Just before Court opened , the attornejs for the "dc ? fonso filed an answer to the affidavit upor which the writ had issued , setting uj first ; the affidavit did not stnto facts sufli ciont to constitute a cause of action. Sec. and , that the defendants had authority t < issue licenses for parts of a year , prorating ing on the basis of $1,000 per annum. Mr. Ambrose opened his argument by arraigning the administration of the city , stating that if the supremacy of the Ian was not maintained , the good citizens ol Omaha would resort to the shot-gun poli < cy. Ho was interrupted in the midst of his invective by Judge Wakoloy , who said ho would not liatun U > any argument of that kind.V'I am not , " said ho , "in fav or of a eocond Cincinnati. " In tho-acgumonta of counsel for both plaintiff and defendants , there Boomed to uo bnt little variance upon the construct ion of the Slocumb law , the debatable question being the form of the action. The attorneys far the defense argued that mandamus would not lie , as the plaintifl had'p.n adequate remedy at law , and fur ther that the issuance of licenses woo n discretionary act of the council. A Broken Jaw. Sunday evening , as 0. E. Mayno was stooping down under one of his horses , tlo animal lifted its foot in such a man- tor as to strike Mr. Mayno upon the side of his head , knocking him over against a fence and fracturing his jiw.
