The four boys arrested for breaking in to the now opera house and stealing twc old pistols and some other bits of ntago property were before Judge Aylosworth yesterday. The Rap in the sidewalk on Broadway , in front of the Hordic barn , is very an noying to foot passengers , especially in muddy weather , and , naturally enough , much grumbling results. The injunc tion which Mr. Key secured prevents the city from filling np the place until appraisers are appointed to fix the danv axes , and it is claimed by good lawyers that this stop on Mr. Kty'a part was necessary in order to secure his rights. If the council should appoint the appraii on , the injunction would bo void , the place could bo filled up , and then the lit igation could go on as to the finding of the appraisers , the council having a right to reject the finding ; if it wanted to. In the meantime the public could have the use of the walk. If the council could thus act without jeopardizing the city's right , and Mr. Key could not have lot the work go on without jeopardizing his , it aooins that the muoh-bodrabblod citl- cons should kick against the council in- sUad of Mr. Key , for uubjocting them to inconvenience while the litigation is go- ing on. SONETHING OF A STAKE , About $100,000 , Worth of Council Bluffs Property in Libation for Dyer Ten Years , Still Unsettled. The Cftto of Radford Y/I. / Folaom is ( till in ! court , and comes up to the front at the United Slates court now in nession at Keokuk , Messri. S pp ifc Pusoy , of this city , being attorneys for Radford , and W. S. Mnyro for Foloom. The case involves the title to propcsty now valued at about $100,000. Among this property are 115 foot on Broadtray , including the place known as Pat Lacy's , and several loU west. There are nlio about 200 other lots in this city , nnd COO or ( iOO acres of farming land near hero. The case has been dragging along in the courta far over ten years. It appears that in May , 1871 , Jeremiah Folnom gave to his brother , Simoon Folsom , what seem ed on its face n deed to the property , the consideration being ? 21,000. Simoon Folsom in turn gave to his brother Jeremiah miah a bond in the sum of $21,000 to iccuro the reconveyance of this property from him to'Jcromiah , provided that the latter would liquidate the existing in debtedness of Samuel Folsom , who is a Mn of Simoon , The bond provided that this should bo done within ten years , and stated the indebtedness at $21,000. In 1872 Simoon Folsom in turn docded the ' property thus acquired to his other son , Frank Folsom , and the 'following year Frank commenced an action against his undo , Jeremiah Folsom , to quiet the title and have it settled in him , without a cloud , Jeremiah at this time collecting the rents and otherwise claiming control of the property. Soon after this Frank was thrown into bankruptcy and George W. Had ford was appointed as his ae- signco. About the name time the court put the property in the hands of J. D. Edmunson as receiver. This action was fought along in the courta until 1879 , when Judge _ Loufbourow decided that the dpod to Simoon Folsom and the bond given "back by him to his brother , Jere miah Folsom , formed as ono transaction a mortgage instead ef a transfer of title and Jeremiah Folsom was given until Juno 1,1880 , to redeem the property by paying the amount found then to boduo. Both parties appealed to the supreme court. Radford , as assignee , appealed on the question of the transaction being in the nature of a mortgage ; Jeremiah Folsom appealing on the fixing of the time within which ho must redeem. In Juno , 1882 , the court rendered an opinion sustaining the lower court on the question of its being ft mortgage , and re versing the decision as to the debt being duo , and sent the case back. Then Radford commenced an action in the United States caurt to foreclose the mortgage on this property , and that is what is being contested now in Kookuk. Among which might be termed the side issuas was a decision by the supreme court thai the appointing of a receiver was thus authorized , and ordering him to turn over the property to Jeremiah Fol- soin. The lower court made an entry of this judgment and Radford appealed , and that was passed upon lately , and the de cree of the lower court sustained , and judgment given against Radford as as signee and bondsmen for the costs in the state court. These amounted at that time to $0,000 , by which some idea may bo gained of what a luxury litigation is. MALVEBN MATTEES , A Council Bluff * Youth Tries to Bell His Father's Team Serious ' Hallway Accident In Mills County. MALVKRK , January 31. A young man by the name of Keller , a resident of Council Bluffs , was in town Tuesday trying to nell a horse and buggy. The nrioa at which ho offered them was ao low that auspicious were aroused , nnd a telephone message was sent to the Bluffs inquiring about the matter. An anstrur came that the hdrao and buggy belonged to young Kolloy'a parental ancestor , and thut ho had no right to dispose of them. Thereupon all trades were declared "oil" and the young man loft town in disgust. Malvorn Leader. W. U. Barnes , an old and substantial citizen of the county , died at his homo in Poor Crook Tuesday night. Ho was just recovering from a eovoro stroke of paralysis , and on Sunday evening was taken with neuralgia of the heart , which resulted fatally. The funeral ne'rvicos were held on Thursday , under the auspices of thn O. A. A deaf mute named John L. Pylo wan killed by the Chicago , Burlington & Qujiicy train just east of Malvorn Tuoa- d' y afternoon. Ho had boon at work for Mr. George Stewart , a farmer , and was looking after some hogawhtoh had broken through their iuolosuro and were running on the railway ground. The young man was walking along the track when an on- Sine and caboose came along and struck him , killing him instantly. His akull was fractured , nock and back broken , aud ono log broken. The jury exonerated the railway company. Young Pylo'a homo rriia in Virginia , and his parents are reported to bo quito wealthy. On boiug informed by telegram of the accident they ordered the remains to bo sent there , which waa dono. Aa a freight train waa nearing the bridge over Silver Creek , just Uor leav ing Malvorn , ono of the pavsongora , for sumo reason unknown , jumped oil the train. He received aotno novoro cuta on the head , besides several bruises. The man aeomud crazed when picked up , and would not return to town. Ho waa at lust recognized by an acquaintance , and idontitied as Charloa Poteraou , a farmer lit iii } ; near Hiutinga.
