Threats of violence were made to men who went to work , although none have as yet been assaulted. The striking printers issued umanifcstn Friday evening with a garbled statement of the facts of the ease , and an appeal for nid and sympathy from laboring men and merchants , coupled with threats to the publishers of the dailies. .Saturday eve ning they followed this up by scattering broadcast a paper called the Daily Union. In this paper a ( luring call was issued for a mas meeting of working men thu same night and a challenge to KoHuwator , Yost and Richardson to meet them and state their sidu of tlio case. On Saturday at 5 jj. in , , Mr. Shelly , President of the Printer's Union and another leading member of their body , iniulu a rcqust to the'C managers of thu three Omaha dailies , to meet with them with a view to agreeing upon somu compromise. In re sponse to this request , Messrs. Yost , Richardson and Rosuwater attended this conference. Mr. Shollny expressed himself Anxious that the conflict should cease , ard dopro- cuted the strike , because ho uuntght it was ill-advised. Ho believed that it was in the interest of the men and the pub lishers , to make mutual concessions , and proposed , as a compromise ; that tije ptico of night composition bu raised from 112 to IfUJ cents per thousand ems. On the other hand , the Union would rededo from thu rulu that requires all advertising to go by the piece , if the provisions of the schedule were accepted , and furthermore all men on the strike were to bo employ ed. Messrs. Rosewater and Yost said they uul given permanent places to some men vhom they were bound to to protect. Dhey finally , however , agreed to accept , ho compromise proposed by Mr. Shelley. Sir. Richardson did not like a compro- uiso with strikers , but , after furthei talk , ho said he would give his Html de cision after talking with his partner , Dr. Miller. Wo understand the Herald pro. ; > rioters finally agreed to yield. At ( ! ] i. m. the terms of the compro mise were submitted to a meeting of tht Printers Union and were contemptuous. ly rejected by an overwhelming majority. One of the most interesting cases which tave occupied the time of our courts of late , s that of W. W. Warren , who was arrested in San Diego , Cal. , on the 22nd ) f Oct. , last , over noven months ago on the ehargo of defrauding the bank of Jnldwell , Hamilton Ar Co. out of a con siderable amount of money by checks given him by the Union Pacific and 11. & Af. roads for money not duo him. The railroads were in reality working up the case and instigated the arrest. On appearing in the police court War ren was at once discharged , as it was lain that the bank proprietors were not .h ones to complain , as the checks pre sented were bona fide chucks given by he companies , who alone , if anyone could prosecute , must do so. The two companies , upon this filed com- jiluintH against the defendant , charging liim with obtaining money , which the chucks represented , on false pretenses. Ito wan indicted on both these com- [ iliiintH , and acquittsd on both. In the H. tfc M. case the jury returned a verdict. > f "not guilty without leaving their seats. _ Still determined to convict their vic tim , who had already been in confine- neiit for nearly two-thirds of a year , the iroHocution went back to the old Cald- yull and Hamilton case , on which ho was irst discharged by the police judge and md him indicted by the recent Grand Jury. This case came up this week > oforo Judges Neville and Wakeloy in a motion to dismiss. It ippears that the last legislature msacd a now law in respect to such cases epealing all former laws , without any saving clause providing for prosecutions uider the old law. The ground main tained by Hon. J. C. Cowin , who argued ho motion at considerable length , was ; hat there is now no law whatever for the irosccution of this case , as no law can act otrospectivolv. The court concurred with General Cowin's views and again lischarged him and his freedom ( Toes lot rest upon this technicality , but as shown after proving in a long and trying _ ) rdeal to the satisfaction of courts and juries his entire innocence. It was also charged of late that the de fendant was wanted by the authorities of Urownwille , for some offense committed Lhero but this was disproved also by a telegram seen by the reporter , instructing thu ollicials at this point to release him as lie was not wanted there. Mr. Warren , now that ho has goyo through so much trouble to vindicate his Uond name , proposes to locate in Omaha Did prove to the public that ho is an lionest man. Heal ICmatc Transfers. THE THOMAS CONCERT. > A Noteworthy Performance at the Opera flense , Thu Thomas concerts , which closed on Saturday evening , were the most elabo rate , brilliant and successful instrumen tal performances over given in the city. The orchestra numbered sixty pieces , every ono of which was in trained and skillful hands. Mr. Theodore Thomas , who is the best equipped leader in the United States , conducted the entire'per- formances , and nothing whatever was wanting to the perfection of the whole. Mr. Thomas' system of leadership reach es to the bottom , and overlooks nothing essential t success in every respect. Xot least among ita excellencies is the hand- tiling on the instruments , and this is best seen perhaps in the system of bowing he ho has introduced. Every stringed in- strumcnt falls into the system , the bows of all moving together in the samu di rection. This method not only affords the appearance of perfect unison nmontr the performers , but also insures absolute uniformityiof treatment , and places the volume of sound , at every moment at the perfect disposal of the leader. The BUB , in this general reviowal of the concerts , will not aim at a systematic notice , but will content , itself , with a grouping of the chief character star fea tures. And , first , as to what were presented , hero are thu purely orchestral features of the three programmes. From Beethov en ono piece was given at each concert : The rtmliintc from the second symphony , the allegretto from the eighth symphony , and the famous Lconorc overture , No. 