AFFIRMED , Tlio Judgment in the CUBO of Con. neil vs. Tlio 1'onnfiylYanla Cen tral AlHriucd lit Olil- Yesterday. Hon. W. J. Connell last night received a telegram from the clerk of the appellate late court of the city of Chicago that the judgment of the lower court in hd'caso against the Pennsylvania Central vail- road had been aflirmod. This judgment , which was for $15,000 , was rendered about a year ago in the circuit court of Cook county , 111. Mr. Council while travelling over the Pennsylvania Cen tral road with a through ticket to Wash ington was put off this company's train by the conductor. Ho brought suit for damages against the road in Chicago and a verdict for $15,000 was returned by the jury. This was afterwards sot aside by the court as being oxoossivo and a new trial ordered. Tha jury in the second end trial returned a verdict ior a like amount. The railroad company made a vigorous attempt to have this ono sot aside but the court refused so to do. The case was then taken up to' the ap pellate court and the judgment for $15- 000 was yesterday affirmed by that tribu nal. OUT DOWN , The U. 1' . In the district court yesterday , before udgo Neville , the jury in the case of tunn against Banks returned n verdict or plaintiff of $1,150. The case of Rous gainst Wright was then taken up to a ury. This is the third trial for this asc , a verdict for defendant in the first laving been sot aside by the supreme court , and a disagreement of the jury in ho second. It is an action for damages > rought on the bond of defendant , who s a justice of tlio peace , for an attach * mcnt allotted to havp boon unlawfully it- sued by him against the property of plaintiff. " It may have been that the intense cold < opt many people from attending the entertainment , and there may bo such a thing as the old play having lost consid erable of its interest to theatre goers. While the play is a standard one and canuot'bo beaten as a backwoods play , yet eleven years is a long time for any play _ to bo presented before the same audiences each season , and people will not bravo the weather on such a night aa last night to see a play which they have witnessed time and time again. As for the play itself it was rendered in excellent style , although a lack of life was noticeable in the first two acts. Davy" was presented as Mayo alone can do it , and as usual was faultless. His leading support , Miss Charlotte Behrena , as "Elinor Vaughn , " was good. Some of the parts , perhaps , were not sustained as well as they woru a year ago , while others wore bettor. The audience was very cold until the close of the fourth act , when moro en thusiasm was manifested , and Mr. Mayo and Miss Bohrons rrero called before the curtain. Always to the Front. I feel It a duty due to the Nebraska & Iowa Insurance company of this city to make the following statement : I recently took out two policies of insurance on my stock , ono in the Nebraska & Iowa for $750 and ono in an eastern company for § 1,000. On February 9th I sustained a serious damage on my property , and in response to my notification of leas said company responded promptly in the per son of Mr. Goodwin , ono of the officers of the company , who made a just and liberal estimate of the damage sustained , and immediately paid mo § 153.13 , this being the first loss paid in the destruct ive lire of the 9th inst. , wherein over § 50,000 worth of property was destroyed. On my policy in the eastern company received only $08.60 damages , notwith standing the fact that their policy was for § 1,000 where the Nobrasda & Iowa's policy was for $750 , yet I received from the latter on mytiamago $51.33 moro than from the eastern company.
