Tim indlctmonta in the cano thcro scorn to bo two of thorn charge , in Bubstnuco , .first , the making of n falao claim against the government of the United States , and , second , aiding another person to obtain payment of 'nlso olnims against the United States. There ara a number of counts in the indictment , but I believe they nro all conceded to bosubhtantially alike , and , hcroforo it will bo oufliciont to con * alder the iirst count aa a fair specimen of the counts. Thin , after certain nl- ccations , Betting forth that Air. Hull was custodian of the United States court-house nnd postofllco at Lincoln , and certain other allegations rather introductory in their choractor , not necessary to bo repeated , proceeds thereafter to nay that defendant did wilfully , unlawfully and feloniously make and cause to bo made and present - sent nnd caused to bo presented to an oflicor of the treasury department ot the United States of America , n cer tain false , fraudulent and fiotitiouD claim and account against the United States of America for payment and approval for 80G yards best quality Napier matting , at eighty cento per yard , alleged iii Bald account to luwo been purchased from ono Albert M. Davia , for the use of said building , at a price of $244.80 , which said claim was falao , fictitious and fraudulent , as said Dtvight Q. Hull well know , nnd that said goods were never delivered by said Albert M. Davis , at the price named at the place named. Then fol lows the allegations that the defend ant , for the purpose of aiding to ob tain payment of said claim , unlaw fully nnd feloniously did make and cause to bo made and used n certain false bill , voucher , receipt or cortili- cflta of account , which is copied in the indictment ; followed by the allegation that said voucher , receipt , bill or cer tificate was , und in , false , fictitious and fraudulent as to the cost or price of said matting , as the aaid Dsvighl Q. Hull well know , "nnd the grand jury aforesaid , upon the oaths nforo said present that the said Albert M , D.wa ! never received the sum o $344 for said matting from the United States or any other person. " There is n very distinct and snfli ciont allegation of the two offenses to which I havu referred , namely : First the making and presenting of a false claim , and , second , aiding another to obtain the payment of a false claim. " It is contended by-jiuisol for de fendant that tub Hccti'm of the stat ute does not describe in general terms the oflfonsa charged in the indictment , but , as I undorsUnd the counsel , they do Insist thtt the statute npplioa only to a party who presents a clvim on his own behalf , and docs not apply tu a person who presents a false certificate or voucher on behalf of some other portion , or in the name of aoino other person. Wo uro unable to concur in this view of the statuto. It appears on the face of the statute that It is in tended tu apply to n case where the porton makes , or causes to bo made , a false statement of this character ; "Where a parson causes to bo pre sented such false statement , or where ho obtains or Is guilty of aiding to obtain the payment or approval of any such false claim. " The use of this language clearly implies the statue is intended to apply to a case where the attorney or agent , or oflioer of an other person undertakes to got a claim which ia false and fraudulent allowed in his own behalf , or in be half of any other party ; otherwise the language "aiding to obtain" would have no moaning whatever.