'A. From Mendelsson two instrumental selections - lections wore given : the overture to Jtiijj JHitK and the overture to Midiniinincr Xiyht'H Jrc < im. Of Weber also two specimens were given the Invitation ( o ( he Dance , adapted by Hector Berloix , and the Jubilee overture. Three charac teristic pieces of Liszt were given- the Hunyurian ] lh pMnli\ \ ftintaula on Hungarian airs , with llivo-lving at the piano , and the Syinp/ioniv J'ocinRos sini's William Tell overture was present- cd ; Schumann's Traumcrci , a laryo from Handel , with violin obligate , and the Strauss waltz , Jicnuliftil Jllitv JJaiutlic. The pieces dc resistance , along with the pieces from Lis/.t were the selections from Wagner the f.ohcnyrin IVortyitel and the /tunliaimcr March and overture and the celebrated Berloi/ composition , the Jamnatnn ! nf Faust. This last was first produced in this country about two years since by Mr. Thomas. Itembraces three movements ( a ) the Invocation Min uet of thu Will o' the Wisps ; ( b ) Banco of the Sylphs ; ( e ) thu Hakoczy March These were the purely instrumental num bers. Then there were the following vo cal numbers by members of the company , each with full orchestra accom- panyment : Schubert's Am. ,1/err , by Frank Hommcrylumlo ; , from the Huguenots - guonots by Mrs. Cole : Scenes from Lu- hcnyrtnS < mntl an Alarm , from Han- dit's , /ndaN ; La Jfchic dc ffahn ( Gou nod ) by Mrs. Allen ; the Jtiyulcito quartette - totto ; the Evening Star ritiiidiizti from Tannhausor , by Heonmi > ry ; O. ' Fatima from Weber's Aba Ifaxiatn , by Mrs. Cole ; and the Beethoven Trio. M'liio Hive-King played Saint Saons' concerto in G minor ; the Liszt fantasia on Hung on an Ain , and the Chopin con certo in E minor. The Omaha chorus sang two choruses from Wagner's Lohengrin at the first concert and closed the second concert with four selections from Hondit's J/cvf- sii. . In this last , however , the orchestra pretty nearly drowned the singers out , a circumstance wholly unnecessry , inas much as the chorus was thoroughly up in the music. But for this unfortunate and needless circumstance the choruses , Lift up your Jfcad and Jfallcluja/i would have been among the prime at tractions of the concert. In both of those elaborate selections the chorus was fully prepared , and did a work which only needed to bo heard to bo fully ap preciated. There were about 150 voices engaged , with the Harmonica Society and the Omaha Glee Club as a base. The services of Mr. David Blakely , who has had thu voices in the immediate training for two weeks should not bo overlooked ; while those of Nelson , Mayer and Smith , the leaders of the clubs , must not bo forgotten. The local singers had , at best , an ungrateful task , audit isto bo regretted that through the inanifest inattention of Mr. Thomas their efforts should not have been per mitted to speak for themselves. Among tiu orchestral selections , all of which were given in a perfectly charac teristic manner , thu most notablu were the Beethoved andante at the first con cert , a composition in perfect classical style ; thu music from the 2d symphony , which was very peculiar , and was beauti fully rendered : the Invitation to the Dance , which is Gorman to the last de gree , and embraced a vast deal of fine playing , with great rapidity and precision of movement , and hist , bu * . not least , thu damnation of Faust , in which every ru- fincmcnt of orchestral playing is required. To these should , however , bu added thu Hungarian Khujwody , which is an orig inal composition of Liszt's in thu Hunga rian style. Mr. Thomas' singers all did better in the concerted nieces than in single selec tions , and did best of all in thu oratorio pieces ; and they did best of all in the Jfamiati selections , particularly Miss Cole in the latter song , with sustained and eouablo power , and loft an impres sion which will not soon bo forgotten. 'Mine. Hivo-lving is , in technique cer tainly a consummate pianiste. She plays without the score ; and what seems sur prising is that onu who is such a master of the technical peculiarities of the pecul iarities of her instrument should still be so unsympathetic ami so cold. Hernias- torpiecu was the Saint-Saens concerto in three parts , the last of which consists of pure "gymnastics. " I'pon the whole , these concerts have been of a character new to thu Omaha public ; and if they shall provo the la-gin- ning of a better understanding and of accord among the singers und musicians of our city , their effect will not depart with them. Had the weather not been so oppressively hot , thu attondancowould have been much better enough better to doubtess have relieved Mr. Boyd from the necessity of paying out two or three hundred dollars from his own pocket. This is to bo greatly regretted ; for , cer tainly , Omaha has never enjoyed so var ied and rare a musical treat , and it is to bo presumed that that the future depends materially on the success of this experi ment. In this light , thu financial los sto Mr. Boyd is sincerely to bo regretted. 1'rco DIsiieiiHnry.
