two combinations run
ning under that title , and a eorioua diff
erence has arisen by the claim of ono to
the solo right to use the name. At a
late hour last evening Judges Jones and
McKcigan , attorneys for Col. Prentiss
Ingraham , filed a petition before Judge
Lubke , in circuit court No. 12 , praying
for an injunction to restrain Dr. Win.
F. Carver from giving an exhibition
this afternoon , and advertised as the
"Wild Went. " The petition sot
forth that "Tho Wild West" is copy ,
righted and is the solo property of Win.
F. Cody , better known as"BulTalo Bill. "
Other allegations were set forth in the
petition , which the Judge examined and
issued an order returnable at 10 o'clock
this murning. After the injunction had
been digpojed of the sauio attorneys filed
attachment suits against Dr. Carver for
printing accounts , the sum duo amount ,
nig to about $2,000. The papers were
at once uiado out and issued to the
hliorill' It being ascertained that Dr-
Carvcr and -combination were coming
to the city from Memphis on the steamer
lUton Kougo , which was expected
hero in the evening , copies of
the injunction and attachments were giv
en to Deputy Sheriff Wheeler , who was
instructed to eeire ihora , The boat
reached the Anchor Line wharf at 7
o'clock p. ra. , and Wheeler immediately
vrent on Inard , served the Injunction on
Dr. Carver , who manifested surprise ,
but readily acknowledged service. The
deputy also attached thirty-one head of
domes , several vehicles and other proper
ties. Soon after Dr. CarVer was driven
in a carnage to the Southern Htol ,
where ho consulted with his attorney ,
Judge Lindloy , and niado airangumonta
: o replevin the articles attached

Dr. Carver , in conversation with a
Globa-Domocrat reporter , said that either
iombination in his catimation was enti-
; led to the use of thn name "Wild west. "
Last year ho and Cody ( Buffalo Bill )
raveled together with a uhow called the
3olden West. In October Isst the com-
iany broke up , but nothing was said re
garding the use of the Wild west or any
Hher namo. Dr. Carver asserted that
.ho rival concern wanted to spoil his bun *
ness by starting a legal fight. Ho wi.s
confident , however , that ho would ha
successful 'in the court proceedings , but
voiild disappoint his enemies , ovtii if he j
lad to give A free exhibition , or un der
another name.

3ol. Prcntisa Ingraham , who is acting
'or the"Butfdlo Bill" combination , claims
hat the proceedinga against Carver are
fully justified. The whole fight by the
"Buffalo Bill" Wild Wear , as oa-orted by
him , is based on three grounds , viz ; 1.
That the title is copyrighted and that W.
P" , Cody is the solo owner. 2. That Carver -
vor is trying to exhibit on the billing of
Cody's combination. 3. That ho agreed
lot to interfere with Cody's exhibition.
Tito fight in court to-day promises to be
interenting.

At a mooting called by the North Oma
ha improvement committee , J. J. Brown ,
Hon. A. J. Popploton , Joe. llodman ,
Jerry Whalen , and Tom Daly , wore ap
pointed committee to wait upon the
| county cammiuionen and rccmott that a
ditch bo built to drain the swamp distric
lying east of JGth ntrcot nnd north o
Nicholas. It is proposed to makothofal
into the city ditch which crosses the hot
torn north of the U. P. shops. The sup
posed cost is about § ! , (00. The matter
on Saturday last , wan laid before the
commissioners who then referred it to
Surveyor Smith for an estimate. A re

next mooting of the commissioners.
